      Actually no! Once an inmate makes a request or complaint like that they are usually immediately separated. They respondingbofficer whom revived the request/complaint is duty bound by law to ask the inmate. Do you feel as though you are a danger to yourself and or others? If the officer did not do this then the prison is at fault. However that would be looked over and rendered moot since the inmate will be judged sane and therefore able to stand trial. That brother is gonna die in prison.

The punishment is removal from society. Some guard deciding to turn the heat down in winter to make people sick is illegal (sadly, they are almost never punished for shit like this. Only the very worst guards are brought down, by prisoners on occasion. And the prisoner who does so is making a huge sacrifice. He is usually tortured for doing so).

    His responsibility was to let the CO’s know he has a problem, and it’s their responsibility to determine how the situation should be resolved. They chose not to act so every employee he told should be charged with criminal negligence at the very least.

    I was curious as to what Burks had been convicted of, found this:
    "Burks had been sentenced to prison in December 2016 for fleeing and eluding police and receiving stolen property, and was classified as level 4 security, according to the lawsuit."
    Allegedly other inmates and prison staff not only knew of Burks being gay, but also that Madden was homophobic, and both inmates requested to be separated. Dang...

      Thats nice that people want to blame a guard.
      Fact of the matter is that it is not policy in pretty much all prisons worldwide to grant single cells or transfers to another cell if cellmates dont like eachother. Few countries actually make an effort, but are often constricted by number of cells and amount of inmates. Bottom line is it costs money and few people give a shit.
      So those 50 that upvoted (many many more in all the comments) should consider what it is they want. If they want things like this not to happen, open your wallet.
      It certainly isnt going to lead to a prison guard being prosecuted or even reprimanded. Its policy and only if they have a strong indication it will lead to great harm will they do something in some western countries. In non western countries... not even worth mentioning.

Prison is not a progressive place it’s a place they lock people up in 4 by 7 foot cells. Guards know how things work, they were bored and wanted to see someone die. I’ve seen guards laugh when people commit suicide or watch as a mentally ill person who shouldn’t be in prison is making a fool of themselves and shitting on themselves. Prison is a sick place and it only functions barely with such rudimentary laws such as these no matter how crude it is it’s the guys fault for murder but guards are to blame for created a scenario that I guarantee they knew the outcome

      I’ve been in Prison in 2 separate states LA and TX. When you are roomed with a homosexual and they request to be moved. They are suppose to take that matter very seriously. Proper protocol is he should’ve never been allowed to go back in that cell once requesting to be moved. That Prison is at fault

This includes race, sexual orientation, gang affiliation, etc. This is to preemptively reduce instances such as the case in the video. The system failed. You are wrong here.

The death penalty is a barbaric practice datinf all the way from the medieval days, Also it would keeo the defendant from justice by putting him out of his misery and not having to live with the fact that he killed a man. The problem with the US is that we waste taxes on inmates every year because its all avout punishment when the system should be based on "rehabilitation". Germany and other countries in the EU have a justice system based on "rehabilitation" instead of punishment and they have a better success at it when we do. All because republicans want us to waste taxes and so the prison system and even the private prisons can make their millions. We gotta stop thinking out of feelings and start thinking with our brains.

    The ultimate responsibility of this murder falls upon the killer. Stop blaming the prison. He said that he didn't like the guy and "wasn't into that," he didn't say that he was going to harm the guy so therefor it wasn't a dangerous threat. If he had threatened him then they have the responsibility to move him ASAP. Non-threatening moves can take a couple of hours to complete. You have to submit the moves for approval, check PREA scores and then notify the control center of the move. Then control center must double check everything. Moves have to be made at a non-restrictive time. Blame the idiot and stop making excuses for him. The "It's always someone else's fault," is a cop out.

