      @@pathologicusmaximus They've been Doing death threats towards developers, harassing anyone for having different consoles, You're not allowed to be positive anymore, Toxic behaviors, pirating/ stealing video games that are currently still being sold to the public and many more.

      On the alternative brightside, at least there's a casual/ respectful side that just plays video games for fun.

Nintendo still makes good games with the occasional miss, but dare not even have one minor complain online about their games because the people who own 30 joycons will report you.       BIngo. Though, after the Switch stops being supported I believe we'll see supported forks of these emulators or perhaps new Switch emulators in the future. It'll be awhile though.

      Its why the older emulators are more safe cause its harder to argue that Company is making money off that system or games since they no longer produce (at least the game disc/cartridge) it.
      Though Emulators do have their place even along side when they do have the stuff. Just make it so that you can pull the games to pc heck the controllers of the switch are like X box controllers. So there is a ready controler already that works with it.

    Boycott the switch 2. That’s the only way you can let Nintendo know they messed up. If your complaining or not happy about Nintendo‘s actions and you’re still buying their new products, then you’re letting them know they can keep bullying as they please. Please don’t be like the call of duty fan base.

      A boycott will absolutely not work. Nintendo appeals to casuals, who don't really care about the online discourse surrounding emulators, if they're even aware of it. You would only be able to convince enthusiasts, and even then, only a few. Any boycott would be a drop in the bucket.
      I learned this trying to boycot Pokemon for a while, it just doesn't make a difference.

      You're right, but they're Nintendo's emulators. Nintendo has proven with the Switch that they can get away with, and make a massive fortune with simple emulation. They can make easy money by reselling old game ports to us. Super Mario All Stars was one of the top selling games on the Switch, and it was just three old mario games that were lazily emulated and thrown on one cartridge, all so we could repurchase the same games over and over again. The entire Nintendo Switch online service is just an emulator behind a paywall. Nintendo's reselling their old library, and they want exclusive control. There's little to no work involved, it's easy money for Nintendo.

      More interesting was that it was found that the roms resold as classic games on the wii/3ds shop were the ones downloaded from the internet rather than new dumps done by nintendo.

      Nintendo might develop the emulators in-house, but the FRAMEWORK for the emulators is not theirs. For example, they use iNes mappers, which are community made. Without those, NES emulation would be a whole different beast.

      @@sinchman1 If you buy a DVD/Blu-ray disc, you OWN it. What you do with it (as long as you aren't illegally distributing it) is your business. Same concept applies to emulation. Whether I play a switch game on my switch or via Emulator, it's none of Nintendo's business.

      More that Trademarks should be more or less attached to the companies or person that makes them while Copyright is only there to protect a recopy of the game at least for the profit time of the game (1-3 years) and that should be for all media just so that a lot of this Copyright nonsense dies off. Only reason its so extended is cause of the few companies bribing officials to pass longer and longer times. Litterally Disney with "protect Mickey copyright extension bill".

      @@FahadAyaz it's how corporate-centric their society is. For example, they have laws in Japan that prevent renting out physical game cartridges including playing retro games in an arcade setting, because legally that's apparently cutting into the profits they can make on it.
      Yes, they have a law that logically would mean reselling a used copy of a physical product would cut into the original company's sales on products they no longer have in stock to sell.

      Even IN Japan, Nintendo would lose, as, between the antitrust laws that have recently passed over there, and the fact that patent laws apply worldwide, between just those two things, it does not look good for them, and if someone could argue two very famous American legal cases, namely, Data East U.S.A., Inc. v. Epyx, Inc., and Capcom U.S.A., Inc. v. Data East Corp., in a way that can apply to this particular legal case, then any competent Japanese jury, and/or judge, would IMMEDIATELY toss out Nintendo's claims, and ESPECIALLY if it is proven that Nintendo was, ironically enough, in violation of the law before, and it just so happens that Nintendo tried similar tactics against Bandai Namco for its Digimon franchise, and they also lost horribly as well. However, if you try to find anything on that topic, well, Nintendo has paid a lot of people to make that information conveniently disappear, and not just from the internet. Moreover, there are also other video game companies that have had features that Nintendo had ripped off from their competitive franchises that are against Pokemon that could also be cited, as well as the fact that Nintendo has also ripped off other people, and/or groups, for things like its music in its video games, and if all of those companies work with Pocketpair, as well as its legal team, as witnesses, then Nintendo is going to cease to exist, and that, in turn, will also end the emulator issues, and the destruction of its history, not just with video games, but also with its other products as well, and what remains of Nintendo will be bought at a fire sale price. Nintendo is desperate to win because it knows that it is devoid of talent these days.

