I think this game definitely is like pokemon, because no one actually cares about pokemon's gameplay. What is "pokemon" to people is the character design philsophy which is why this game blew up so much, because people have been wanting a "pokemon" game without the same repetitive game design they've been doing for so many years.

Based on my llmited knowledge of US copyright law, the worst that is going to happen is that a few of the Pals might be redesigned. That doesn't mean Nintendo won't sue, and it's easy to go bankrupt winning a copyright defense case.
The fact Nintendo already C&D'd the pokemon mod for palworld shows that nintendo probably knew about the game prior to that. I think they'd already have taken legal action if they were going to. None of the designs fail the 'squint' test -- meaning that the differences between conflicting designs are different enough that it won't cause confusion. Different shapes in some cases, different color palettes in others -- I don't think any of the designs are infringing. If anything Pocketpal will agree to change some designs so that Nintendo can crow about an IP law "Win" to maintain their reputation.

1:43 I don’t really agree with that. Healthy inspiration means building off Pokémon’s philosophy of design, or perhaps building off the design concept of a specific Pokémon. Basically remaking the design of Luxray, or straight up recreating Venusaur’s flower and sticking it on top of an original design… That’s not necessarily theft if you ask me, but it’s not really healthy creative inspiration, either. I would tentatively call it creatively lazy, but I’m not quite sure. This method of “sampling” specific design elements from another IP is undeniably a new phenomenon in gaming, and people are trying to decide how they feel about it.

I'm afraid the issues this game has is going to be ignored because people keep focusing on the wrong things; it's either blindly hated or blindly loved. So much misinformation and people talking as if they're an expert despite barely understanding how modeling, ai and game development works. There's alittle bit of that in this video to be honest. I keep seeing people getting a translated interview about Crafttopia mixed up thinking it was about Palworld for instance. This isn't their first game and they aren't as Indie as they are making themselves out to be, it's not a small team. I've been playing it on Xbox Game Pass (which is quite buggy), it's really bare bones with a memory leak at the moment but has potential. There's no depth to this game, it's nothing new beyond the capturing, which I do enjoy. There are some more unique pals that look nothing like Pokémon; I wish they had gone with a more distinctive style that sets at least most of them apart. The name is a little ridiculous, people are probably going to call them Pokémon over pals on accident. So much of the style clashes in game for me. The game looks good despite some of the clashing styles but everything looks good on Unreal Engine. It is possible they used AI for concept art but there's no way of knowing and no poof. We can have a discussion about this without being ugly and rude, otherwise no one will take you seriously.
There is some shady stuff worth looking into. Looking at the model for Azurobe, it's clear that they either traced, referenced or changed up the model for Primarina, the tiers in the hair doesn't make sense on Azurobe because the hair ties that make it that shape on Prim are missing on Azurobe. Perhaps they couldn't make the deadline, and this is what they came up with. It also almost looks like they took the nose off of Primarina, enlarged it and stuck it on the tail, you can see through the tail that it wasn't meant to look like that, maybe a last-minute decision to try to make it look different, who knows. This is just an observation and speculation on my part, not an expert. If you didn't know about that specific Pokémon, you would miss it. Someone on the team was definitely cutting corners by doing this, they have the ability to not do this the more pals I encounter.
I hope they evolve their style and work more on this game but it's possible that this is all we're going to get since there's not much of a roadmap. That is, if they don't abandon Palworld for another game like they did Craftopia. I can see why they did it back then but hopefully it doesn't become a habit. The Azurobe example is the main concerning one for me, but I haven't found any other similar examples showing that they traced the same flicks of hair. Even if they did trace/copy some of the character parts, is there anything that can be done legally about it or will it just be something that's legal but frowned upon? I wish they had shared more of their process and concept works.

