  • The FAA released a REQUIRED TRUST TEST for Recreational Drone and RC Pilots. If you fly your UAV recreationally under the Exception for Recreational Flyers you must pass the safety test before you fly. All the questions and answers are here, as well as some bonus material that most miss.

    CBO INFO: "...The Aircraft is Operated in Accordance With or Within the Programming of a CBO’s Set of Safety Guidelines That are Developed in Coordination With the FAA. Once the FAA has developed the criteria for recognition of CBOs and started officially recognizing CBOs, those CBOs’ safety guidelines will be available for use. During this interim period, the FAA offers two means to satisfy this statutory condition. Recreational flyers should be able to explain to an FAA inspector or law enforcement official which safety guidelines they are following..."
    **** Technically you DO NOT need PRINTED CBO documents with you, you only need to be able to state what CBO guidelines you're following (in addition to the FAA rules for recreational pilots). My experience is that it doesn't hurt to have it along though, as when the police are my face my memory isn't as sharp as it should be... 😉 For the moment, the easiest is to use the existing rules from the FAA for recreational pilots (or the AMA rules, see the links below) as a 'proxy' for the CBO Guidelines. You need to be able to state that's what you're doing though, "...Yes Officer, I can tell you what CBO rules I'm following, but at the moment I am substituting these guidelines instead of using the CBO guidelines as allowed by the FAA as stated in AC 91-57B in this interim, and the rules are...(state the current recreational pilot rules or the AMA rules)". Keep in mind though when the FAA recognizes actual CBOs you'll need to pick one and be able to discuss and follow those rules. This is probably coming soon, before the end of the year is my guess. I did add links below to make it clearer as I think the FAA made it a bit more confusing than it needs to be with the AC 91-57B circular.

      Glad it was useful to you! Technically you DO NOT need CBO documents with you, you only need to be able to state what CBO guidelines you're following. My experience is that it doesn't hurt to have it along though, as when the police are my face my memory isn't as sharp as it should be... Having them along does show professionalism even if you draw a blank when trying the discuss them... :)

      Awesome! Note that the CBO doesn't have to be in your area as you don't even have to join, just follow the rules of one. You can if you want, but not required... Make sure above all you have fun, that's important! Good Flying!

    Keith, love your channel. I have been following drone channels for years and never ran into your channel untill last week. Thanks for doing your compliance videos. ...very useful.
    My neighbor started giving me a hard time amout my mavic mini 2 and he is the type to call the cops. I had no idea the FAA had changed thir rules for recreational flyiers to include a test. Just took it to make sure i am completely legal. Thanks so much!!!

    I am an occasional recreational flyer (Mavic Mini) and had no idea this was coming. This is why I subscribed to your channel last year. This video is most helpful and shows that I was following the rules already. Question: Part 4, question 3 is confusing. This was the only one I got wrong in the entire test. Answer is both, but since I am not required to register the "mini" I only checked the test certificate. Clearly this question is geared towards the over 250 gm drones. You correctly state in the video that you "may or may not need" the registration depending on drone weight. Be that as it may, I now know to answer "both" to this question. Thank you for this tutorial.

      Indeed, I was thinking if I didn't want to register a mini and still fly then completing this test will be required on top of the 107 so I can be a legal hobbyist. In contrast to what I've heard mentioned elsewhere, this is not required for part 107 certified pilots performing 107 missions. If you're flying recreationally, even if you have your 107 certificate, you need this training certificate. It was straightforward to complete for sure, about 8 minutes and I was recording the video at the same time. Surprised the FAA stated 1 hour was the expected time. I could start the test, go fly the mini around and deplete a battery, come back and finish and still have time left over... 😎

      @@daviddarviewsandmore1697 Hello, the video you commented in here should give you the direction on what it is and how to complete it. Links for the different items to review are in the description. It is a safety test that you can't fail, REQUIRED before flying any drone in the airspace in the US, even the Mini 2. So if you are in the US and haven't taken it and you have flown or plan to fly, certainly don't post videos before you take care of this. It is free and required in the US. It's pretty easy and there's good info, but if you have specific questions let me know, happy to help.

    I took the test. I finished the test in about 10 minutes. I actually learned more about drone flying from the drone group I joined 2 years ago which is what caused me to complete the exam quickly.