      @@FahadAyaz Seems that Japan uses "first to file" rather than "first to market". Supposedly one of the patents that Nintendo filed was for throwing an object at something to capture it in an open world setting and throwing the object to release it. In other words, the mechanics used in Pokemon Legends Arceus, Scarlet, and Violet. The problem is that this mechanic was used before Nintendo in Craftopia...which was made by Pocket Pair.
      In other countries Nintendo might have a hard time proving infringement given that Pocket Pair could arguably be considered the ones that created this specific execution of monster capturing (though there may be other examples that came out before this). In Japan this might not matter though if their patent laws go by "first to file". It's possible that even if Pocket Pair came up with and used the idea first, that a judge might tell them that it doesn't matter and they should have filed the patent first.

      that is literally how I have been. I love nintendo IPs but I have not bought any of their games since they became more and more against modding.
      Personally I could care less about these games now in my eyes when you buy a product specially OFFLINE SINGLE PLAYER games you have the right to be able to change it and modify it to get it working better. Their original switch (Not even 3 months out) ran most games like garbage but had the Developer stuff left in. Then they made another one which is not more advanced. Took getting an oled for MH Rise, and BotW to run very well without some lag and jitters.
      Meanwhile if you use a computer and know what to do you wouldnt need to buy 3 DIF CONSOLES for the same stupid games.
      I still have two of the 3 switches and its the original and oled cause my husband plays but I dont care and even got my husband on pc. Nintendo needs to change up treating their customers and competition like dirt. Sony is already evil enough over the years treating developers, customers, and their employees like crap. Only thing I saw nintendo doing was doing good for their employees but now i dont care both companies need reality checks.

      @@Aaron-zl5gq If the emulator isn't the issue, then Nintendo wouldn't have scared Ryujinx into taking it down. It was the issue. I would have liked to have seen Ryujinx stick to their guns and keep the emulator up, as emulation is legal for all. The REAL problem is the ROM files being dumped onto the internet for all to download. If Nintendo wants to get those taken down, I have no issue with that, but the emulators themselves have a right to exist.

I mean, just because they've taken yuzu down doesn't mean i can't still use the program itself on my computer, and with a simple google search you can find a shit ton of backups of both yuzu and ryujinx. I mean, there's literally a backup on the internet archive.

Just overload the system, folks, and make Nintendo regret their evil ways, and then work around their internal triggers for combating piracy by rewriting the code inside of said video games to get rid of the triggers in said coding in said video games, and you will fix the problem.

      @@Scornfull Based on the rabid flame wars that Nintendo fanboys have around this topic, I'd say it's safe to say that a great majority of Nintendo fans play on original hardware exclusively, and are completely against emulation due to Nintendo being against it. Nintendo fans tend to follow the leader, and will blindly defend the company no matter what, even if they make horrible decisions. That being the case, it's highly likely that next to none of them are figuring out how to dump their own ROM files to legally back up their games, and most of them don't want anyone else doing it either.

    The part that sticks out the most to me about the Ryujinx takedown is how it's phrased; Nintendo "offered an agreement". That part reminds me of the 3DS slideshows leaked in the gigaleak which goes into detail about how Nintendo was borderline stalking a 3DS homebrew developer to convince him to stop. I hope for the dev's sake it wasn't a legal threat in disguise.

      from my understanding Ryujinx's main dev lives in latin america. For those out of the loop, even if the country has extradition laws with the USA/EU, it is virtually impossible to get their governments to waste resources on these frivolous 'capitalist' lawsuits outside of really heinous crimes, that's the third world for you. So, if this is truly the case, chances are nintendo just wrote a very compelling check to them as they're more than aware that their lawyers have no power over there, and they learned that the hard way in the 90s.