    Some corrections
By the time they made palworld they were using git, they however hired a UE4 veteran dev who never worked with git and recommended perforce since it was better for UE4 but they didn't have the budget for that so they settled for SVN
Also they switched to unreal cause they of the veteran applying to the company and they had 3 choices:
Not hire him, hire him and have him learn unity or trust him with teaching them and switch to UE4 (since the rest of them were amateurs)

To be clear, while they have different niches, Unity isn't necessarily more fit for small teams.
But Unity definitely has less built-in stuff that can be considered bloat. An empty unity build could maybe be a few MB, while an empty unreal build is already quite big. If you're not using all of those features, being on unreal can be pretty annoying.
On top of that, while you can use nodes in unreal, you can easily end up having to do C++. Unity uses C#, which is way easier for beginners. It's also a bit harder to do source control with unreal.
These are the reasons Unity has its niche of small developers, but that doesn't necessarily make Unreal unfit for small teams.

the talk around Palworld has revealed people willfully ignore the difference between shared concepts (therpal and ekans) and shared designs (direhowl and lycanroc) because of the awful state of Pokemon in recent years
Nintendo's taken down non-profit fan games with all original mons nowhere close in design to their own. A retail game with designs this close actually makes me worried for what otherwise looks like a very fun game and the competitor Pokemon's needed for a long time

while I am a pretty big gamefreak hater, agree the gameplay is nothing like pokemon, and have no issues with games being unoriginal in terms of taking from their inspirations (I hate the trend of dismissing a game as a knockoff just because it has a similar core gameplay loop and iterates on already good mechanics), I think you are really (maybe hastily) glossing over how blatant some of the monster designs are in terms of plagiarism. while a lot or even most of the designs seem to be original from my pov, I have seen several pals with large parts of their designs having the exact same shapes arranged in the same way with slightly adjusted proportions as a pokemon, often one with the same concept and idle pose. additionally many designs do this but just splice it from two different sources - ex. the base shape of azurobe's snake section is basically exactly the same as serperior's, while its plume is literally a 1:1 of primarina's in terms of shapes and their arrangement. The former could be argued to be coincidence since there's only so many ways you can stylize a snake, but with how blatant the other section is it's hard to give them the benefit of the doubt. Additionally the track record of their previous games doesn't help support the case either.
personally I think it would be hard to make a legal case and nintendo wouldn't really have much upside in pursuing one anyway. It is also hard for me to feel bad for gamefreak as they have lied about having to remake models in the past as a pr excuse for a lesser product. At the end of the day I feel like a lot of the issue is that they have become the 2nd biggest game on steam ever, with just a bit of plagiarism. It raises the question of how much plagiarism is acceptable to people, and would people react differently if they weren't stealing from one of the biggest media franchise on earth? It also seems like a lot of ppl are looking to use this as an excuse to normalize art theft.
hoping this game is just a one off instance of this type of thing. it sucks as well because a team of their size and tenure getting this level of success is insanely cool and I don't think they needed to copy anything to do it. very funny to hear that the guns were added purely as a marketing thing for the pokemon w/ guns angle, I think if you compare the overnight success to games like ark and conan it clearly worked.