    Thanks. I took my test a couple of days ago through the AMA. The presentation and administration were different, but the questions were the same. Since the AMA is a recognized CBO, I have always carried my AMA card as well and followed their safety guidelines.

      That's awesome! Always good to have the info, never know when you're going to need it! Technically the AMA isn't a recognized CBO, yet, (there are none at the moment) but the FAA does say to use their guidelines until there _are_ recognized ones, which I can't imagine wouldn't include the AMA, so you'll be ahead of the curve!     One thing that I think is very import is to get propeller protectors installed on the drone.
    The protector is not only protector the drone from collision, but also protect you and other being hurt.
    Specially beware of your neck when you are holding the drone.

    When you state

    What exactly are you referring to? do you mean state all of the rules from the CBO you have with you (ie following)/ ? or do you just mean

      Thank you for for watching and the kind words! So the purpose is to be able to say "Mr. Officer, thank you for asking! I'm following the AMA CBO Guidelines while I fly under the rules for Recreational fliers under 44809." The thing that this does for you is set the rules against which you will be judged at that moment. So for instance, you are flying directly over a person on the beach, and you say you are following the AMA CBO guidelines, which states that you will not fly over people, which means you are breaking the recreational rules and means you automatically will fall under art 107 rules. Of course, the whole point is to be conscious of the CBO rules and follow them. It is my understanding that the CBO (at the moment) that has clearer and more favorable rules is the FTCA: ftca.flitetest.com/safety-guidelines/ but certainly use the one that you plan to follow... As the FAA recognizes CBOs in the near future hopefully there are recognized ones that work for most hobbyists, but time will tell, but this is what we have until then. Hope this helps. Good Flying!

      Indeed I was surprised when the instructions mentioned 1 hour for the course. Took me about 8 minutes but I was recording it for this video so it took a bit longer. I don't think the certificate is really valid without the FAA shirt though... lol. Good Flying!

    Strictly speaking, you don't have to have the CBO document with you. You just have to be able to explain the guidelines you're following. I think you were one of the people I saw discuss that sometime last year, along with Greg at Pilot Institute in one of his videos. After that I made a point of preparing myself to have that conversation if it ever came up.

      Technically you DO NOT need PRINTED CBO documents with you, you only need to be able to state what CBO guidelines you're following. My experience is that it doesn't hurt to have it along though, as when the police are my face my memory isn't as sharp as it should be... 😉 For the moment, the easiest is to use the existing rules from the FAA for recreational pilots (or the AMA rules, see their site for rules) as a 'proxy' for the CBO Guidelines. You need to be able to state that's what you're doing though, "...Mr. Policeman, I am substituting these guidelines instead of using the CBO guidelines as allowed by the FAA as stated in AC 91-57B in this interim, and the rules are...(state the current recreational pilot rules)". Keep in mind though when the FAA recognizes actual CBOs you'll need to pick one and be able to discuss and follow those rules. This is probably coming soon, before the end of the year is my guess. I did update the links in the description to make it clearer as I think the FAA made it a bit more confusing than it needs to be. Hope this helps! Good Flying!

    So Cessna pilots need a visual observer on the ground with line of site of their airplane because they are flying first person right? My fear is that making uav rules more strict than actual pilot rules will lead to people disregarding them entirely.

    When flying away from home, there is a current aeronautical chart, & full copy of the FARs in my truck, within view of where I’m standing. Have dealt with the Faa for decades. Most of the FSDO guys think of a license as a starting place to learn, as opposed to local Leo who will think if you have a license, you must know it all. Goal is to become a porcupine, too much trouble to deal with.
    When you can’t dazzle them with brilliance, baffle them with bull Shyte .

      @@AlienDrones am not keen on trying to keep rec and non rec flights separate. Film is always rolling, and therefore stands the possibility of someone wanting it for commercial purposes ( even film from the tiny whoop stands the possibility of sale). While I’ve gotten the trust ticket after discussions with other pilots, (more for local Leo than faa) I don’t see it as relevant to 107 holders. Am also seeing a lot of confusion in the rec side, thinking that because rec rules don’t specifically spell things out that they don’t have the same rules… like night flight. No rules mentioned in rec so hearing pilots say they don’t need strobes or follow other regs cause they’re rec pilots and the rule doesn’t apply to them same for flight over people. I see a lot of confusion that needs to be ironed out.

