My channel is centered around reaction/review/commentary/critique (mostly of movie trailers). When I get copyright claims I often use the "review" fair use argument (in the beginning I used "reaction"). But I've wondered if I should use "commentary" instead. Because that is what I often do in reaction to a trailer I watch. I don't just play the trailer and film my facial reactions. At the end, I discuss my thoughts about the trailer, the story, the actors, review how well the trailer was done, etc - various things. So is "commentary" more accurate than "reaction" or even "review?"
I am confused over the time element here. If I want to analyze a photograph and tell why it works, such as where the lights were placed and the depth of field and how the background was handled, I would have to leave the copyrighted photograph up on the screen for most of the duration of the video. Would this not be allowed because of the time? So far I haven't done this because when you look on Getty, for example, there is a cost for editorial use. Any advice appreciated!
Hey Jill -- I mean, you could. It's just a risk you take. You have to remember we're dealing with TH-cam policies here and bots. What you've described is Fair Use, however, bots sometimes make mistakes. My advice is better be safe than sorry.

that's the thing about fair use it does not eliminate copyright claims it just allows you to use copyrighted content without being liable or having to explictly give credit to the copyright holder. they can always issue a claim until youtube deem it a false claim because it was fair use

Hi Emily. To answer your question, If the creators show portions of the video and then comment and/or react to it, it is considered Fair Use and it becomes their original work. Hey Chris -- it's possible that parody covers what you describe but I'd have to see it. Generally, what most YT are doing today is not parody -- it's just using copyrighted material for the punchline, which is not Fair Use.
I understood this to be the case in the context of video essays, however I've been struggling to find information on what would be considered commentary in reference to something like a game mod. What I mean is, would someone basing their mod off of copyrighted material be considered a commentary on the material itself in that it's their interpretation of and expression of said material showing appreciation? If so, what would be the limitations and exemptions in this regard? I'm asking due to the current situation with Nintendo going after modifications for the game Garry's Mod, an 18 year old game, out of the blue and very harshly. Do these creators have any legal standing or defense? I'd love to get more information about this and considering how well you explained this I hope you'd consider covering this topic!
Just to add, in case you're not aware of the situation, these mods made by the community are not for profit (as far as I am aware, if there are outliers they are not the norm and shouldn't be taken into consideration anyway, however I'd be interested to know how this would affect the majority if there was a small few that were profiting where they shouldn't be, and if this would basically destroy any defense others who were not being scummy would have) but I'm sure if you cover this you'll look into it. I just thought I'd add some extra info that could help you decide whether it's worth you're time or not

If I am correct in my understanding, you can no longer do music reaction videos where you let the video play and simultaneously describe the musical techniques the artists are using. You would get a copyright claim. If you dispute the claim under fair use, even though You Tube has a category for reaction videos and you can state that you were simply providing a review of the video, if the copyright holder wanted to they could actually cause you to go from a copyright claim to a copyright strike?

I do language -learning-related content for the somewhat obscure language Esperanto. One idea I've had is to dub and comment on other people's videos into .... uh .... better Esperanto. Ideally, I'd like to get permission to do this, but I wonder if it could be considered fair use - education, commentary.... The clips would probably not be short - which is something you keep saying. Hi, im pretty new to this TH-cam adventure. I’m trying to understand Fair Use on historical pictures, newspapers clips, and pictures/ drawings out of books in a series I’m working on my other channel. Basically it will be me revisiting locations and wanting to show and talk about a historical event. I understand anything created before 1927 is public domain. But, some of these pictures I have found are on the local public library website and they ask for permission to use pictures, etc. My goal is to be factually informative in my videos by helping the viewers to get a better understanding on the history I’m covering in each episode. "Content uploaded many times by other creators" falls into the content reused policy and seems to imply that using other people's videos are not monetizable. I am confused.

Yes, as long a you follow the Fair Use rules. Make sure the clip is only 2-5 seconds long (10 secs max) and that you comment and/or react directly to the clip you just showed. Everything has a copyright attached to it by whomever created it (whether they have registered it or not), therefore you can just assume that ALL videos are copyrighted. You cannot use material that is not yours or that you do not have permission to use. It's really that simple. 👊😀

Hi Marina (again)!! I believe you watched my previous video about Fair Use. There are 5 guidelines in there that you must abide by: The video you share can only be 3-5 seconds long, and then you must comment and/or react to the video you just showed. The video on Fair Use is the main video and then I have made other videos to explain more of it. I would suggest you watch several of my videos and then I bet you will begin to understand it. 👊😀
What if I want to use video game footage in my video but then I talk about how these clips relate to what I am discussing? Is this considered fair use? I just want to make sure that I won't get copyrighted before I start posting videos. Like if I played a clip then talked about how it helps prove my theory?
Are videos like what Ray William Johnson did considered fair use? Would it be fair use to play a copy righted video and pause it every 4-5 seconds to commentate it and give your own twist about what is happening?
You must have permission to use the video you will be sharing. Otherwise, you can only use 2-5 seconds (10 secs max) of all the videos AND then you must comment and or react to the video you showed. Hello Mr. Corzine! I was wondering, my friends and I have started this TH-cam channel where we react to and review movies (in separate videos). For the reactions, we watch through the movie together and then cut out most of the movie for the final video. While we record, we usually speak over and discuss the movie as it is playing, thus preventing us from using a short clip, which you mention is preferable. Would this still be considered commentary (or any other form of Fair Use), even though we are not distinctly pausing the movie and discussing it? Hi Ian, I'm thinking of starting a TH-cam channel where I'd teach plot structure using TV episodes as examples. The way that I wanted to do it was by having my voice talking about the structure of the particular episode that I'm talking about (say, The Office Season 4 Episode 1), and while I'm talking about the structure of that episode, I'd have relevant clips from that episode playing, although the audio from those video clips wouldn't be playing, just the video. My questions are: if I monetize the video, does that fall under fair use, and am I okay to start making videos like that? If not, then would I be alright to do that WITHOUT monetizing the videos? And failing that, what if I used pictures of the SCRIPT from that episode instead of actual video clips? subject to copyright also?
Written words are subject to copyright, too, and so you have to put Fair Use principles to work!