I could write an entire essay on my issues with the discourse around this game as a game dev but ive come to realize that most people online are on the side of palworld and arent going to actually try and form their own independent thoughts.
For those willing to actually think instead of just hopping on the palworld hype train consider the following:
    1. Do you really want more games that have no creative vision and hop on trends of whatever is popular
1.5. Do you like the newer marvel and star wars content? Or the entire line of film and tv that copied marvel humor in order to hop on trends without any creative vision? Do you like 80 cinematic universes? Do you want the same with games hopping on trends? Are you not concerned that this game sets a precedent for just that?
    2. Do you know how to 3d model yourself? If so, could you not evision grabbing a snake hook brush adding some tufts to the pokemon models, making a few extrudes and retopologizing it. Especially as a beginner modeler? If not, are you really gonna take some random screenshots on twitter as proof either way?
    3. Does the game actually improve on anything from pokemon games or survival games in any way? What does it do differently from arc besides having pokemon looking characters?
    4. Does the game actually look good to you or is it just Unreal? Do the characters look like they're from the same world as the things around them. Does the ground match the trees etc.
    5. Does the game run well or are there plenty of bugs and glitches
    6. Does the developer have any other games in early access? How long have they been in early access? Do you trust the developer to finish this game for any reason? If they have no creative vision or investment in the wordlbuilding or franchise why would they focus on this game when another trend is on the horizon.
These are my issues with the game. All my answers to these questions are negative or negatively leaning. I am an indie dev. The creativity of this career is the most important thing to me. I cant like a game bereft of it by the own developers' admission and portfolio. That doesnt make a better game industry.
Many peoples frustration is the fear that this makes things worse, just like with marvel movies it communicates that audiences dont care abour creativity or unique ideas, they just want mcdonalds. This game is mcdonalds. The burgers are good and tasty, but they will give you cancer and cause mom and pop shops with local ingredients to shut down.
Its disheartening to see that happen in realtime as people cheer and outright fight for the death of creativity in an industry. This is why we got diablo immortal. This is why the industry is where it is now. Not because devs release unfinished garbage and remasters, but because players have made it very clear that they hate new and original ideas. And why risk it when trendy ideas always net profit.

    • @appleku51
      @appleku51 10 หลายเดือนก่อน +1

I'm confused. I get behind the 3d model issues you outlined and even the lack of creative vision (it screams "I want money and fame" by the developer), but are you stating that the newer Marvel content is unique and creative? Inserting and outright imposing ideologies in a creative "safe" setting where folks go to escape such drama, set in a fantastical world, written and directed by individuals with NO or limited qualifications for such a task, is not creativity. Creativity is not bastardizing decades of stories, characterizations, and world building. It's unique work done by folks like Mike Flanagan, Guillermo del Toro, or Hayao Miyazaki.

    • @dracofells5390
      @dracofells5390 10 หลายเดือนก่อน

@appleku51 No I'm stating exactly what you are, that marvel content if at one point was unique is now completely lacking in it and has started a trend of other studios copying their formula.
Thus we have cinematic universes for everything from hot wheels to the mummy and endless reboots. I'm with you on the works by directors like Toro and Scorcese being the ones that are creative and unique.
I bring this up because in asmongolds clip of "no one cares about the artists opinion, the game is fun" he mentions marvel movies and the Scorsese criticism of them by saying "shut up old man Thor is cool."
The point I'm trying to make is that I fear by setting a precedent for games lacking creative vision making lots of money the industry will be pushed further into a dark age of games lacking creativity.
I'll try and make that point more clear, thanks!

A game being fun is one of the most important things. But games are also art, and art being creative is one of the most important things. If a game is extremely fun but derivative and uninspired, it makes for a great game, but terrible art.
If a game is extremely thought provoking and inspiring and really makes the players think while also inspiring artists to take new liberties and expand on ideas but it's ultimately a snooze fest its a bad game but great art.
Games are always both, and if fun was the only factor, games would have never evolved beyond pong. Narrative games wouldn't exist at all. Games have a unique challenge of needing to be both.
I don't need to ask if a game is fun when the primary defense of its many flaws are excused because of this subjective feeling many players have.
I'm glad you're having fun with it, I'm not telling you not to. I'm suggesting that a game with no creativity in its design lacks artistic intent, and this massive flaw is massive. More game with similar flaws will lead to artistic stagnation and I don't want to see that just as much as I don't like seeing the plethora of games now that only put art as a primary focus.
Additionally I'll remind you that the recent pokemon games got by on the same excuse of "fun". Just look back at when the game released and everyone claimed "it may look bad and be broken but the bugs are funny and the game is fun."
This game isn't really the wake up slap to game freak you may think it to be. If anything its further confirmation that as long as they keep making pokemon, people will buy it because pokemon remains fun. No matter how broken or unfinished the game is. No matter how uninspired the design or the worldbuilding. As long as it's "fun" and that requires no innovation on palworld devs or game freak devs part.
It's absolutely bizarre to me how internet discourse forgets so quickly. I remember arguing with people defending scarlet and violet and now I'm arguing with people defending palworld, and you're both saying the same things.
Again, I like mcdonalds. I'm sure palworld is fun. But this is my career, my passion, my life and more. It's a bit frustrating to watch it get bastardized while audiences cheer. I don't like suburbs, I don't like gentrification, I don't like McDonald's and Starbucks every block. I much prefer a varied environment of ideas and cultures and expressions. I very much resent the idea that "fun" is all that matters because of how it incentivizes trend following and discourages creativity.
If that's a problem for you, you didn't listen and you didn't hear me. That's fine I don't expect you to. Most humans follow trends. The trend right now is to like palworld. I'd encourage you to maybe try seeing my perspective a little bit more openly, but that might be the first time someone did so on youtube ever so I won't won't my breath. But I assure you that it's not a slippery slope fallacy or baseless fear, it's a shifting of trends we've seen over and over.
But alas people never learn from the past do they? A wise man once said "Ah shit, here we go again."

