  • A simple man called me and said he was about to buy a flat from a builder. I give him some simple, straightforward, blunt advice. I said, "Don't buy flats from any builder. Buy a ready-possession flat only from an actual user or an investor." I warned him not to get sucked into a sales office, which is like a spider's web for a fly.

    This video was so much helpful for me. I'm looking for home ..I liked new property and I asked the sales team for agreement draft copy (soft copy) so that my family lawyer can go through it but they did not provided me..I asked them for the reason but no satisfactory answer was given. I have changed my mind, now looking for a resale flat or ready to move OC received property. Don't buy promises by your hard earned money. Think 1000 times and ask 100 questions to sales team..and most importantly have confidence. Thanks Krishnaraj

      Title search with the registrar.
      Freehold/leasehold land ownership
      Society records, nominee, membership
      Construction quality with the help of an engineer/architect
      Leakages etc
      Krishnaraj sir will know a lot more but this is the minimum

    I bought flat in trisara group gurgoan..we paid downpayment..then later they said 80%bank loan..we wait for bank loan every time cancel ..tried many loan still cancel..even my friend 5 of my friend bought and paid 10% like me..every ones bank cancel..later sales office people said we need to pay .but still we paid 2and install.they told us this time bank will finance .after 2nd install still bank denied ..me and my friend wasted many money my friend too..after cancelling the flat they charge us heavy penalty amount..

    Yes its good to buy under resale but some body has to be a first buyer from builder. So stringent laws are must for both parties to comply.

      (1) Somebody has to be a first buyer. Just don't let it be you 😂
      (2) If most customers avoid booking in under-construction projects, then builders will start selling ready-possession flats only after getting OC i.e. they will mend their ways.
      (3) Also, if most customers avoid builders who force terms & hidden conditions on them, then builders who are transparent in their dealings will succeed, and sneaky builders will fail to be profitable.

      @@KrishnarajRaoUrbanNaxal Dear Sir. While I appreciate your efforts for a commendable job for public, I would like to highlight one point. If builder will sell flat only after getting OC, which means builder has to take loan which implies flat cost will be high so may not be affordable by many people. The bottom line is stringent laws are must for both party. You know the conditions of banks in India with High NPA'S. You have put cases in TH-cam, reputed builders are cheating people in many ways. This is because our laws are there but not strictly followed. Many rera cases are pending even after builders are asked to pay the customer by the tribunal.

    When we apply for loan to purchase a resale flat then will bank check legality and title check for the property before disbursing loan amount?
    Because many a times I heard people saying if bank is approving the loan for a particular property then property will not be having any legal issues...

    I suppose this buyer on the call is talking about buying a flat in a new project......so should he buy from builder or investor?? Since it is a project where possession is given after 6 mths.

      What is the guarantee that the possession will definitely happen within 6 months? how do we know that the builder even intends to give possession in 6 months? Suppose it doesn't?

      Even I'm not confident.
      But on completion the rate goes a lot beyond budget.
      Hence the was looking for something like near completion.
      Pls guide about This possession on RERA date

However, if he doesn't deliver, you will have to to go to RERA or other judicial forms to get enforcement of his legal obligations (i.e. your legal entitlements). There is no authority that enforces the builder's obligations suo motu i.e. without any need for action from you. And I need not tell you about how much of a pain and struggle it is for you to engage a lawyer, go to RERA or other courts, and fight a legal battle.
