      You make it a point that it's strange that anyone would defend Billy Mitchell but, defense attorneys usually DON'T care who they're defending as long as they're paid. Do you think Amber Heard's lawyers truly believed she was innocent and Johnny Depp was abusive? Especially with all the evidence stacked up against her case? I just think that it's not fair to treat the lawyer the same as you treat Billy Mitchell. Yes, he's probably a liar, but that's basically what lawyers are half of the time.

      As someone who studied law, that's just completely standard lawyer advice. NEVER give more in an answer than the person is asking for. You can end up giving away extra ammo to your opponent very easily, or get caught in lies, or your "embellishments" can be further questioned. There's a good reason lawyers tell you to just say yes or no most of the time, and also why during cross examination you want to try and pose more open questions that the witness can't just answer yes or no to, but that also aren't calling for speculation (in which case as you heard in the clip they may not have to answer if judge accepts) or aren't leading the witness (so you can't say "so as a director of the board for IVGHOF you'd have knowledge of what's going on there?"... because whilst this SEEMS like a yes or no question, it's actually leading the witness to accept that they're a director, and whichever answer they give, if they give one, implies that they accept being a director... it's sneaky and you're not allowed to hide such assignations in the facade of asking a question... A good lawyer will object and the judge should smack you down for such a blatant attempt)

    Billy is basically the textbook definition of a pathological liar: Just can't stop lying even when it's actively harmful to them, can't admit to things they lie about being lies, and sometimes even believe the lies their self and won't even acknowledge that they personally said something previously if it contradicts a current lie.
    For someone like that, you'll never get them to admit guilt no matter how solid and undeniable the proof you have. Which means - even after these legal cases are done and dusted - he will continue to argue his side to the day he dies.

    My theory on the necessity of this specific lie: The reason is that if it's proven that he's a high-ranking member of the museum, then he could be asked for his plaque, for use as evidence in court. Someone in his position should have absolutely no difficulty in getting a hold of his plaque. He knows that there's something wrong with the plaque, so he needed to get rid of it in some way that makes it unobtainable for the court. That's why he needed to have donated it (the most honorable way of getting rid of it) to a museum. He just didn't expect to be questioned as much about the museum, so he panicked and decided to try to distance himself from the museum as much as possible.

    Once a lawyer has taken on a client, for the duration of a case, they can't just drop him. They have to notify the court with a good reason. Valid reasons might include "he's actively refusing our advice", "he's hired another lawyer", things like that...but for due process reasons, "i found out my client is a scumbag" is not among them. The issue is, almost nobody is ever charged with perjury, even when it's an open and shut case. During the Amber Herd vs Johnny Depp case she was caught for multiple lies be it big or small. Yet she never had anything come of it. It happens with multiple cases, it's just not a charge they bother to hand out in general and is there to merely discourage people from lying, just like most laws and things it's just there to try to keep honest people honest. Compulsive liars like Billy aren't afraid of it due to the fact it's almost never followed up.

Just the fact that he likes to present additional information to a question he has barely answered to justify his lie reminds me so much of when we have to confront a kid for doing something they shouldn't. It's an immediate lie followed by unprompted, unnecessary information that usually has nothing to do with the event. And his smugness when he lies is just intolerable. So to comment on the "why is his lawyer still defending him?" I want to talk a bit about a video I saw many years ago where a psychotic kid murdered his girlfriend's family (I think he was like 16, maybe 18 at most), he showed up to court wearing a shirt that said "KILLER" and seemed to have zero remorse. His lawyer was interviewed afterward about basically the same question, and his answer was really poignant. He said something along the lines of "Honestly, these are the types of cases that most need lawyers. I don't condone what my client did, I don't like my client, but my duty is to do right by the law and make sure it is handled correctly. Due process applies to *everyone*."
    I see similar parallels here. Billy may lie with every other breath, but he is still entitled to legal representation like anyone else. Your client is paying you; you may not like them at all, you may not really even be trying to get them out of a charge, just making sure they aren't unfairly punished for the crimes they did commit. They are essentially just making sure the punishment fits the crime and due process is carried out correctly.

      Yeah, it's important that every case, even seeming open-and-shut guilty cases, is properly tried. It's essential that we hold courts and prosecutors to a high standard so they do their jobs as thoroughly as possible, because if we start slacking on "obvious" cases, how long before we start slacking on all cases?
      This case probably isn't one of them, but there have also been a lot of cases where it seemed open and shut... until later, sometimes years later, a new piece of evidence arises that changes everything. (DNA evidence is a big one! A lotta people went to prison for murder or rape until DNA evidence proved it was someone else.) So it's essential to a free and fair society that every case is prosecuted and defended as fairly as possible.

      The lawyer defending that kid was almost certainly a public defender assigned to him by the state as part of a criminal case. The public defender cannot turn away clients, and his job as a government employee is to defend those who cannot provide their own defense. No such right is provided by anyone in civil court. Billy definitely should hire a good attorney for his litigation defense, but only a dipshit attorney would agree to take the case. The odd thing about this relationship is it's not clear how Billy has the money to pay his attorney's fees. Billy certainly preys upon others' inability to endlessly pay attorney fees by dragging out his frivolous lawsuits. The simplest answer would be ; "It's a job" For the lawyers it's not about the person, it's about the case and the legal challenge itself. Most surgeons don't like cutting people up, it's the thrill of solving the medical puzzle, it's not even about the person on the table.

    14:15 let's not villainize his lawyer. Everyone (even Billy Mitchell) deserves legal representation. It's not the job of a lawyer to represent only the innocent clients, but to represent all clients they've taken on to the best of their ability. Even a guilty person can argue a mistrial because they lacked representation. So I'm willing to give the lawyer the benefit of the doubt and believe that he is doing what needs to be done so that no one else has to suffer.

