The cam car car right of way, but in that situation I would wait until I knew the intention of the other car. Some drivers, as clearly demonstrated here lack courtesy and good driving skills. I have seen this type of accident happen when taking my son to school. Interesting point aside the driver of the car involved was also the driver that stopped right outside the school gates, another example of poor judgment. Sadly we have to accept the fact such people exist and drive accordingly.

On a normal cross road, yes you would be right. This is off set, so priorities are different.