I almost always fly 107 so this is not required but there are a lot of recreational pilots out there who are simply ignorant of the rules and regulations but I do try and educate every chance I get. Worse than ignorance are those who won't be pressured by "big brother" and refuse the simplest rules or regulations, but can only do what we can do... If someone simply refuses when presented information, well... 💪🤜

      Howdy! Thanks for the question! In my understanding there is no exception for this regardless of weight. The fortunate thing is that this is fast, easy, free and requires or logs *none* of your personal information. So if your equipment and operation doesn't require registration so at the moment, you can legally still be completely anonymous, at least until remote ID rolls out... 😎 Good Flying!

      If you are flying as a recreational pilot _only_ then one registration number will cover both drones. If flying under part 107, then each drone needs its own registration number.

      That's a great question! You can definitely take the training even if not required, it will be useful information for flying safely regardless of where you are, but of course still look into local rules and regulations so you stay in compliance with those... Good Flying!

      From what I can tell, if this passes it will end recreational UAV use as we know it today. "Stick a fork in it" done. But of course, still allows for Amazon and UPS to have the airspace. Hopefully I'm misinterpreting the bill. I started to read it a few times and can never make it to the end. 😕

      @@AlienDrones I’ve read it in various versions. This one just governs commercial use, no mention of recreational use. The biggest change was that it tries to protect commercial landing zones from being regulated out of existence and guarantees their access to the commercial airspace between 200-400 feet. I guess UPS and Amazon leaned on him pretty hard. That being said, I don’t think you are misinterpreting the bill at all. It looks to me to be a misguided attempt to try to put toothpaste back in the tube. UAV users are here and are not going anywhere. It is just a question about how you can regulate them in manner that is easy to comply with so that they will operate safely. This bill simply turns up the current morass of local regulations to eleven which guarantees a higher rate of noncompliance.

      You don't have to if you always fly 107. One reason you may want to have this is if you don't want to register one of the sub 250g drones and fly it, as you can only do this as a recreational pilot. Once you fly 107 then you are required to register it. If you don't want to be burdened with all of the 107 regulations and simply want to fly recreationally at some time then the recreational certificate is required... Hope this helps, good flying!

    Recreational flyers probably aren't doing it because there was no notification of the test. The only ways recreational flyers would know of the test is by word of mouth or if they had to renew their registration (or register for the first time) and actually read the requirements and even if they did, the test did not exist until early summer of 2021 even though technically the FAA added that to the requirements a long time ago without any notification whatsoever to the recreational pilots. If they can notify pilots of registration renewal they can notify pilots of tests when they become available but they don't. Am I surprised that the FAA moves the goal post by changing the rules without any notification? Not at all, that is what they do.
    I contacted the FAA back in March or April of 2021 with questions about the test. First I got a computer response that left more questions and answered nothing. I contacted the FAA again and requested a response from an actual human being. The response I got back then was there was no test of that date and they didn't expect the test to be ready until early or late summer of 2021. The FAA also said until that time you can fly and there is no rush to take the test. That said, I don't trust a word that comes out of their mouths.

      These are the questions that are in the test and I don't believe they randomize them like they do on the 107 exam. As this is considered training as well, they are pretty straight forward.

    Wow. More paperwork. Heavy pants. Gravity sucks. FAA also. But, this is the price for advancement, and I'm o.k. with making people cognizant of the risks, since essentially newbies are offered technology they probably really don't understand in the least. Today can someone buy a drone and not understand they cannot fly it above 400 feet? Absolutely they still can, especially from the various drone sites that do not publish the rules, maybe it's in their literature somewhere - but yeah, I get it. Anyway, this was an expected cost, and I'll pay it. As for the FAA, I get it. They never get public praise, hardly anyway. But we need them.