    • @YuengsNwings
      @YuengsNwings 11 หลายเดือนก่อน +1

      Certainly everyone has the right to proper defense in a criminal trial which is why public defenders are provided by the state and federal governments, but no such right exists in civil court. You don't get a mistrial due to poor representation in defense against a lawsuit. In fact, Billy preys on people not being able to afford defense attorney fees by dragging out his frivolous lawsuits. Nothing is compelling this dipshit lawyer to take Billy's case. The odd thing about the relationship is it's not clear how Billy is able to pay for his attorney's fees, or if the guy is even charging him at all.

    Just playing Devils advocate here... but the form @ 18:24 itself wouldn't have been submitted by Billy, and chances are he never even saw it. What's to stop him re-using his argument from 7:00? It doesn't necessarily prove he was a director, merely that the IVGHOF claimed he was a director on both their website and their filings.
    Yes, whoever filled in the form (presumably Barry Flint) would have had to sign a big scary box with the usual perjury clause, so it would be weird if they would risk penalties over false filings, but lets not forget we're assuming actual competence here as the basis of the argument, and that's not something I associate with either Billy, or any of his associates. Maybe Barry thought Billy was on-board as a director but Billy didn't see it that way?

      Why would the IVHOF name him as a director on a tax form?

I honestly wonder if psychology and law professors will use this video in classes to teach people how pathological lairs behave

    • @Megaritz
      @Megaritz ปีที่แล้ว +37

      I’ve watched Billy Mitchell’s six-hour deposition from his lawsuit against Twin Galaxies, all the way through, twice. I’ve spent an unreasonably vast amount of time researching this stuff while I should be writing a dissertation about something else. Billy has spent his career telling bizarre and inconsistent lies with very little restraint. By contrast, in his lawsuit, he has endeavored to restrain his lying to be more-or-less consistent across his various legal documents and statements. This boxes him into saying a lot of bizarre things, in a painstaking effort to avoid contradicting his previous official statements.
      So now he’s basically required to stick to some of his own wild half-baked cover stories for previous lies. This explains *some* of his wild lies, such as the one about Carlos “not working at his behest” (see below). However, oddly enough, I do not think any of Billy’s previous statements required him to pretend not to be a Hall of Fame director-so this particular lie is still baffling. Here are some of the weirdest things Billy appears to say in his deposition:
      1. Billy never helped Carlos Pineiro et al in testing any equipment, and Carlos et al didn’t do anything “for” Billy or on Billy’s “behalf” or at his “behest.” Billy just accepted their offers to test equipment (while knowing & approving of the purpose of it), and he played Donkey Kong while they were testing it (but he was going to play DK anyway, and anyone else could have played DK instead), and he provided equipment such as a television (but this was not to help Carlos et al-it was just to provide the TV to Rob’s shop, whilst knowing & approving of the fact that Rob’s shop would thereby use the TV for the testing by Carlos et al).
      2. Billy has never seen “King of Kong” or ANY movie that he has EVER been featured in.
      3. Billy has never been a director of the International Video Game Hall of Fame.
      4. Billy has never looked at the IVGHOF website in his life. He had no idea, and no way of knowing, that its website had listed him as a “director” for years.
      5. Billy has never looked at the Twin Galaxies website a single time in his entire life.
      6. Billy has never been a leader or co-owner of TG in any way whatsoever.
      7. Billy knows very little, and can produce very little documentation, about his own financials. (This is bizarre, since he is a business owner-and he needs to provide documentation to prove “damages” in the defamation suit.)
      8. Billy has never actually watched ANY versions of the putative 1.047M or 1.050M Donkey Kong tapes which Carlos et al spent weeks analyzing. (I think THIS one shocked me the most! The idea that Billy could have gone all these years, amidst all this controversy, without ever once watching the videos themselves, is *mind-boggling*. There is no way this is true, and it is one of the weirdest lies I’ve ever heard him tell.)
      Note: This isn't a full list of lies in the deposition. There is other stuff like Billy's crazy lies about the joystick, and Music City Multi Con, which have been covered at length elsewhere by Karl (and by the recent long video by Veritas). And also Billy says other weird things in the deposition attacking Dwayne Richard and Carlos Pineiro, which I'm quite sure are also false, but which I haven't looked into quite as much.

      @@rphntw1n I don't know if there's a forum. There is still an ongoing Billy Mitchell "post-verdict dispute" thread on the Twin Galaxies forum, but it has barely been updated in the last year. However, by far the most detailed website about Billy Mitchell is called "Perfect Pacman" by Ersatz_Cats. You can find an immense amount of Billy Mitchell lore there, including both the famous Donkey Kong saga and the slightly lesser-known "Perfect Pacman" saga. The site is already a pretty solid compendium of information across its many articles for the last few years. Various of its articles also have links to interviews with various former associates of Twin Galaxies and/or ex-members of Team Billy, etc.
      Also, a TH-camr called Veritas recently made a 4-hour video on Billy and the evidence against him. He doesn't cover the Pacman stuff (except the interlude on Music City) or the lawsuit much, but he does a great explanation on the evidence that Billy cheated at Donkey Kong, and rebuttals to basically all Billy's main defenses. I think he intuitively clarifies the evidence that Billy used MAME and why it matters.
      Be sure to watch all the videos by Karl Jobst as well, if you haven't already. Karl himself hasn't made a playlist, but someone else has. You can find it by searching "Karl Jobst Billy Mitchell," and the playlist (all 21 videos, including a few about Todd Rogers also) should appear within the first few results.
