- The plaintiff says she bought a house from the defendant, but he turned off the pool two months before she moved in so he could save a buck. Now the water is green and it’s costing her a fortune to clean and refinish. She’s suing for what she’s owed. The defendant says the plaintiff had 15 days after the as-is sale to list damages, and she didn’t, so he’s off the hook.

Oh Lord yes. If you're doing it yourself, it can be a nightmare if you don't know exactly what your doing.
The tablets are meant 2 float in a device 2 slow distribute the chlorine. They are NEVER supposed 2 sit upon the pool bottom as they are corrosive and WILL damage the surface whether it is plaster or paint or surfacing....You NEVER allow them 2 come un2 contact with surfaces directly...ONLY in a float.
That is true, they will bleach the color right out of a vinyl liner and will burn the finish on a fiberglass pool or a painted pool. Usually on a marcite type pool they won't harm it but if you put the tablets on the surface you are playing with fire. I serviced pools in south Florida professionally for several years and this was common knowledge.
So true! Shock can easily damage some liners also.

Thank goodness someone else sees things correctly. She and judge Judy are making a mockery of our justice system. He incorrectly placed the tabs in the pool which ate at the bottom and caused damage.
Uh Judge Millian is correct and is an expert. You are not, so no need to complain of what you do not know.

Allowing tablets to sit on the surface of the pool absolutely can ruin the finish, they're supposed to be put into a dispenser or in the skimmer.
Came here to say just this. Serviced pools for over a decade and they are not meant to be just thrown in the pool. They absolutely can cause damage if left to sit on the surface of the pool. Judge was way to arrogant and ignorant on this topic to make a ruling without doing the slightest bit of research on a subject she clearly knows nothing about.

This is a case were the seller probably knew he did in fact throw tablets in being in a hurry, When im pretty sure you should put them in the skimmer are a floater,,, But Judge has no knowledge of this because they probably have a pool tech. No sham she has to rule the way she feels is right.

@Luke Rinderknecht I agree the plaintiff should have provided a written affidavit from a pool company stating this, but her arrogant attitude concerning the tablets themselves is what is out of line. Had she just kept to the evidence presented to her in the case, no issues from me. But when she interjected her supposed "knowledge" on the matter and stating they dont damage anthing is flat out false and people need to be aware of this.
@@dnryan1 agree. It’s her attitude that annoyed the hell out of me. She’s also spreading misinformation which can cause people to ruin their pool.
Just say she didn’t have the evidence instead of screech about how you’re supposed to do something that you’re not supposed to do as if you know everything.
Plaintiff should’ve at least googled how to use chlorine tablets or looked on a package of them as that would also likely say not to toss them in the bottom of the pool.

That's not true! Not everyone/every business wants to be associated with a TV lawsuit. Be real, who wants to go around saying they're being sued? That's not something to brag about.
@@DavidKen878it’s public information. If you know the names of one of the parties and the state in which they’re suing, you can find the names of the people or companies they’re suing.

Plaintiff should have got it in writing on the day of closing that the costs associated with the pool would be on the seller. On day of closing 95% of the time the seller is just ready to be done. Could have gotten it fixed and then sued.
I believe the plaintiff. If she had to get pool resurfaced right after moving in, there was clearly something that he did wrong.
She knew that she was buying in on as is sale of a home. She did not look at the place before purchase, now this is all on her.
Just because something is made “to work/fix” an issue doesn’t mean that if used the item will not cause or create damage. Prime example are the “flushable” hygiene wipes. Those cause havoc on a toilet but they’re “supposed” to be flushable.
Tablets should definitely not be placed directly on the surface of the pool. I've done it and it definitely cost me when it ate thru part of the liner. They are supposed to be put in a dispenser.
I hope she appeals this absolutely absurd verdict. The defendant even admitted he threw the chlorine tablets on the bottom of the pool! Yes, in cases like this where the judge is so blatantly wrong, they are 100% allowed to appeal.
This is not a court of law. The two parties agree to drop their suit in order to appear on TV--with the understanding that there's no chance to appeal the decision if they don't like it.
It's unfortunate that this lady lost that case because if you put chlorine tablets directly on the bottom of the pool it will mess up the surface and turn that whole area white she just didn't have the proper knowledge and proved you cannot put chlorine tablets directly at the bottom of the pool they have to beat in some type of device that's floating

