Universities typically keep professors emeritae on the faculty list as a sign of respect for retired professors. Although, I imagine he’s likely to lose a lot of that good will with all these findings coming to light.

    12:38 That page lists him as “professor emeritus,” which is the title for professors who have retired their faculty position but may retain some responsibilities. For example, they may continue to oversee graduate students or take part in defenses, among other things that depend on the university and its size/needs. In short, his appearance on the faculty page accurately reflects the situation as you describe it, essentially listing him as “former professor” with caveats that are more or less unique to that position.

    When you said 'his expert testimony was only 2 pages long' I nearly spat out my tea.
    For some context, for anyone who doesn't know:
    I had to contact a vet about providing expert testimony for a small case a few years ago, and asked what that would look like. They said it would be a minimum of 30 billable hours, with a report detailing all work conducted, findings, opinions, conclusions, and references for all research & work done. They estimated this would be between 10-20 pages of writing, plus supporting evidence & results, depending on what was needed to draw an accurate conclusion.
    Thankfully I didn't need their service in the end, else I'd know what the report actually looked like, but this hopefully puts their 2 page report for a large lawsuit like this lawsuit into some context.

    As a lawyer, most of expert witnesses is shopping around for the highest credentialed expert who agrees with you. If they don't agree with you, you go onto the next. Lower tier experts will often shift their testimony to match yours so they can get paid. Then the other side hires a similar expert, they battle it out, and a jury picks which one they believe more. The sugar baby stuff would never get admitted into trial,as its irrelevant, so he happened to pick one of the careers where having a disgusting and clueless social media presence didn't destroy his career immediately.

      @@Oxxyjoe there is something called a "daubert motion" basically the other side can say "we think your expert witness has no idea what they are talking about", and explain why. If the judge agrees, their testimony is excluded. For expert witnesses if you lose a daubert motion even once, your career is over. So there is some recourse and it would be a very, very bad idea for an expert witness to be dishonest. Just like there are unethical lawyers, there are unethical expert witnesses, but many are also professionals who are going to tell you what they actually think regardless of whether it supports their case. They'd have to be very greedy to change it, since even analyzing the case to form an opinion is something they would need to be paid for.

But it seems like there's also something to do with, if "this will end your career" is the recourse, then, that probably doesn't actually occur much, because it's too severe. It's too severe to be used, and therefore doesn't get used enough. That is, based on your description of it. I get the jist, however. They're under the microscope and have to be excellent... but if everything were actually that perfect, would we have the problems we have? Clearly we have an expert witness who just says whatever right here bro

      I mean, you *can* literally do that with non-zero probability. Just that the probability is so close to zero that it would never happen in countless umpteen lifetimes of the universe, but there is a verified physical mechanism that theoretically allows that (even macroscopic objects have a smeared wavefunction). The videotape error? There is not even a theoretical mechanism to support it. You can not create a mismatched NTSC video frame using an ordinary VCR no matter how it malfunctions, because a VCR has no framebuffer, it has only access to the one instance of time it is copying at that instance of time. It can't pull in elements from the previous or next frame. Or even previous or next *line.*

    Something isn't lining up. Those testimonies are usually in depth, and with very good reason. The expert KNOWS what they are talking about and can explain eventualities or possible other causes. 2 pages isn't very confidence inducing.

      If the case had not settled, he would have been deposed, and both sides would've asked him followup questions. The settlement came before they had an opportunity to do that, so we only have his sworn affidavit. Even so, two pages does seem a bit on the short side.

    While I was in college, one of my professors "retired," but still worked in the same building, just as a researcher instead of a teacher. I guess it's common place in the US for professors to keep working after they "retire," and still be considered faculty. The big problem here is I saw that professor several times after his last class, so Dr. Zyda is likely still frequently interacting with students

    I'm glad VHS is gone. No longer shall we suffer recording one thing only for it to show something completely different, such as this one time when I was recording me defeating the final boss without getting hit even once, but the VHS was a bit dusty and thus showed me taking some damage and losing a few lives. Real embarrasing!

