  • Those who are familiar with Mumbai's (and Godrej Properties') real estate market practices knows that a flat-buyer is generally NOT ALLOWED to complete his payment by transferring his booked flat to another buyer if he finds that he is unable to complete the payment. This person, claiming to be a Godrej employee, tried to convince me that after paying booking amount, I will be not only allowed, but facilitated by Godrej team, to transfer my flat to a third party if I am unable to pay.
    When he realized I was recording him and may expose the lie on TH-cam, he distanced himself from Godrej and said he was a Channel Partner.

      To my understanding builder is saying 1) that if you cancel the purchase you will lose your token amount of 10 percent initially given.What is the big crime in that ? It is a normal.way of any buisness transaction 2) Further the builders channel partner is saying that there is very good possibility that instead of losing the initial token amount of 10 percent the he can help original buyer can find some one newnwho will paybthe remaining 90 percent and the flat can transferred in the name of the new person. The original 10 percent given from the original.buyer can be takem from the new buyer . So all this help is being given so that even the small token amount will not be lost inspite of breaking the purchase agreement . Why then is the buildernor builder channel partener being labelled as a monster ?

I am feeling so lucky i booked flat in a society already given possession in 2017 at much discounted price. If i would have booked in future project i would be so depressed now.     I am surprised by the sheer audacity to introduce himself as Godrej employee. Looking at the way he was getting irritated in the end, he should have said we are a customer centric company till the time customer doesn't asks us any questions.

    Yes this is yet another masterpiece. I have been following the videos of our Krishna sir for around one and a half years. From understanding the logic and policies of the builders, developers and other potential customers, I could understand one thing very clearly, DO NOT , I REPEAT - DO NOT GO FOR UNDER CONSTRUCTION PROJECTS, AND DO KEEP YOURSELF WELL READ AND UPDATED ABOUT OC CLEARED GOOD PROJECTS AVAILABLE FOR RESALE EVEN IF IT IS GOING TO COST SOMETHING MORE.
    I could steer clear from financial blunders only because of these important vlogs apart from few others which speak the bitter truth rather than sugary lies. I am grateful to my numerous TH-cam (Social platform) Guru's like Krishna sir.❤️🙏🙏🙏

    This is very true... and the worst thing is these builders never provide the agreement copy to review before registration and the bad side is many of purchasers do not even bother to ask them for it... and people should be aware that they have to read and understand all the clauses in that agreement before signing it... once they sign the agreement, builders are least bother for what the purchaser is demanding..

    Hi I have been a victim of this in Godrej Forest Grove Pune after paying 10% then they increased the price by 6 lakhs after I complained to the consumer court they refunded the amount without discussing.

    These "Channel partners" work on instant commission so they need to get someone to give the initial deposit/EOI. Then they get their cut and don't care what happens to you.
    Law should be made that commission agents will only get commission after delivery to end customer.

    Sir my boss ..booked a flat in Godrej before the demonitization by booking 1 Lacs .. as soon as demonitization happened Godrej reduced the flat price ... After calculation he was at loss considering price paid and price offered by godrej..He decided to cancel the booking ..till date they not refunded the amount to him....
    We need more video from you sir ...who can expose this builders lobby...playing bad practice ....and playing with emotions of hard earned money of people.

    You are absolutely right no one will transfer 90 lakhs to your personal bank account on a 100 ruppees stamp paper.
    Its just a marketing tactic to make a person believe he will not forfeit his 10% if he cancels the project and he has option to transfer the agreement
    If any such option is there it should be in the main house contract

    Opinion may be different for each one, but one may also have a doubt whether he can take the purchase of any property to the end or not… Such a person should not even see the property under construction, and do not even think of buying it.

