    With the K-1 Visa I feel like you are letting the U.S. government decide for you if you can marry the foreign person. I find that way to much power being given to the government and it is intrusive.

    My husband petition me back 2015 with a CR1 spousal visa ,and it took 8 mos with the whole process. It was crazy and overwhelming but thank god I was able to come to the US . We’re happily married for 6years and been together for 7years !
    I wish everyone that’s doing the process a success in petitioning there partner and success in there marriage as well ! Godbless everyone

    I'm not sure about this, but I have been told a fiancee visa you can not fly back to your country until you receive your green card, where as a spousal visa she can fly home if needed because she will get the green card earlier,,,,,,,,,,,

    Can you Travel to USA while in The proces of obtaining visa on other types of visa like esta or tourist visas? I understand That k-1 visa does not allow you to leave US untill you obtain green card?

    Check this out. I knew this guy who met a Filipino girl working in Thailand online. He went to Thailand a couple of times and stayed several weeks. He married the girl in Thailand and applied for a spousal visa for her at the US Embassy.
    In the meantime, he returned alone to the US. Unfortunately, he became ill with a form of leukemia and died here in America.
    The visa was still being processed at the time of his death. She still wants to come to America and his family wants her to live with them, but it seems that once the Embassy learned of his death, they seemed to have stopped the visa process.
    Interesting situation..

      it must be a valid, legal marriage recognized by the law wherever it was performed. it doesn't have to be in the usa or the partner's home country. anywhere at all. no polygamy whatsoever, however. my partner & i are also evaluating this option.
      it's a shame, this group makes decent videos but replies with the same thing for any question in the comments -.-

    If the US citizen is able to travel and marry overseas the CR1/IR1 is the best option imho.

      I 100% agree with that. CR1 - your spouse will have a their green card when the arrive and can find work. With th fiance visa, you will have to wait until 6 months after marriage before you can apply for change of status for your spouse. Time frame is about the same.

      good depends on your status and income and. From day one of paperwork submitted today with tax returns etc, it's taken us SO FAR a year and a half. We are now waiting the next few weeks for them to the paperwork to the embassy, and once there, applying for it to be expedited. We're still not done. We're nearly there. But also possibly months away. Covid doesnt help

    why apply for nonimmigrant visa for your spouse if it takes pretty much just as long as it'd take to obtain immigrant visa? only to have to wait for another year to get your green card?

    In my circumstance the pandemic got in the way of me fulfilling the two year requirement of having met in person by about 29 days.

    My uncles is American and she is Vietnamese. He visited her a few years ago and the case was received with in two years. Her first interview was December 10 and they requested more information. She has a second interview on January 24. We have all the information and we have more than enough proof. The thing is she is very shy and she freezes and cant explain all her answers correctly. You could say she has a panic attack. Should we file a lawsuit or appeal on the k1 visa or get married in Vietnam? I am lost for words and its sad this situation. He did try to return to Vietnam several times to visit but the country was shut down because of the pandemic. Anyone please help me what should we do?

    I'm gonna start with my proccess. I have one question about the children. My baby is still on my belly but will be born by november 26th. I'm wondering if my baby would need to be include in my petition because we are gonna get his CRBA as soon as he is gonna be born and thefefore obtain his US passport, under this case i don't think he will need to be include on the aplication? am i rigth? I want my husband to meet my family back home but he has been denied the non-immigrant tourist visa twice.     What happens if my girlfriend doesn't have enough income for the k1? I have being reading some comments were they say you can be denied even with a co-sponsor (in my case will be my mother in law), but looks like that dosen't happens with the cr1 because the co-sponsor is important? is like that?

    do you know if while a K1 visa is processing if an EU citizen can still enter the US with an ESTA? Or is entry not permitted during the time of processing? Thank you for any guidance you may be able to provide!

      I would presume yes I have an ESTA and it would just prove your commitment to your fiance going in and out of USA..

      US citizens are naturally residents, and can petition.
      Non-citizens who do have residency CANNOT petition for their foreign fiancé.
      The lawyer in the video explains this many times.

    Question? I filed for a K-1 form 129. It was received, but within 30 days we withdrew it. It was never processed. Does that still count as 1 filing for a 2 year period? And I have to wait?

    Hi, very useful! Am I understanding correctly that if the US citizen lives abroad together with their spouse, the US citizen has to move back to the US in order to have a US domicile and be able to sponsor the CR1 for the foreign spouse? This would imply that during the whole CR1 process, the couple will have to live in different countries even tho they are married unless they file for a K3 which could take longer than the CR1, correct? Thank you

      I'm not an expert, but I believe that is indeed correct. Even after you marry overseas, you have to be once again separated UNTIL approved. THEN, he/she can move to the US. Frickin' insane, eh?

      @@SuperVladamere I'm now actually thinking of seeing whether my soon-to-be wife will just come and live in the US for 180 days after we marry (as a visitor), then after she returns overseas, where I might then stay with her there for some time, then I return to the US.
      Then, she once again visits the US for 6 mos. on a tourist visa, and so on and so on until the visa is approved.
      I REFUSE to wait any more time than necessary to be apart from my new wife due to the ridiculous red tape and outrageously lengthy time it takes for her to finally be permanently in the US. We'll do what it takes to remain together for as long as possible while waiting to be approved.

    I had 2 approved F129 before for K1 more than ten years ago, and one K3 in 2017. Is it possible for me to do the waiver? What's the chance of being approved? Or I can't sponsor K1 again at all this time? Please help answer my question I appreciate it!

    If the fiancé has a driver license that’s valid In their country can’t they drive in the USA till they get their USA drivers license/green card?

      You gonna have to go to the licensing office once you arrive in America to register and while waiting for at least 30 days you are allowed to drive but must carry the document as proof that you applied the US driver's license

      Time they can drive varies by State, California for example is only 10 days for new residents.

      Yes absolutely, you can just as long you can provide solid 11% evidence that you have strict reasons to returning to the UK such as having assets, job, etc. But you have to make sure you give them enough proof you are indeed only visiting the US and need to go back to the UK. You're lucky too that you're from the UK where it's easier entering the US compared to many other countries which deny many tourist visa applicants.