    I worked in corrections for 20 years. The inmates are supposed to be assessed in several.different areas before being placed in a room with someone - if there is a complaint this should have been addressed also. The prison is also responsible

      Breath Again Prisons have about 2000 to 1000 people locked up in facility. Everyday dozens of people put in love request but there is a process that goes before u are moved except for when u say someone threatened your life and was gonna harm you which this ain't definitely the case(and then u kept in solitary where no one wants to really be). There is a classification team that actually works on a height, weight, race, past gang affiliation, and custody level criteria which will put people in same housing areas which people who should likely equal(strength, age and race wise)... When an inmate puts a move slip for a reason which is not considered an life Threatening by himself then the corrections people have to do an investigation as well as try classifying him with another matching housing area. This takes time. Note if you say you are in a life threatening situation y'all get moved out that second. Y'all get put in solitary. People that don't know nothing about serving time be saying whatever in the internet. If the just moved people by them saying then the whole day in the pen activities won't run cus all CO's gon do is move around. Mfs petty af there, he gon move to a new spot, gamble, borrow, have a fight and ask to get move to another spot, do the same and the cycle goes. That's not how shit works. There are rules to follow and they seemingly are the best so far. Stay your ass outta jail...

    There should be no such thing as "cellmates". Prisoners shouldn't have physical access to each other at all most of the time, let alone have to sleep together. Our justice system is EVIL.

      @@daqueen3188 do I agree with crime? No, however it’s a broad spectrum, in some states you can go to jail for drinking in public , and in a lot of states marijuana is illegal. Should those people be punished for their entire lives, and thrown in with the wolves that commit horrible crimes? No, however I also believe that prison should be about actual reform, if we actually helped them while in there to give them tools to better themselves on the outside, there wouldn’t be so many repeat offenders.

    If I were an inmate and I felt very uncomfortable with the presence of a black man in my cell, would I be just as entitled to a transfer? If he felt uncomfortable being shoehorned with a gay man then what would make the sentiment more justified than the perceived threat of a cellmate of another race or color?

      You will need to explain how you’ve just made a (false) logical equivalence between a hypothetical straight male in the first scenario and a hypothetical gay male in the second. Are you assuming that the gay guy is a clear and present danger to the straight guy? There’s a reason we separate the sexes in contexts beyond prisons and not sexual orientations, because the latter would generally be considered a violation of the highest law of the land (constitutional law). I’m not sure what you mean by “wokeness.” I’m just trying to understand how you’ve come to equate the threat level of a male prisoner to a female prisoner with that of a gay male prisoner to a straight male prisoner. The female straights and gays don’t seem to have a problem with cohabitation. So I don’t see why this civility can’t apply to male prisoners. If we permit and enforce segregation based on sexual orientation then we should also permit separation based on race and ethnicity and religion, because are those not also legitimate threat referents?

      Now obviously being the woke person that you are, you're fine with the first scenario but not with the second.
      The reason being "straight men" is not a group you care about. You don't think there's any discrimination in that first scenario and you're sure as hell not gonna compare it to discrimination based to race & ethnicity because it's obvious that it's not the same.
      However, the second scenario involves a group you care a lot about: gay men. You're uncomfortable with the idea that gay men are viewed as potential rapists, even though you're fine with straight men being viewed the same way. Your priority is no longer the protection of the potential victim but not to hurt the feelings of an "oppressed group".

      In most state prisons all known gay men are housed in a special unit to try to keep disruptions down cause guys would literally be fighting over who belonged to who in a sexual relationship type of way. I do believe that a lot of these guards do this deliberately knowing the possible outcome. This is just common sense. Why would you house a known gay guy in the same cell with a quote unquote straight guy whom was possibly known to be violent and had issues with homosexuality. A lot of shit is swept under the rug when it comes to prisoners. If a prisoner doesn't have someone on the outside strongly behind them then anything is possible to happen to them and little or nothing will be done. If I were that inmate who was killed family I'd be suing the hell out of prison from the warden on down. Prisoners are humans just like the rest of us and they deserve equal justice. The prisoner who killed him is the punk.

      I’ve heard of it, but I don’t believe it’s everywhere. Some jails will just put you in segregated housing, which seems more like a punishment than an accommodation.
