    Why would he take that order as “shoot my lethal weapon” when he is not supposed to have one in the first place?

    Tell me if I'm wrong, but if auxilaries are not supposed to be armed, and the unit leader knew that and was working under that assumption in the first place; then, the order the unit leader gave could have only been to fire less-than-leathal weapons. By extension, the man committed premeditated murder because he brought a gun to situation he was prohibited to in hopes of possibly using it and believed that since he brought an unauthorized weapon, he could use the guise of "green light" to fire and proceed to say he was just following orders.
    Additionally, he never reported his firing of two live rounds during a confrontation with civilians. Which is a firable offense regardless. There are so many issues with this situation and court proceedings but I am also well aware it's for entertainment.

      They sound like USAF security forces augmentees. They get a light training to do.the job the real security forces do, but they haven't gone thru what we did.
      So they can't handle the same stressful situations that require restraint when using deadly force.

      As far as premeditation and deliberation to prover murder in this situation, the state would be unable to prove first degree murder which would be the appropriate charge when premeditation is involved such as a contract killing. Voluntary/negligent homicide would be the appropriate charge.

      @@JamesSmith-gn9ou There is a valley of leeway between premeditation and something like contract killing. He knew what a green light order means to an auxiliary officer requiring him to fire non-lethal shots and what would happen if he replaced those non-lethal shots with lethal ones under those same directions even if he didn't know a green light order would happen that day. It would like going to the park and firing a random shot straight ahead every day. It might not have killed someone that day but he knew the effect that action will eventually have. This case could easily be argued as a random killing (still charged as murder) and not manslaughter or negligent homicide.

    If he's (a) prohibited from carrying the gun in uniform, and (b) not licensed to carry the gun, then they could just charge/convict him of illegal gun carry, then go for the manslaughter charge. Bringing a prohibited weapon is evidence of malice, and blindly firing it into a crowd, with no aim, negates any claim of self-defense.

      a) TV show and murder is more dramatic b) first-offence manslaughter can have a really short sentece. considering this show also likes to focus on how media affects cases and how they're tried, the fact a police -affiliate fired a weapon into a crowd of protesters meant public pressure on the DA office to go down hard on the guy, so the possibility of a 5-year manslaughter sentence meant they coudn't go that route
      (i know manslaughter can have more years than that, but if the murder conviction is going well the defence can deal down to manslaughter with a longer sentence, but if they start on manslaughter the defence will fight for the shortest time possible)

    That cop who slugged the reporter isn't much better. He can't control the crowd, so he picks the easiest target, someone who's not running away. I see it all the time. Cops, teachers, even parents, they can't handle the incorrigibles, so they go for the one who doesn't put up a fight, just so they can save face.

There is processing time from receiving to fulfilling, especially when under a stressful situation... a fucking gun was fired. I'm fully aware that this is just a tv show, but at least use your melon to understand the situation 🤦🏾‍♂️.

    I know this is TV, but I always find it funny that when an officer does the very serious thing of shooting a live round, nobody ever asks: did you report firing that live round? Why not? Is that not regulation?

      Yes it's television series but it is based upon real events that happened in New York City. On duty Auxiliary Police Officers are NOT ALLOWED TO CARRY GUNS UNDER ANY CIRCUMSTANCES in New York City. They can't even bring them to the Police Station when going on patrol.
      However like with the regular Police officers there are some jerks and knuckleheads who disobey their orders. Those are the psychopaths that we must be aware of.

      There are different rules/protocols for every department, but generally, yes. If a round is fired, a “use of force” report is supposed to be filed. Some agencies have rules that state that just pulling a gun/taser/baton is to be reported as a use of force.

      Police are given a leeway of 200 rounds a year without reporting it. Except Chicago where it's 1200.

      As it was said, Auxiliaries only have pepper spray, they aren’t issued any other forms of less-lethal weapons like beanbag shotguns or tear gas launchers.
      While I do kind of understand how it feels and believe auxiliaries should be given better protection, this officer’s actions were inexcusable - you don’t fire INTO the crowd.
      There was a similar situation in Hong Kong where an officer were being attacked, and he was pushed down by a mob before he pulled out his pistol and immediately shot into the crowd.
      In some cases, it is ok for an officer to exercise deadly force to protect themselves, but it is very hard to defend opening fire Willy-nilly into a crowd of protestors: especially when not everyone in said crowd was attacking the officer.

      @@openthinker6562 In real life NYC Auxiliary officers do not carry pepper spray, only a strait wooden baton. This episode when aired caused some controversy in the NYPD auxiliary community, as many help work on the sets of the shows, along with a Blue Bloods episode that showed an NYPD auxiliary shooting people. In real life, in the entire history of NYPD Auxiliary, no auxiliary has shot someone. End of the day, this Auxiliary was NOT authorized to carry a firearm (nor are most regular citizens of NYC).

      Depends on the people and what kind of armor to protect his head he has. If anyone has a legal gun and is being attacked they can and should open fire upon the group attacking them. Otherwise the violent group will then have a gun.
      Real moral of the story is don’t attack people.

      Sadly, that isn't unusual for modern US cops, even outside of riot situations. Sure, during a riot, or some of the operations SWAT does, they might have some excuse, but the attitude continues outside of emergencies, and even among cops with no SWAT or riot control experience.

    wait.... why did she claim at around 6:08 that he wa s"non responsive" he was responding to her question. the judge made a bad call, that should have been in the testimony and not "stricken" just because he said " that the circumstances determine the type of force used" doesn't mean he's unresponsive it just means that any sane and rational person would know that lethal force on protesters is stupid.