      Indeed, awareness is good, that's for sure. Not sure if it will change much though. My guess is if people aren't interested in the rules, they won't bother with this either. The people who seek out the education are already being safe regardless of this test, the people who don't care probably still won't care... But, kudos to the FAA for trying to educate, worth a shot.     Okay, so I have a cheap little "toy drone" that does have a camera on it. I am new to drones and i have some footage i thought about posting on my channel. It's not of anyone but me and family. Am I still not allowed to post footage? Like I said I am new to all of this and i am so confused. I got the drone to post videos or pictures up of like scenery or with my family or friends and I'm not even sure if I can post it?

I had no idea about alot of the information cause like I said I am new to all the drone stuff. When you purchase drones(the one I got was gave to me) do they have any information about the FAA inside it? I understand everyone needs to do research if they want to fly, but until i ran across your channel I knew hardly anything and it worries me of what else I could not know. I am not out any money cause of the drone being gave to me, so if it became to much to deal with. I wouldn't even bother any more. But I am just getting started and it feels overwhelming that I don't want to do anything wrong.

I am really good at obtaining information if it is laid out in front of me in sections and for me to get an understanding of something. I just want to know all I need to know before going out and flying my drone anymore(deleting footage I have, it's nothing i am too worried about. It was just of me and some family outside doing outdoors things and nothing to hide) I just dont want to take my chances. I will take the Trust test soon cause i do love flying drones and all. I just want to figure out if i ever want to do the 107 test. Because i would like to grow my channel. I also have thought about a career in drones. But i want to know if it is for me and if preparing for the 107 is for me.

When I studied for the 107 exam I decided I wanted to do it on my own and I watched a video from Tony Northrup: th-cam.com/video/6_ucCKFJUCU/w-d-xo.html and searched around the internet for test questions, just to get a feel for it. I passed with 95%, but honestly if I had to do it over I would probably plunk down $100-$150 for a course from a reputable training service, would be easier and probably take a fraction of the time. PilotInstitute.com guarantees you pass, so if it were me, I would do that. Right now there's a $100 off sale (I am not affiliated with or make no compensation from them, BTW) use "HOLIDAYSALE" in the coupon section, that's about as cheap as I've seen it. If you do decide to go there, let them know Keith from Alien Drones sent you. Always good to help each other in the industry... As far as the 107 test, you can *only* take it at a recognized testing center, not online. Takes a couple of hours and $150 + fees, mine was actually at an airport. The official test center nearest you info will be part of the course info. Anyway, hope that helps! Good Flying!

      If you enjoy flying is is worth getting the 107 certificate as you learn a lot and you do have more credibility and can do more things and don't have to be bothered by the weight of the craft. It's kind of a pain to only fly sub 250g drones if you're worried about registering, sometimes you just want bigger and better. If you're interested in a course, I have worked with Pilot Institute for a study course, they guarantee you pass or money back. It helps support the channel if you use this link: bit.ly/3rwJrxV (or enter ALIENDRONES in the coupon section) you can get $100 off as well. They have a bunch of free stuff on the site too, worth a look. It always depends how you want to use drones if it's worth it to you or not to get the 107. Now the recurrent test is completely free (used to be $150 every 2 years) and the recurrent is online so you don't have to go to a testing center (just for the initial) but once you get it, it's good forever for free at this point, just keep up the recurrent.

      Not sure what the context of your question is but the certificate from the TRUST test is likely not the same as the "Flyers ID" or the "Operator ID" to my knowledge.

    I want to know why drone pilots habe to take the commercial pilots test every 2 years and a private pilot only has to take the test once. I dont think this is fair game to the drone pilot.. What's your thoughts on this.. I would take the test but i wont do it being i have to do the test every 2 years.

      I agree this seems odd, but that being said, the "test" for commercial 107 pilots still exists but it is now more of a _training_ and the test portion is correctable so you can't really fail, and it's now free instead of dropping $150 each time. Perhaps there is just a higher expectation of drone pilots, not sure. I know I hold them in high regard! Good Flying!

    I did not see that on my test and have no clue we had a CBO we must follow. I am sure a High % of people with drones just do not look to see if the Gov. has updated rules. The same goes with any new rules unless it is published everywhere most are not going to take the time to seek this information. In my quick opinion and I could be wrong it just sounds like a CBO is going to end up like the HOA of drone flyers.

      No. All recreational pilots need to have the TRUST certification and need to follow all the rules regardless of weight of the aircraft.