    12:36 He's listed as "Professor Emeritus" which is an honorary title; he is no longer working there (at least officially.) I'll bet you dollars to donuts that getting that title was a condition to getting him to leave his tenure amicably, otherwise the university would have probably had a harder job keeping it under wraps.

      @@psylencecy Exactly. I was just thinking about this the other day, because it's not fair to judge someone if a friend of theirs turns out to be a scumbag, so how is that saying then still true? So here's what i got:
      Statistically speaking it's a numbers thing, obviously, but for people personally it seems obvious to me that anyone can make a mistake of trusting the wrong person. We can't read minds, we don't do through background checks on everyone we know and instead give people the benefit of the doubt unless or until they F it up, and we're all sensitive to plausibility and charm, and scumbags often necessarily rely on charm and deception to compensate for a lack of substance an worth.
      But when someone is total scum, they tend to attract other scumbags and push critics away, so they're left with other scum and with vulnerable people they can victimize/baffle/lie to.
      On the opposite of that spectrum are people who want to learn and grow and they'll have critical people close to them because they value each other. That encourages them to be around each other, and it has the added benefit of deterring scum bags because their biggest enemy is knowledge/honest criticism.
      So in conclusion: scumbags are inevitably dumb F's who don't grow but only learn how to deceive and gaslight more effectively, because everyone who could encourage them to be better is pushed away and/or abused by them.
      Life is so much easier and less harmful to people around you when we're empathic, kind, and sincere.
      I mean, how often would you think that someone will do something nice for that lying scumbag just because they want to do it? How often does someone surprise you with an act of kindness because someone thought about you? You don't have to ask for a lot I imagine. Most people don't. This guy though, if he doesn't abuse a girl to force her, she wouldn't even smile at him.
      So yeah, you can tell all that just by the friends he keeps close. Same for Billy. You know that he's a lonely lying sack of manure who has to rely on other liars to keep up his facade and to stay in his comfort zone/fantasy land, where he is somehow the good guy with great value. Kind of sad if you think about it. Maybe he'd be a totally different man if once in is life he had valued and respected just one person so much that he'd want to be the best he can, just because that other person deserves nothing less, like most people do.
      Sorry this is so long, it probably doesn't interest anyone one bit. I like thinking about these things and putting it to words. I think that a lot of people intuitively know how it works. And we don't need to put it to words if it just works and we know what we mean with just a short generalized sentence. I love looking critically at generalization and see if they work and how exactly, and what the essences/general principles of those are.
      i also love the sweet irony in how I am an extreme reductionist and I need 5 paragraphs to get to the core principles and someone else can just intuitively say the same thing in just one sentence 🤣

His defense was he though that twitter/social media wasn't real life and he could do what he wanted without consequence.     Holy hell. I'm a university employee as a lecturer and student adviser and I am 100% certain that if I were caught doing even a tenth of what Zyda's doing, my ass would be rightfully booted in no time.
    I cannot even imagine looking at my students in that way. It's almost the same mental block as one has with family members; it just doesn't happen to me, it's not even a remote possibility.

    I’ve been a graduate student in a PhD program at an American University for a number of years now. I’ve gotten to know the professors, the culture, and the types of power dynamics at play.
    Unfortunately, most of what you describe regarding the institution brushing things under the rug don’t really surprise me at all. Frankly, the most surprising thing is his professional twitter account staying so creepy for so long-I’d have expected a Department Chair or concerned colleagues to tell him to keep that on personal accounts at some point, probably.
    But Universities are extremely perception-conscious and try to avoid attracting criticism. They instinctively brush things under the rug as long as they can to maintain the front they need to. At most, a problematic faculty member will be subtly sidelined from standard responsibilities if their colleagues find them too creepy or weird, or they will be allowed to retire, because that’s much easier than to attempt to fire someone with tenure.
    This professor’s behavior is definitely extremely unusual, strange, and creepy, if not criminal. But unfortunately his institution’s response is entirely par for the course.