Regarding the "glorifies animal abuse" thing. If that's what you think, then accusing the game of asset theft is not how you go about it. Just make the point you're trying to make, right?
I see this happen a lot, like when an artist is shown to be an abuser, and people are like "their art is shit". What's the correlation? Are you saying it's okay for good artists to be abusers? Or that if someone makes shit art, then they're a bad person? I really wish people didn't conflate things like that.
I fucking loved Kevin Spacey in a lot of his movies. Dude's an outstanding actor, put him in a role and he rocks it. I just don't watch his movies anymore because he's a predator and hurt a bunch of people, but that doesn't suddenly make him a bad actor.

Dismissing palworld as just a copy of other games is like saying a band isnt original because the instruments they use have been used by other bands. Sure, a band could, theoretically, invent a new instrument, but using existing instruments in new ways and combinations can make a band unique. Just like palworld is unique despite many of the systems being very similar to other games. Its the way they put those systems together that makes it unique.

    More CONTEXT:
This is outdated information - the account that accused the OP of "scaling to fabricate the evidence" was reported. The tweet was taken down and the account is gone (last i checked)
I am a Technical Animator, I rig models for a living. I dont speak for byofrog - but I would like to add more info about the situation:
    what is "SCALING"
Global sizes of 3D Assets varies for every project. if two 3D models of different sizes need to be compared side by side then of course the need to be resized to be inspected. The act of "scaling" does not constitute "tampering." Think of it this way - you have two images of different sizes in Photoshop that you need to compare side by side - free transform with locked proportions is what scaling is.
The account that accused the poster of "fabricating" evidence - was shouting out loud "they scaled the model to make them match" - and everyone accepted it as ""evidence tampering" without knowing what "scaling" actually meant. It basically just means uniform re-sizing. Dont take my word for it - ask any 3D Artist what scaling means.
It's basically a label that stemmed from a lack of understanding about the subject matter. And just because it gained traction - everyone accepted it as truth without verifying the sources. The account that called out Byofrog was reported - and the tweet was taken down, and the account gone.
    What is Fabricating actually?
When the model itself is edited - by that - PARTS of the skeletons are moved, the shape is changed in crucial areas, individual vertices are edited- in order to change the model's shape / shilloute. Basically, moving body parts around, changing limb sizes, or number of fingers, or shape of a mouth - that's what tampering is.
But doing a uniform scale - is almost a fixed practice in 3D modeling. Resizing those models so they can be put side by side to inspect the details is not tampering.
Again, dont take my word for it - ask any other 3D artist.

I bet they also moved away from Unity, due to the major scandal when Unity decided they were going to change their service in such a way that hurt smaller devs specifically, and seemed to make things not profitable for smaller devs. Not sure why anyone would risk working with Unity after that fiasco.