Recreational only flights and don't use the video for growing a channel for instance, even if there is no compensation, or it could be considered a 107 mission, requiring registration and a 107 certificate...

    This is just the next step in the FAA forcing recreational pilots out… it’s going to be choosing between being confined to a CBO field in the middle of nowhere or being forced into taking the 107 test, which I cant even do now because everyone in my area is afraid to have someone else breath on them.

      Thanks for sharing! Trying to see the silver lining here, but this doesn't seem to be too bad, just a bit of common sense training and nothing is logged with the FAA like registration does. In the most general sense it is nice to have some "basic" training for everyone flying a UAV in the airspace, and it's fast, easy, private (no personal information required) and free.

      @@AlienDrones I learned more watching a few TH-cam content creators… I didn’t read any of the course material, just skipped to the quizzes and got 100%… likewise people that don’t care, won’t care, wont learn and won’t fly correctly/safely… they will have their certificates, because they can do exactly what I did and if they hit “check answer” they can pick until they are correct. Not exactly a great learning tool. And the government is crafty, like that little part about recreational pilots needing to associate with a CBO or whatever the wording was… its a needless baby step to more control of recreational pilots.

      Hello! Sorry, this is untrue. 107 pilots can fly _recreationally_ but are still under part 107 so this has nothing to do with 44809. The TRUST test is part of 44809. If a 107 pilot wants to fly the same drone as a rec pilot under 44809, they would have to deregister it from 107 registration then reregister it as recreational, then they could take the TRUST test, then fly it recreationally.

    Thanks, Keith. This was very informative. Betting we drone pilots will hear from fixed-wing and helicopter flyers how we cause this. But in reality, it was coming for them (us) anyways.
    To me, the FAA knows or cares about 4 things. Airspace, Aircraft, Airports, Aviators.

    The question isn’t can I explain the rules to them it’s if they have enough experience to know the difference between what I tell them and any BS I make up because I seriously doubt any flat foot I meet in the mountains will know his butt from a hole in the ground

    Great! Just took the TRUST test and passed 100% first time, also registered my drone and labeled it! Now for a question for you....which new app do you like best for B4youfly ? I've heard there are some restrictions here on the Oregon coast, so need to practice and get really comfortable in our winds and coastal features. Love your channel and appreciate your humor and direct but informative content. You are my go to resource! 😁

      @@AlienDrones lol im tempted to look at it. im sure passing is a no brainer if your able to press a button. but im not gonna take it on principle. (but people will say it takes all of 5 seconds well not 5 seconds but... its not the ease its the fact that its another hoop thats designed to discourage people from the hobby by constantly adding regulations. well i wont bend to their will.)

    The AMA completely wipes out things that the FAA has allowed, making them more restrictive because their rules were meant for RC aircraft....which are a lot less safe and often heavier than drones. For instance the FAA allows you to transit over people and moving vehicles (not remain above), while the AMA outright prohibits it. Seems to me that the fix is in and the AMA is worse than the FAA in terms of restrictions. Unless the AMA revises their rules for drones under 250 grams I'm no fan of theirs.

      Interesting perspective for sure. Over the past couple of years someone flying as a hobbyist actually had more freedom to fly in more ways and more places than someone who sought out more education and got their part 107 certificate. It almost made me abandon the 107 as it seemed silly and backwards. Now it seems the FAA is unwinding this a bit and there will possibly be advantages to having a 107, which honestly there should be. I think (IMHO) that they don't need to restrict the hobbyist more, just let us fly in line of site below 200' safely and call it a day. If you want flights over people, BVLOS, flights in restricted areas, controlled airspace, at night, etc. which are more advanced and inherently less safe operations, then make 107 required for those and move on... simple. But that's just me... 😎 Good Flying!

    Just wait soon we will need a licence for any activity! A licence to: for any sport...bowling, golf, tennis etc, to walk, to speak, eat, breath , use a chair, watch tv, oil paint....etc etc! 1984 is coming!

    then i guess ill fly illegally. *Update i took the stupid test. honestly i kept clicking next till i got to the questions and just answered them (didnt read any of the actual content) tbh its a common sense test so its literally just a waste of time but hey the FAA wants me to waste my time fine whatever as long as i dont get harassed by cops or whatever ill just give them my reg and cert and tell em off. if you got a 1.5 minutes to take the test then just do it. its over as fast as you can click next and have the subsequent pages load.