No -- the strike drops off in 90 days, unless you get another.

Just to add, in case you're not aware of the situation, these mods made by the community are not for profit (as far as I am aware, if there are outliers they are not the norm and shouldn't be taken into consideration anyway, however I'd be interested to know how this would affect the majority if there was a small few that were profiting where they shouldn't be, and if this would basically destroy any defense others who were not being scummy would have) but I'm sure if you cover this you'll look into it. I just thought I'd add some extra info that could help you decide whether it's worth you're time or not
Do reaction videos like anime reaction videos considered as commentary and fair use? Lately, anime channels haven been receiving a lot of demonization, claims and strikes and even some being terminated(like mine). It would be great to know your view on this. 😁

Hi Ian, thanks for your video. If I am correct in my understanding, you can no longer do music reaction videos where you let the video play and simultaneously describe the musical techniques the artists are using. You would get a copyright claim. If you dispute the claim under fair use, even though You Tube has a category for reaction videos and you can state that you were simply providing a review of the video, if the copyright holder wanted to they could actually cause you to go from a copyright claim to a copyright strike?
Kindly advise If the commentary can be a non-verbal one? For example, me reacting to a copyrighted video and giving my opinions in the form of texts displayed on the screen. Can I do that? Thank you...

I do language -learning-related content for the somewhat obscure language Esperanto. One idea I've had is to dub and comment on other people's videos into .... uh .... better Esperanto. Ideally, I'd like to get permission to do this, but I wonder if it could be considered fair use - education, commentary.... The clips would probably not be short - which is something you keep saying.
And again, I think I would rather get permission to use the clips because I'm sure people would appreciate feedback better if they knew it was coming and gave permission first.

Hi, im pretty new to this TH-cam adventure. I’m trying to understand Fair Use on historical pictures, newspapers clips, and pictures/ drawings out of books in a series I’m working on my other channel.
Basically it will be me revisiting locations and wanting to show and talk about a historical event.
I understand anything created before 1927 is public domain. But, some of these pictures I have found are on the local public library website and they ask for permission to use pictures, etc.
My goal is to be factually informative in my videos by helping the viewers to get a better understanding on the history I’m covering in each episode.
I just want to do it the right way from the beginning!! Any suggestions?

Because while commenting on videos makes using other people's monetizable. "Content uploaded many times by other creators" falls into the content reused policy and seems to imply that using other people's videos are not monetizable. I am confused.

So I was wondering, what if I am interviewing a person that was on a late night talk show? What if I used the clip that featured the person I am interviewing? And we talked about what happened and how did they get to be featured on that talk show after I showed the clip? Does that count as part of the fair use guidelines?
Yes, as long a you follow the Fair Use rules. Make sure the clip is only 2-5 seconds long (10 secs max) and that you comment and/or react directly to the clip you just showed. Everything has a copyright attached to it by whomever created it (whether they have registered it or not), therefore you can just assume that ALL videos are copyrighted. You cannot use material that is not yours or that you do not have permission to use. It's really that simple. 👊😀

Hi Marina (again)!! I believe you watched my previous video about Fair Use. There are 5 guidelines in there that you must abide by: The video you share can only be 3-5 seconds long, and then you must comment and/or react to the video you just showed. The video on Fair Use is the main video and then I have made other videos to explain more of it. I would suggest you watch several of my videos and then I bet you will begin to understand it. 👊😀
What if I want to use video game footage in my video but then I talk about how these clips relate to what I am discussing? Is this considered fair use? You must have permission to use the video you will be sharing. Otherwise, you can only use 2-5 seconds (10 secs max) of all the videos AND then you must comment and or react to the video you showed. Hello Mr. Corzine! I was wondering, my friends and I have started this TH-cam channel where we react to and review movies (in separate videos). For the reactions, we watch through the movie together and then cut out most of the movie for the final video. While we record, we usually speak over and discuss the movie as it is playing, thus preventing us from using a short clip, which you mention is preferable. Would this still be considered commentary (or any other form of Fair Use), even though we are not distinctly pausing the movie and discussing it?

Hi Ian, I'm thinking of starting a TH-cam channel where I'd teach plot structure using TV episodes as examples. The way that I wanted to do it was by having my voice talking about the structure of the particular episode that I'm talking about (say, The Office Season 4 Episode 1), and while I'm talking about the structure of that episode, I'd have relevant clips from that episode playing, although the audio from those video clips wouldn't be playing, just the video.
My questions are: if I monetize the video, does that fall under fair use, and am I okay to start making videos like that? If not, then would I be alright to do that WITHOUT monetizing the videos? And failing that, what if I used pictures of the SCRIPT from that episode instead of actual video clips? As in, the video would just be me and then images of relevant portions of the script from that episode?