    Is it not a risky and hard deal to get?
    Why someone will give me 90 lacs and trust me that I will transfer the title and possession to him once I get the possession.
    If I see the current situation then I do not have title and I have no rights on property but I am asking someone please trust me and give 90-95 lacs .
    Will the agreement happen on the property which I do not own?
    Or will it more like a loan /borrow agreement.
    Does Law allows to have an agreement on the property which I do not own or have no rights as of now ?
    Here question is for deal between Party A who gave initial token but have no title or rights on property.
    and Party C who will give me money to settle the deal and get possession and then transfer in name of Party C.
    I am not considering godrej in between.
    Why Party C should give money to Party A on what concrete basis?
    If Party A denies to transfer title to Party C later then what will happen?
    What if after getting money party A is not interested to get that property owned and do not pay the money to godrej itself.

    The website of the said company facilitates buying of their property online.For this one has to register and create an account. While doing this the user has to Agree to GPL’s terms of use.
    Would appreciate if you can critically look at their terms and conditions as given in the website.

    Finding genuine salesman has become very difficult now. He is saying that everyday there's change in pricelist to compel customer to book immediately.
    Let me tell you, all the prices with all contractors for all kinds of works is fixed until project completion. There's no escalation in prices even when the project is delayed.
    If everything is fixed, why it should change daily or even quarterly?

      You can check on Rera website. I think they have else selling is not allowed

      I believe so. RERA does not give permission to a project, it is a registering body. But without RERA registration, you can't sell.

    I didn’t understand why they were having a conversation at all. Every builder is only interested in getting the entire amount. Why wd they be bothered if it comes from X or Y! This channel partner definitely had some malefide motive. Every builder does tri-party agreements. It is a standard accepted procedure.
    AND I Don’t work with Godrej or any builder. But I used to be in construction hence I know that no builder is bothered where the money comes from as long as it comes. 🤣🤣

    See after knowing that buyer is having good knowledge these so called sales team ( Frauds in doing ) changes his stance from Godrej Property employee to a Channel Partner and distances himself from the key point aspects of transfer n all. These channel partners just take the lead to builder and take their 5% commission and run away and in future if you seek help from them they will not even recognize you.

    Krishnaji, you case is not strong here. You are going to lose 10 percent of the booking amount, i.e. 1 percent of the total price, if you cancel the deal. I.e for a 1 CR flat, you might lose Rs. 1 lakh (assuming you paid 10 lakhs as the booking amount). Plus of course the stamp duty and registration fee ( which will be much more than 1 lakh) . If you are not happy, you should ask for a lesser cancellation fee. Say Rs. 10,000. Or you can ask for a lesser booking amount. Or you can walk away. Nobody is forcing you to buy. You should focus on assessing whether the builder is capable of completing the project on time and the project is legal. Only other safe alternative is to buy a ready possession flat with OC from the builder or some seller. Also as per your logic, prices are coming down due to corona pandemic, so you will get the same flat at a lower prices than today after 1 year. If most buyers boycott these builders for 1 year, they will be brought to their knees. Spread the message to postpone flat buying for 1 year.

    The whole conversation could have been avoided if there's clarity from both ends.
    1. The buyer must have clarity, that he will have the money to pay the whole amount.
    2. And seller must not try to convince customers out of their jurisdiction. What agreement says, agreement says and that will be final. Seller's simple answer should have been, "Yes, Your money will be forfeited, if you don't pay the required amount in time." Now buyer knows the consequences and if still he books the flat, it's his own decision.
    Both the parties must be genuine for a fair and ethical deal.
    I never recommend to book flats under construction, unless it is your business. If you are not an investor you should always buy resale flats with all the legal documents in place.
    Under-construction flats book karna matlab "hawe ka paisa dena", jo chiz hai hi nahi uska paisa de rhe hain.

      You hit the nail. Buyer should be circumspect of paying full amount till possession. What guarantee the builder can give if buyer defaults on his payments? It happened with me way back in 2001. I paid installments amounting to 1/4 of price with sale deed registered and couldn't pay further. Reputed builder said cancel the registration and wait till next buyer. The matter ended peacefully in next one year with no losses and gains on either side.
      In many cases KRR and half baked sales staff drag the conversation on and on.