    Use AMA instead. They don't require any email address just your name They provide a link. Besides... The level of the test really shows the level of FAA regulators.

      @Siamect According to the current FAA website, the AMA is an authorized administrator of the test but isn't an officially recognized CBO, none are. They may be recommended safety rules but not a CBO. From the FAA: "...Follow the safety guidelines of an FAA-recognized Community Based Organization (CBO).
      Note: We have not yet begun officially recognizing CBOs. Recreational flyers are directed to follow the safety guidelines of existing aeromodeling organizations or use the FAA provided safety guidelines per Advisory Circular 91-57B...". Maybe there's something in the works but this is the official "in print" from the FAA...

Think I misunderstood your comment about the AMA earlier, you were simply talking about the test location and I had "CBO" on the brain as I just got through a bunch of questions about this. Of course you are correct about the test, no email is a benefit and the AMA is a good spot to take the test. Apologies for misunderstanding, good flying!

    In regards to your link above for FAA CBO Rule1, what do the requirements for an Air Boss and Air Shows have to do with piloting an sUAS (recreationally)? There's no mention of a CBO that I could find.

      Indeed, I can only assume the FAA has something linked wrong, as they state you can use the existing rules from the FAA or AMA guidelines as a proxy until the CBOs are recognized, then list the "air boss" document. I think I'm going to update the link in my video description so it makes sense and try to interpret the intent of the FAA instead of the odd link they have... It should be updated now and make more sense...

    I prefer to safeguard my privacy when flying a toy. A citizen should not have to obtain a license in order to operate a UAV (unless it is a commercial operation or the FAA has already classified it as a possible threat--like a passenger airplane.) The airspace above our heads doesn't belong to the FAA. It belongs to the people of this country and under the US Constitution we are all equal. The FAA maintains no authority over anyone except those who possess an aircraft-certificate for operating an aircraft for commercial purposes. The FAA claims to own all airspace above the United States, putting you under their preemptive authority regardless of whether you want to acknowledge this outright prerogative. A non-commercial pilot certificate requires you to get permission for everything you do that involves flying. The Federal Aviation Authority provides a false prerogative in order to fly your toys in the sky. In fact, they consider it an unlawful act of treason if you toy operators don't seek permission from them and abide by their rules. The FAA is using non-commercial licenses to track and register citizens of the USA.
    It's not that the FAA would be powerless to regulate the likes of Amazon and Google if they want to start using drones for deliveries, or surveying their large plantations by air. It's just that private commercial uses of drones are in a regulatory grey area where the FAA's licensing authority by law is very limited.
    The closest authority they have is derived from two sources: Congress' power, under the Commerce Clause, and the inherent powers of the Executive Branch. Therefore, anything they do with regard to regulation of aircraft falls within at least one of those two Constitutional grants of authority.
    FAA regulations are written in a way that can be interpreted in many multiple ways. It is ambiguous because its very nature contradicts the Constitution. The Fed granted itself too much power, it is unconstitutional for a citizen to mandatorily acknowledge any dominion the FAA may have over certain air-space, but logically this is inapplicable to many citizens regardless of the FAA arbitrarily configuring their rules to include toys and sUAVs. Non-commercial licensing is redundant and a way to confirm that a citizen does indeed acknowledge their authority.
    As of now, the FAA specifically prohibits you from operating a drone for fun. Currently the FAA has disproportionate authority to restrict property rights of individuals in an arbitrary fashion, by law this is not permissible.
    In a world of technological innovation - private citizens should be free to fly in the sky without going through official licensed systems; while remaining ensured that product safety is absolutely paramount. Commercial licensing will only serve to protect big businesses and allow government bureaucrats more access to individual’s information for needless tracking and control.
    The FAA has been using an unconstitutional standard to determine whether or not to grant waivers for drone operators who want to fly recreationally and eventually - the agency's entire drone waiver process will eventually be under question.