    I feel that the only solution for Nintendo's fan hate is to stop talking/purchasing/supporting their solutions/ business decisions/ and undermining support for history of gaming.
    We have been proven right in backing up stuff time and time again as a fight against Lost Media and preservation of gaming/movie/music history.
    Examples off the top of my head
    - Metropolis
    - Doctor Who (Early Seasons)
    - Unreleased works
    - Online Storefronts/Online Play discontinued
    - Damaged Media/Fading Media
    - Low Availability in 2nd Handmarket
    - Overpriced in 2nd Handmarket
    - Studio/Music Losses due to mismanagement, no backups/duplicates, HQ Masters unavailable to public.
    At a certain point , the consumers (us) needs to demand a change.
    - Nintendo - Anti-Consumer Practices
    - Wizards of the Coast - AI Art, Closing Licensing
    - Broadcom - Price Hikes for VM Ware
    - Microsoft - Windows Recall, Microsoft Office Pricing
    - Price Gouging, (everywhere)
    And again, these are just the ones I can think of off the top of my head.

    As far as I know, using DMCA takedown notices to threaten people into stopping a behavior other than the actual purpose of the DMCA is not legal. Can we actually stop Nintendo from doing this? Likely not. But it is frustrating how bad the copyright system is at doing what it was made for, especially when you have to deal with international entities that don't give a damn about fair use.

If you want to demonstrate that a piece of hardware or software is capable of running popular Nintendo games, how could you do so without showing a Nintendo game running? So I believe using Nintendo game footage in a video like this would qualify as fair use. But Japan doesn't have fair use doctrines in its laws, and I hear in Japan you're supposed to ask for permission even for the purpose of identification.
      That said, the creation and distribution of technology that circumvents DRM is against the DMCA, and it is my understanding that fair use doctrines apply to the use of copyrighted works themselves, not to the use of DRM-circumvention technology. There still remains the argument that an emulator is a tool made to execute legitimate copies of the work, not bypass DRM to produce additional copies, and that a mere informational video about an emulator is even less related to DRM circumvention.
      I believe Nintendo is taking advantage of the fact the videos show footage of their games in order to make a copyright infringement claim, even though the reason they actually want the video down is because it shares information about emulators. That's what I meant when I suggested they might be taking advantage of the DMCA to stop something beyond its purpose.
      Obligatory PSA: I'm Canadian, and not a lawyer, and these are just theories based on my understanding of their alleged actions.

    The only good Nintendo, is an emulated Nintendo.
    What I think we should do is go back to calling all consoles "Nintendos". No, not because I support them or anything stupid like that. But because if it becomes a common phrase, to call all consoles Nintendos, the will lose the ability to hold or enforce the copyright on that name. Look it up, back when NES was new, Nintendo had to put out a campaign to get people to stop calling every console a Nintendo(like the Sega Genesis). It wasn't because they didn't want to be associated with those other consoles. No, they loved that the name Nintendo was on everyone's lips. Then their lawyers informed them of the potential backlash of this and how they could lose the rights to the name Nintendo.
    So let's bring this back. The generic term for "a console" should become "a Nintendo". They want to take from us, let's take from them.

    wouldn't it be weird if lawyers were required to defend our rights and the letter of the law, and if they didn't and instead accepted payment to sway things on behalf of others, they'd be disbarred? Come to think of it, wouldn't it be just NUTTY if you couldn't pay someone to defend you in court any more than you can pay the cop or the judge.

      Well you shouldn't be able to pay off any of the "Just A System". But that is the world we have. And don't go blaming capitalism. you can have corrupt judges in any system that you put them in. Just what sort of corrupt would they be?
      In this case, swayed by money. In other cases, swayed by other factors.
      And some cases its activism, just have to read up on it and see what is up with each one.

    TH-cam REALLY needs to enable region blocking at the creator level. This problem of Nintendo of Japan getting spurts of random DMCAing would go away over night. I think TH-cam gave this ability to Totally Mark when he was having his spat with TOEI over reviewing Manga.