Sure, it was a yes or no question and he didn't answer yes or no. But simply trying to frame it as "yes or no" ignores the procedures they take beforehand which is what the defense attorney was counting on

    Who decides what situations auxiliaries are allowed to participate in? Because I dare say whoever missed the fact that an auxiliary was bringing a loaded firearm on duty, against not only the rules of the job but also the law, would also be criminally liable for what happened.

      The NYC Axillary police page says: "...Auxiliary officers are trained to observe and report conditions requiring the services of the regular police. Whenever possible, they assist in non-enforcement and non-hazardous duties."
      Riot control is definitely a hazardous duty. In RL, auxiliaries would be used on the perimeter of a demonstration to observe the crowd for weapons or unruly behavior, watch exits/entrances. They might be stationed at nearby transit stations for incressed patrol presence during an event. Help keep standby EMT areas clear of bystanders. Assit parking enforcement or direct traffic. They shouldn't be used as riot or crowd control officers as they aren't trained for such activities.

    I was a reserve officer for 15 years. this seeming "authority" detectives have over the line officer was never present here. His flip dismissal of the officer to give a directive to another officer was not happening here. Several times we had officers from NYPD come here to pick up prisoner. Their attitudes towards the public were alarming at best. The first time one of them saw rifles and shotguns hanging in the rear window of a pickup he went nuts--screaming for backup--and yelling you will get your gold shield for this. None us understood what he was yelling about. After he calmed down we explained it was legal here. His reply was that civilians can't own guns. It is illegal!! The guy was a nervous wreck while he was here.

      @@teacher_shep no it doesn't make sense. the fact that law abiding civs in nyc cannot have guns to defend themselves is an affront to the constitution. in the 1960s High Schools in NYC had shooting clubs and students carried their rifles on the subway. guess what crime was lower before nyc clamped down on law abiding citizens carrying guns

I fully support the right of the people to keep and bear arms to the fullest extent. I know and appreciate it more than other people as an openly gay man living in a red state. I especially support that right in a place like NYC where people most need the right to bear arms in and out of the home. I was just commenting on the fact that somebody, especially an authority figure, one of very few to be able to carry a firearm on and off duty in an area where most other people are not allowed to carry outside of the home, and who probably has had experience with all other people he's encountered carrying or bearing arms doing so criminally. Would react to seeing somebody other than a sworn law enforcement officer "opening showing" for lack of a better term, a firearm in public.       My GOD I remember those days when I was in my high school shooting club in New York City. I even joined the NRA. I thought that I was the only DINOSAUR left! I got drafted and joined the Navy and served THIRTY FOUR years. Because of my high school shooting experience I was a MARKSMAN and later became an EXPERT. My parents were both World War Two and Korean War and early Vietnam War (Indo China circa. 1954) military doctors who taught me how to fire the BAR (BROWNING AUTOMATIC RIFLE for those who don't know what it means), M1911 45 ACP and the Walther PPK. But you are absolutely right about low crime rates in New York City during those days when we had the high school shooting clubs. Especially on the subways.
      But I really don't know about giving kids guns these days. They seem to extreme bunch PSYCHOTIC ENTITIES. I wouldn't want to have a bunch of gun toting kids coming to my house because I deleted them from my Facebook page or checked dislike.

    We have auxiliary police in some German states, and some of them are even allowed to carry a gun. But of course, over here, it is no problem - in any given year, police fire only about 100 shots. The entire police. All cops combined. In a nation of 83 million. Cause, you know, people over here respect the law.

      LOL! Guess you don't know that the vast majority of police ops in Germany are classified including the court proceedings hence the number of shots fired is not reported. You have cops that in court are only identified by a number and wear a hood to protect their identity. Berlin sends out its anti terror teams more times in day then the city of Los Angeles does in a year.

    The auxiliary cop on the stand had a point that wasn't explored. To the protesters - the opposiition - he and the others like him looked just like the regular cops. The crowd wouldn't bother at this moment with the finer points of differentiation, to them they were just cops.
    Yet he was supposed to confront them with fewer means of protecting himself, potentially putting himself at higher risk of getting injured or worse. And if he had gotten injured, I would doubt that he would have been entitled to the same kinds of benefits and support the NyDP offers to full-scale officers.
    So yeah, looks like he was getting screwed coming and going.

    Agh... I can't side with the guy, but I can't side with the rioters, either. I don't care *what* you think about the system or the police, you don't just escalate the situation when you aren't being directly threatened. I hated the media coverage about the BLM rioters being portrayed as victims when they attacked police, throwing excuses like "the police are violent, too", and I really despise the idea that people protesting are always justified because of their "ideals". But I can't agree with the guy because if you wear a badge then you also have to follow the responsibilities it entails.

      But there is a ton of contempt, a ton of complacency by governments regarding cops. They assume that the profession can do no wrong in many occasions, if not all. The US rejected the idea of a king, when they became independent and when George Washington rejected being a king.
      But guess what, government put the cops as de facto kings in what truly is a surveilance society. The king can do no wrong applies to them and no one else it seems.
      I don't know what kind of solution we can bring to this yet... but we have to find a way. Because the same state that passes the law and uses all manners to make people abide to it doesn't do the same to officers.
      All in all, it's like V says: the government should be afraid of the people, not the opposite