      Howdy! I appreciate your thoughts! In this case there must be a bit of a misunderstanding as this video specifically cover simple _training_ and not a license by any means. The _testing_ (if you call it that) can't be failed and the questions are safety related and are very common sense. There is no personal information required to take the course. Your comments "...As of now, the FAA specifically prohibits you from operating a drone for fun" is incorrect in my understanding. There is a specific _carve out_ in 44809 that allows this specifically. I do understand and agree with many of your thoughts that there has been an likely will continue to be overreaching authority in this and many other instances for sure.       “(7) The operator has passed an aeronautical knowledge and safety test described in subsection (g) and maintains proof of test passage to *be made available to the Administrator* or law enforcement upon request.
      (8) The aircraft is *registered and marked* in accordance with chapter 441 of this title and proof of registration is made available to the Administrator or a designee of the Administrator or law enforcement upon request.
      …(d) Updates.-
      (1) In general.-The Administrator, in consultation with government, stakeholders, and community-based organizations, shall initiate a process to periodically update the operational parameters under subsection (a), as appropriate.
      (2) Considerations.-In updating an operational parameter under paragraph (1), the Administrator shall consider-
      (A) appropriate operational limitations to mitigate risks to aviation safety and national security, including risk to the uninvolved public and critical infrastructure;
      (B) operations outside the membership, guidelines, and programming of a community-based organization;
      (C) physical characteristics, technical standards, and classes of aircraft operating under this section;
      (D) trends in use, enforcement, or incidents involving unmanned aircraft systems;
      (E) ensuring, to the greatest extent practicable, that updates to the operational parameters correspond to, and leverage, advances in technology; and
      (F) equipage requirements that facilitate safe, efficient, and secure operations and further integrate all unmanned aircraft into the national airspace system.
      …(e) Statutory Construction.-Nothing in this section shall be construed to limit the authority of the Administrator to pursue an enforcement action against a person operating any unmanned aircraft who endangers the safety of the national airspace system.
      (f) Exceptions.-Nothing in this section prohibits the Administrator from promulgating rules generally applicable to unmanned aircraft, including those unmanned aircraft eligible for the exception set forth in this section, relating to-
      (1) updates to the operational parameters for unmanned aircraft in subsection (a);
      (2) the registration and marking of unmanned aircraft;
      (3) the standards for remotely identifying owners and operators of unmanned aircraft systems and associated unmanned aircraft; and
      (4) other standards consistent with maintaining the safety and security of the national airspace system.

They “control” airspace to confine those to using aircraft only within an arbitrary regulatory space created by federal agencies who have no rights under the constitution and who are trying to remove freedoms in favor of authoritarian control domestically. The FAA now says they will fine or imprison private pilots for taking pictures of their own property from the air. If that sounds bizarre to you, you’re not alone.
      Government is many layers deep and can’t be controlled because we aren’t in every layer of it. If they want to make rules within the boundaries of their job, your government gives them the right to control the rules and laws. They have to write regulations for them for that reason; laws are different than regulations. Regulations seem a lot like laws when you read them, but they’re ALWAYS not enforceable by typical/normal legal action, which involves superimposed control.
      The Federal Aviation Administration is pushing laws under examination that do not entirely authorize them to restrict the flying of remote controlled aircraft systems, but yet, they are placing unconstitutional and totalitarian restrictions on their use in public airspace and therefore allowing for arrests to be made against a citizen exercising their rights within public airspace by showing it was “causing a disturbance in the peace” or any other reason they can manipulate.
      The FAA is the expensive way to solve a problem that could be solved less expensively and with more liberty.
      They have been one of the most counterproductive and unnecessarily bureaucracy-ridden agencies to ever reach American privacy. They are completely incompetent when it comes to talking with average Americans, a fact that people will begin to see more clearly in regard to drones and their presence in our air.
      As long as our constitutional rights (actually, natural rights) are intact, nothing the FAA does or what the police do can curtail the flight of an individual citizen.
      Congress has overstepped it’s bounds. Now the FAA is implementing all kinds of unconstitutional and tyrannical restrictions that restrict us from flying our drones. This is a blatant violation of the rights we have as citizens, so we the people must support repeal of the FAA’s authoritarian laws on UAVs - while publicly admonish their dominion without acknowledgment on simply a weak federal basis.