      While true, it’s worth noting that it’s very hard and borderline impossible to remove a faculty member from their position. Especially one who is on the verge of retirement. I’m not sure what the situation is with this department, but in my time as a grad student I knew several older professors who barely taught any classes because students complained about them or their material was so outdated. I TAed for a professor who gloated that he had used the same exam for 20+ years, completely ignoring any and all of the advancements in his field. On the opposite side of the spectrum, I have seen Twitter posts come into consolation prior to tenure approval. About 8 or 10 years ago at a school in IL a professor’s job offer was withdrawn due to his comments on twitter regarding Israel. So it’s not just an issue of the administration not acting, it’s also that their capacity to act is extremely limited by the protections in place within the faculty system. And there are roundabout ways to keep professors away from students even if they ostensibly retain their title and position as before.
      Which isn’t to say this is all fine and dandy. And I’m sure know all of this yourself, but the other readers may not. But it’s worth noting that the issue goes beyond the capacities of the department or faculty members. Tenure doesn’t dissolve in the face of creepy twitter behavior because it wasn’t designed with that sort of problem in mind. Unfortunately, I doubt that system will ever change, and is more likely to be removed or replaced entirely due to how broken the university system is overall.

      @@loldoctor You’re absolutely correct, and I’ve had a number of similar experiences to those you describe, myself. Hence my comment about getting/allowing the professor to retire being the easiest way for the institution to effectively get rid of them.
      But my point remains that universities try to handle these problems in-house (which, due in significant part to tenure, they tend to do poorly), and try to avoid letting any embarrassing details get out to the press. They think they are defending their reputation and the perception of their institution, but in fact they are simply dodging any accountability.

      This is a general university issue. Uni politics, no matter which country, is a cesspit at worst of times and a ball of spiders at best of times; some places a tad better, some a lot worse. It’s in how Unis are constituted; who gets to vote for what, who can fire whom, who decides that you get into a position where you get to do these things - it’s very network-y, intransparent (commenter loldoctor actually hinted to some of these issues; you won’t get tenure if the deciding faculty profs don’t want you; this can be purely due to your political opinions or world view - that’s… obviously an issue! Same goes the other way around; full tenure profs have been fired for having the wrong opinion on politics - and I’m not talking about extremist garbage; completely normal other side of the coin opinions) and disconnected from the ground floors.

      This is definitely true. Not American but from Europe, and I've had similar experiences. An older professor was openly misogynistic towards a classmate of mine - it was brushed under the rug and he 'retired'. Another professor was recently moved from another uni in the country, after the first lecture of his me and a couple of mates went to a pub and the new professor forced himself along. OK, we're all graduate students with big aspirations, he probably wishes to know us better, nothing weird with that. Well, after he had downed a couple beers too many he starts opening up that the reason he came to our uni was that he had in a drunken haze mass emailed inappropriate stuff to the whole faculty of the last uni he worked at.
      I loved and still love the field I studied but that was the moment I decided pursuing a doctorate wouldn't be for me. There's a lot of good professors out there, but a lot of scummy stuff gets brushed away and creeps get away unscathed.

      The court is suppose to be neutral. One side presents an expert and the other side can question the validity of their expertise and have the person striked as an expert or just discredit them.

Case in point being that when someone is found innocent or is proven innocent over enduring a long sentence, say while in prison for years, then what would truly be just are for those who had falsely convicted him needing to be the ones to pay restitution to the innocent party. It’s how and why making a wrong verdict in court ought to be treated extremely seriously. That doesn’t happen, ever.

      The crux of all this is: define "awful person". Sure, we understand what truly good and truly bad means, but at what point between the two do you draw the line? Someone who watches porn? Someone who likes guns? Someone who has a certain opinion on abortion? How do you legally separate "knowledgeable AND awful" from "knowledgeable and NOT awful"... or should that even matter?

      Also, him recording his neighbors and homeless people is already super weird. If anything I’m going to suspect that his status as a professor is just for prestige, so any claims of being knowledgeable I would find as questionable.

      The messed up part is that if you look at his credentials, he clearly has expertise. Its scary that he seems to be an "expert for hire", willing to BS testimony to help his employers, whatever their case may be. To be fair though, not sure how common this is. In the heard v. depp trial, the heard side had a bunch of werid expert witnesses. dr. doofenshmirtz comes to mind.

