    He's absolutely right, if you smoke it will turn the walls brown around the pictures not to mention the smell.I advise if you smoke don't smoke in your house it runs everything.

    When you paint the walls a different color, it is usually with the landlord permission and must be painted back to the original color when you vacate the rental property.

    I’ve been binge watching people’s court, and I notice she typically is passive aggressive, she often says something nice to the litigant before bringing down the hammer (ie you have great handwriting) lol

    I’m a smoker but refuse to smoke in our house.
    I always go outside to our covered deck or into our heated (50 degree) garage during our well below freezing temperatures.
    I also refuse to smoke in my wife’s car out of respect for her.
    The windows in my car or our pickup are always cracked (we have window vents on all 3 of our vehicles so that the rain and snow can’t get into our vehicles).
    Every 2 years our vehicles are professionally cleaned and detailed on the interiors to rid them of smells.

      That is very honorable of you. I’ve been with my bf 7 years and he knows how sensitive I am to cigarette smoke. He uses my car often and I’ve always felt like it smelled like smoke but thought I must be wrong. I ended up catching him smoking in the car the other day,he’s been smoking in it the entire time and telling me he wasn’t.

      @@AtonalApple It’s not my business, but if he’s dishonest with you about him smoking in your car, then what else is he deceptive with you about?
      If I ever say or do anything that I shouldn’t have, I own up to it.
      I’m very selective on who I allow into my life. If they’re dishonest, they’re gone.
      I’ve been secretly stashing money back and a couple of weeks ago my wife found my stash (in my nightstand). She asked me about it, so as always I was truthful about it and told her that I’d been saving money as I could to buy her something as a gift just bc I love her.
      I’m thinking about a pair of Diamond ear rings.

      not that bad unless someone is sensitive to every single smell on earth. most of that in the pictures looked like orange mold, orange
      Aspergillosis, a lot of people confuse it for tar residue.

      Yes ,I agree. I've been in the renovation business home and business ... Some people just don't understand how much third hand smoke gets on everything and how hard it is to clean. Smokers loose their sense of smell and taste buds too.

    I'm a nonsmoker and I would never take an apartment where a previous smoker lived without the entire place having been cleaned of the nicotine. In the pictures it is very clear the plaintiff was a heavy smoker.

      nicotine doesn't leave stains, that's not where the stains come from. Tar does it. Nicotine is a stimulant. If I spill my soda I'm not going to say the caffeine stained my rug.

      today yes, year sago it wasn't like that, most tenants painted & carpeted apartments, smoked inside, put down contact paper etc. Only in the last 20 yrs have landlords not allowed tenants to do anything on these places.,

      Yes, and no. When you are a heavy smoker inside it needs much more cleaning and painting in a different way than from just regular daily living

    Judge, I don’t know about now, but under WA state law every time a tenant moves out after at least a year, the landlord must repaint the interior of the property.

      In Ohio it's not required for Landlords to paint their rental units. In some cities it is, but other than that they aren't required by any means...

    Tenants should stop with the "" Sense Of Entitlement"" regardless of how long you are there, you are a renter, she struck me as that type, but Judge Milian upset me in this case, instead of wasting so much time focusing on the paint color change, like the landlord why were all the holes, in the walls, she is far too old for children, so was there domestic violence, what happened and we never got the reason 😡

      she likely hung pictures like most people do, and then tried to cover it because landlords go ape shit over the smallest holes in the walls, she was screwed either way he'd sue her for that as well. all he had to do & grab some good grit and sand it down but those paneled walls will be ripped out anyway. He likely spent the deposit & doesn't have it anymore & is likely having trouble selling it, this is textbook, a lot of them do this shit.

      She had a great reason to talk about the painted walls, for the plaintiff did not have permission and was to return the walls to original state. Every lease states that. And who says her adult children are too old or herself to put holes in the walls. Even when you hang stuff and make holes with nails, you are to return the rental to original states, by putting the holes that were made by the nails. Gues you have never rented a place, or never rented out property.

      The wall color was a very important part of the case because if she painted it brown when the walls were originally white, she would’ve been responsible for painting the rooms back to the original color. That would then mean that the landlord could have had the right to keep back more of the security deposit due to brown having to be covered with multiple layers of paint. She got on the plaintiff and defendant on their lies. She handled this case fairly.