      I think TH-cam doesn't do it because there must be some kind of behind the scenes deal that they have with copyright holders. I imagine Nintendo and others would pull their ads if they didn't have the ability to abuse the copyright system.

    Any technology that has publicly ended support is open to 3rd party support/reverse engineering. Patents can be pursued but they don't hold as much water at least here in the states due to the structure of the tech laws etc. I'm not a lawyer but have been in tech 20+ years now.
    Nintendo just uses strong arm tactics that aren't quite illegal but they got lots of funding. If stuff made it to court you'd probably see Nintendo drop many of their grievances.
    Check with legal council of course and good luck. ❤️🍻

      They wouldn't even care if it were illegal. Suing strategically with no grounds against people with net worths in the 100s of Ks is nothing to them.
      What gets me about this though is its clearly driven by the bias' of the Japanese leadership rather than real commerical interest/data driven decision making. They stand to make no extra money and lose more on payment for legal services.

      I don’t know if Nintendo would say they gain nothing from it. To them, this is a worthy price to pay for maintaining absolute control over access to, and pricing for, their IPs, and therefore the ecosystem of dependence on their systems. The ability to maintain scarcity to keep demand high through lack of access, and to potentially rerelease games in the future and retain profitability if they wish. That’s what they are commercially interested in, more than immediate profits.
      I do agree that emulation and piracy don’t have a hugely detrimental impact on their sales however. Nintendo’s quest for control may always be a wild-goose chase that ends up dragging their reputation, and the gaming community, through the mud.

    Every single company is rapidly becoming just like the exact same deadinside, soulless corporate cookie-cutter profiteer business. They're all just operating now on totally mindless internet data, algorithms and management school templates. Nintento has been getting overtaken by this stuff just the same as every other big company, and they will have had teams of analysts and marketing agents watching the rise and success of their company's 30-year-old properties on emulators and then they've made a campaign to as easily and cheaply re-release these old console catalogues in hi-res for Switch, now they're assassinating all the emulators and trying to stamp them out.
    In this case, the company happens to be Nintendo, but this is not a Nintendo thing, it's a business thing now and one school of thought and methodology of business with a sole focus on maximizing profits as much as absolutely possible over anything else is completely taking over the entire world. They give us some pathetic distraction "content" to occupy our brains, churn out mostly regurgitated ideas with a few new superficial bells and whistles and before you know it, everyone just accepts it all as normal and even actively defends it as if it's some grand new marvellous future we're progressing into.

    The sheer hypocrisy of Nintendo to get Ryujinx taken down when they themselves use emulation. Unlike Ryujinx, Nintendo is actually profiting from the use of emulators as a paid service incentive for their online, and no one can tell me that they actually charge for the online and that the emulation is simply a bonus when Nintendo has a higher tier model of where paying more money exclusively grants access to more emulators. offer access to more emulation. They’re 100% specifically profiting from emulation, which is the very thing they don’t want anyone else doing. They’re even profiting from emulation that isn’t Nintendo branded. Emulators are 100% legal, but the fact that they can get them taken down basically sends the message that emulators are wrong, EXCEPT for when Nintendo utilizes them. Rules for thee, but none for me. Straight up, between this, what they did to Russ, and for how they’re going about suing Palworld for a bogus patent, I honestly think Nintendo is an evil company.

      I don’t think it’s doctrinally inconsistent for Nintendo to market their own emulation on Switch Online/the Nintendo Museum/elsewhere. If IP is a kind of property right then it makes logical sense for the owner to be able to manage and use their IP in their chosen ways as owner, and to bar unauthorised use of that same IP. What Nintendo is against isn’t any and all emulation, it’s unauthorised use (by others, “trespassing” on the “zone of control” they have over their IP). I don’t think that’s logically inconsistent.
      However, it is more inconsistent that their job offers for emulation devs state having emulation experience as being a perk for the job. How do they expect people to get that experience legally if they fight so hard to insist on the illegality of emulation?
      And ultimately one can acknowledge that they legally have a right-and a right has to be enforceable, otherwise it’s empty-and yet criticise their draconian enforcement of said right against fans, preservation and competitors. Nintendo isn’t any less of an abusive, control-freak IP landlord even if they have legally justified backing for what they’re doing-they always have the option not to pursue any kind of action over such cases, and they always go for the jugular.