    Damn, This is really fucked. The fact that no greater fallout happened between the professor and the university (or the fact that either of them have been charged of anything) and they just let him retire is really depressing. There is definitely something sketchy that is happening there.
    Also no wonder that this guy is resorting to becoming a "Legal Expert", no serious company or university would hire his creepy ass with what is on his Professional Account feed.

    As a former university professor, I can tell you that tenure is CRAZY strong.

    As someone that did CS, there’s a severe shortage of teachers and professors since big tech still scoops up the talent and I’m sure he has dirt on them.
    We had this one Professor that everyone loathed with a passion even other Professors and whatnot, when several students filled a formal complaint about his abuse, they got told there wasn’t anyone to replace him until the student-council swung by where one of them got the inside story that due to his previous position at the IT department he managed to collect a lot of questionable information on next to anyone and even managed to get someone fired and their reputation as a researcher/scientist tarnished up to the point this cat tried to end his life.
    Tiptoed around him for the rest of my time there due the him being an odd but really vindictive person that would try to end you if you ever crossed him (or he perceived it as such)
    Do hope the student will be ok and everything turns out well for her though

    Expert Witnesses in general are terrifying, in every walk of life If I am given money to say something you want, I am a compromised individual with a huge conflict of interest, and yet court rooms not only allow this but lawsuits and criminal trials are often decided by who can pay the most expert witnesses to argue for them.       The term "witness" indicates a person who has seen 1st hand what is going on, whereas with an "expert witness" this simply isn't the case, they're a paid person (conflict of interest) raising speculation regarding what may, or may not happen.
      There's no proof beyond reasonable doubt here, it's purely speculation, and as such it shouldn't hold up in court, yet somehow it's relevant...

      @@YouNameItGaming You're mixing definitions. In this context, a witness is anyone who testifies in court. And expert testimony is crucial for the justice system to work. For example, without expert testimony, it would be impossible to prove Billy faked his tapes because nobody saw him do it. It can only be proven by an expert demonstrating that what Billy claims is not possible.
      And while some conflict of interest exists, it's not like you're _allowed_ to just say whatever the client pays you to say. If you get caught knowingly lying, on top of it being an actual crime, you won't be allowed to give expert testimony anymore. Reputable expert witnesses simply won't do it. If you want an expert witness to lie, you'll have to hire some shit-tier loser like Zyda who can't get a legitimate job.

In terms of the conflict of interest it is clearly one, they are supposed to be interested in the truth but that will often conflict with the interest of future employment as expert witnesses who bite the hand that feeds them and disagree with the person who hired them don't get hired again.

    I really did think from what I've read of his declaration is that TG ran into the issue of 'to pick apart his testimony in a way that a non-technical jury would understand is too troublesome'. In other words, juries are not going to have any experts in media transfer or electrical engineering, statistically speaking. They're going to see enough stuff that is just plausable enough because they don't know better. A lot of smoke, but no fire, is still enough to get someone to think there's a fire.

    Honestly, this is more typical of expert witnesses than you'd like to believe.
    Typically a law firm will hire 2 experts. One legit expert that they show everything to. That expert will advise them on what to show to the expert who is testifying. Then they'll have another expert whose main expertise is testifying. They have acquired the credenials they need for the court, often just barely, and then they are very good at walking a line. They are not allowed to lie. If they are caught lying, it can ruin their career, as that will be used in every case from then on. But they are very good at only finding out enough information to say something helpful to their client and to handle cross examination in a way that obfuscates the facts. That's their real expertise. It is pretty common, sadly.

      The Australian journalist friendlyjordies had to take down a video today because the NSW police won't protect them from the political gang they upset by reporting on them. It's reuploaded in some places already if you look for "friendlyjordies coronation" and they just put out a statement on their channel. Investigative journalism in Australia is absolutely in serious crisis.

    I just love what a bizarre clusterfuck this has become.

    Sometimes when you screenshot a Twitter feed, it can spontaneously look like that of an absolute creep, when in reality your screenshot shortcut keys are just dusty and need to be cleaned. In reality the pixels are entirely differently aligned, to look like an ordinary bland academic profile.