    I bet the apartment was white and the plaintiff (as an ex-smoker) had enough experience to know that white paint turns yellow/brown with smoke. She must have thought that the cocoa-brown paint would hide the yellowing caused by smoke; and she would have been wrong.

    We're in the same situation. On a month to month lease after being in the house for 10 years. Our landlord wants paint the house, replace the carpet, and do some repairs beforehand. We've been giving two 30 day notices over the past 6 months and in both cases we've been allowed to stay in the house beyond the 30 days. The painting and carpet hasn't been addressed since we moved into the house.

      Check the laws in your state each state says after x amount of years the carpets have to be replaced..mine for instance says each 8 years it must be replaced

    ADVICE: 1. Take pictures before you move into a place or someone moves into your place 2. Make sure you read the lease carefully and have everything in writing 3. Anytime anything is going to change (like the fence/gate in this case) you get it in writing..

    See in NY law a rental unit is to be painted every 3 years by law he would have had to paint twice on his dime if he was in NY.

    There's a store called desantas where I live , And you can buy what's called A chem sponge ( good size) And it takes nicotine and cigarette smoke off of walls furniture everything , For like 20$, i used to clean fire and smoke damage for a company rhat goes in after a house fire And we use them all the time, they work. Great and it's not hard to get off the walls. And the store is open to anyone not just contractors and Companies, What i'm saying is if he's "in the business " Then he should be able to find a cheaper easier way To clean Nicotine stains off of the walls.What landlord doesnt have pictures b4 someone rents from you?! Who lives there for 9 years and doesn't have any pictures that may prove the wall color in the background atleast ?!🤔

    You do not have to put multiple coats to cover cocoa color. you use the correct quality and it's just a normal paint job. Maybe JM had a bad experience, but it not the only way it goes down.

    No smoking in the house must be in writing on the lease. Normal wear and tear after SIX yrs must be taken into consideration when deduction damages. Landlords have a tendency to inflate their amounts on deductions to then short change tenants. However this land lord states specifics in the lease about conditions of the premises upon return to the owner. Never sign a lease that holds this clause the land lord always will win. There's always wear on suites especially long staying rentals. Be fair !!

    Even though I know Judge Milan's family did construction, she was wrong about it 'taking many coats of paint to go over brown with white.' Sorry Judge, but It doesn't. It only takes one extra quick coat of a fast-drying white primer/sealer - such as BIN - NOT multiple coats, and no matter what the colors are. Again, since these primer/sealers dry so fast - only 15 minutes or so - the painter could only bill the customer a couple few hours at best for their labor (per room), for the cost of the extra coat of paint being applied, along with the additional primer.

    Too all these people advising to take sand paper and sand the spackle ...NO!!! I've done home repairs,finish carpentry for years. If you simply want to remove the spackle or drywall mud that someone has mistakenly put on the wall or whatever... Take a pail of soapy warm water and a flannel cloth ,dampen the cloth slightly wring it out and go over the spot or spots. Let the water soak in and continue the process of lightly rubbing the cloth over until gone.,what you should be left with ,is just a white spot where thehole once was. Spackle dissolves with water. This only works ,if no one has painted over it.

    It has always bothered me why white is the default color, for the inside of 99.9 percent of all dwellings, when it is the most easiest color over an extended period of time to become dirty, and my assumption is that most property owners do that on purpose, to keep a certain percentage of a tenants, security deposit, the overseer is always attempting to gain leverage, in contracts, that way, and then label it as good business, when it truly only equates to what is considered, A LICENSE TO STEAL, SMH💯

      @@kkallsop We - a light gray would work just as well, they both being neutral colors, so not believing that one, what i'm really interested in knowing , and maybe I need Google for my answer, but I am under the impression as people began to think, in terms of modern housing, because prior to that i'm assuming prior to that happening, the inside of housing related, to the log cabin being that is where i'm assuming it all started, i'm just more curious as, drywall and sheet rock began coming into play, as a part of the dynamic, what made white the default color, just curiosity more than anything you know💯

Judge Judy would give people $5000 for crazy things but then she would complain about people on Social Security blah blah blah blah. I don’t know why they canceled the show.       renting after owning is better, when landlords give you excuses you can tell when they're handing you bullshit. Plus the older you get you no longer care about owning anymore, it's not as big of a deal as it was when you were younger, you don't have to deal with all the repairs garbage, it's actually very liberating.