      They may offer it on Switch Online, but that would arise from a licensing deal made with Sega to offer their IP on Switch. That does not mean Nintendo was contractually assigned the rights to said IP, and to my knowledge they have not acted in a way that gives the impression that they were.

What I meant with the reply was that I don't see it as logically inconsistent that Nintendo only want to go after fan emulation; that makes complete sense from the basic principles of how property works. As the owner, they want rights to use and control IP as they like, and they don't want others to do it in an unauthorised way. Not to destroy emulation as a concept. Remember, they're IP landlords, and landlords don't hate the general idea of people (or themselves) living on their property, just other people doing it without paying rent.
      With that said, it not being logically inconsistent or hypocritical doesn't stop it from being excessively restrictive and downright mean-spirited, or from toeing the line of what's legally acceptable (especially when the target of their legal action might have been covered by an exception within the DMCA, and able to plead that exception but for their absence of resources). I don't disagree that Nintendo are being nasty-you can have a valid legal right that you are nevertheless exercising in a totally heavy-handed way.

    Nintendo brought a lot of joy to my childhood, but over the years I have continued to lose faith in them, they continue to milk the Mario, Zelda and Pokemon games, with half baked remakes and little to no innovation, and now to see them attack fans and go after completion like this with frivolous points and grasping at straws is just sad. I think that this is the end of days for nintendo really all this time and money they spend on attacking people would be better spent on making better games or even a new IP. GET A LIFE NINTENDO!

Nintendo does have a near perfect win rate in court, and they don’t pick court battles unless they’re positive they’re winning them. That’s exactly why they didn’t sue Palworld for copyright infringement. Even though Palworlds monsters look illegally similar to Nintendo’s monsters, they’re just different enough to be outside of Nintendo’s reach. Nintendo does their homework to know these things, so patent infringement it is. Whether or not it will be settled rather than fully fought is really up to Pocket Pair, however, I don’t see Nintendo settling for anything less than a severe penalty of some kind. History dictates that they never settle small.

    I'd say nintendo has always been petty and authoritarian. Remember they threw a fit over blockbuster being courteous enough to include game manuals?
    But yeah they're only gotten worse over the decades, frankly describing their increasingly hostile practices as 'you will play our games only the way we tell you'.
    Since they're fighting so hard to prevent preservation how about we give them what they want and let them fall into obscurity, there's plenty of better games that deserve to be remembered and still be playable.

    I've been a lifelong Nintendo fan who more recently got into the emulation/homebrew scene. This is the first time in my life that I'm legitimately starting to buy my own things and all of Nintendo's actions have truly severly decreased my devotion to the company as a whole. I also have a very small channel that I want to grow through Nintendo related videos, however that's starting to seem like a poor decision for the future more and more. TLDR, it's definitely troubling how Nintendo treats their biggest fans, and threating those who want to build a community around their passion for the company and their games.

      quick tip there bud... be careful about posting your age online, actually just never do it, nobody needs to know, and once you post it in the wrong spot e.g. on twitch. they will ban you if you even joke about being under age

Either way, I use a facecam for my videos so it's not new info. If this little comment is what does me in, I don't really give a shit. 🤷‍♂️

    There's only one simple answer:
    Japan has no fair use laws in their copyright laws, and Nintendo, like all Japanese companies, will use that to their advantage to take down what they don't like.

      Even if they were American, what Retro Game Corps did was not fair use. Showcasing an emulator / device by showing a game is not transformative on the content of the game.

    Dude, Nintendo sucks now. It has sucked for a while. And that hurts coming from an ex-huge Nintendo fan. I believe the Nintendo that I knew and love died with Satoru Iwata...And Reggie leaving was the final nail in their coffin. They have no more joy or creativity, all they have now is lawsuits.