I knew before the plaintiff even spoke she was going to lose . When it comes to buying a house , you better go through everything with a fine tooth comb an hour before signing the paperwork. Unless something is in writing at the closing (unless you can PROVE fraud) you are out of luck.
She did lose but she wasn't loose.

Those commercial grade hockey pucks are NOT supposed to go directly into the pool! You are either supposed to put them in the skimmer basket that is in the pool, in one of those floaty things, or (even better) in the hair strainer or filter basket in the pump room. They are extremely caustic and will eat away the finish if left sitting in one place, most especially if there is a vinyl liner.🤦♀
Judge was not listening. The woman said the tablets must be put into a RUNNING pool! The woman should have said it again.

Yea she talks over people and cuts people off when she ask them a question, especially when she's heated. I've seen her talk over her husband a couple times.
Judge was listening. The plaintiff lost due to her negligence of taking care of the pool she did not look at it before the sale was final.

Chlorine pucks destroy pool finish if just thrown in the pool. Their are floating capsules that dispense the chemical slowly and safely.
those tablet can ruin a pool floor they did mine it bleached out spots where the tablet was looked bad
Not sure what kind of pool this is...but the Hockey Pucks/Chlorine Tablets should have been put in buckets of the Leaf/Debris traps..so it can slowly dissolve and not lay on the bottom of the pool.

I have to disagree with the judge on this one. It's too bad she didn't listen as well as she should have and the Plaintiff didn't have expert proof. It could have been googled I would think. It was fiberglass not concrete.

He had the pool refinished 4 months before the purchase and has the bill to show … therefore she chose to refinish again 4 months later.
Chlorine tablets are indeed made for pools and won't cause damage IF used properly. I have a friend who needed to quickly clean his parent's pool he was supposed to have been taking care of while tbey were out of the country. He put way too many chlorine tablets in which resulted in the pool having to be resurfaced, pump replaced and something else replaced but I don't remember what that was.

Thank you for pointing out LOW pH. The woman lost all credibility in my book when she said chlorine was an "acid" and did not know it's a base. She appears to have a lot to learn about owning a pool.
Not true. Sodium carbonate or bicarbonate will raise pH levels in pool water. Muriatic Acid or Sodium bisulfate lowers pH. It’s chemical soup. You are correct that replacing the pool water is costly, but you don’t have to replace the water just because the pH drops.
Plaintiff needs to open her eyes before she buys something. As is without pictures.....pools are a money pit.

I looked up throwing chlorine tabs in the pool and each and everything that popped up said you should NEVER throw them in.
“You should never throw chlorine tablets directly into your pool. Should you do this it will allow them to dissolve directly on the pool floor and it could cause damage along with creating a permanent bleach stain on your pool material whether a liner or concrete.”
That was the first statement I found from a pool company. Not sure how Milian did not see that when she looked. In a real courtroom, the plaintiff would have recouped at least half of what she was out. This crap is making a mockery of the legal system.

Absolutely correct. If you just throw the tablet in it will sink to the bottom and damage the pool. That's why you need to have them inside the floatie thing.
It's not her job to be right about every topic, it's the plaintiff's job to provide evidence that what the guy did was wrong and she could not do that.

She actually destroyed her own pool by complaining about something that isn't a big deal to fix. A green pool is bound to happen knowing he wasn't living there. I would have been a big girl and dealt with the minor issue of a green pool myself. Too many people try to get other people to fix all their problems. Grow up.
