    Woah this is really really helpful I was looking into K1 and K3 and it’s whole headache. I think we will just marry and do the I-130 and go through the process once for all and be done with it. Plus the benefit and normalcy of work is also something that is very helpful for our near future plans. Thank you so much for the wealth of information!     Thank you very much for your clear and thorough explanation for the two visas types. I was not aware that if someone enters the country with a Tourist visa and Marry here this constitutes a fraud. That point I consider very important and has avoided a big mistake for me. Thanks again.

      This is a SUPER important point. There are exceptions to this rule, but the main rule is that you can not enter on a tourist visa for the purposes of getting married and then staying in the country. You can enter on a tourist visa to get married and then leave, but if you enter as a tourist and then quickly get married and stay in the US, immigration is likely to say you committed immigration fraud at the time of your entry.

    This is good information cause I didn’t realize you couldn’t work on the fiancé visa. Other videos I’ve watched said the marriage visa is longer and more expensive.

    This video is the closest I have come to an answer yet, but not quite what I am looking for. Here goes: I (US Citizen) have already applied for a fiancé visa (I-129f) and paid the fees, but due to the VERY long process (257 days ago), we have since married in her home country. I would like to marry her in the US still, but not sure if that is required. No children involved. Do I have to resubmit a new I-130 form and pay the required fees to have to restart the terrible clock or should I sit on the fiancé visa? We are wanting her to travel with me just when I am working in the US. It would be nice to be together.

    Me and my fiance met in September 2020. I am from the USA and she is from Thailand. I am planning a trip to Thailand this October 2021. Would it be best to engage her in Thailand or marry. I'm not sure which one to go with a cr1 or k1. She wants to come to USA to live with me. So if she gets needs a k1 do I need to file for her in USA or does she need to apply in Thailand for a k1? And I understand about the 90 day we have to get married here and we definitely will but can she still stay here while filing for a green card?

    Hi! Thanks so much for this --- I am in a weird situation - I live abroad (temp) in Turkey and have a turkish fiance. We are debating whether or not to do a k1 or k3. I am a dual citizen of US and Turkey so getting married here isnt an issue. However since I was just here temporarily but have stayed because of my relationship here -- I do not work. my fiance is the breadwinner here. Do I need to go back to the states and establish income etc for sponsorship? and then bring him over? which one would be best for us to do this and how ahead in advance should i go back to the states and establish income ?     I applied for the K-1 visa with my fiancé back in September, 2019. Our appointment in Ciudad Juárez was set to be in June 2020, but the pandemic canceled all of it. To this day I still can’t reschedule an appointment, at this point what do you think is the best next step?

    Ive got a question: I hold a tourist visa at the moment and my partner US citizen and me are living outside the US. If I apply for a spouse visa in the next month or two and then say we decide to go back to the US in 5 months (so 3 months after applying), would I still be able to enter the US with my tourist visa while the Spouse one is peocessing or do I lose my tourist visa as soon as I apply for the spouse one?

    Hi, I am applying for a US fiance visa (k1) and I was approved by uscis and it has been 70 days. I chose the embassy in Ankara, Turkey. But there is no news from nvc. Can you help? What should we do? The reason why there is no news about nvc could be due to the closure of the Ankara embassy? And that I should not have heard of nvc until now? Thank you

    lets say your fiance comes via fiance visa, you get married in the 90days..can they then return to their home country to work while waiting on the change of status to go through? My partner and i are thinking about the k1 but are wary about the fact that he wont be able to work after we get married and he will basically be unemployed while waiting. Or is that not the case? Can he ask for a work permit while waiting on the change of status/green card?

      No - once you file a change of status you can't leave unless you have a travel permit. And travel permits are not guaranteed.

    If you are well-off enough that you dont need your spouse working as soon as the date of arrival, and you can wait 6 months before the person can start working, go for Fiance.

      Great questions. Each couple has to prove that their marriage is real. If your relationship is new and you don't have a lot of evidence, then having a big wedding with your family and friends can help you show that your relationship is real. But a big wedding is not required and many of our clients have court house weddings and win their marriage visa cases.

    Hi!! So my boyfriend and I plan on being engaged then married to my boyfriend who is from Japan. He is on a J-1 visa that is till next May 2023. We want to start the marriage visa but he wants to change his J-1 visa. He is working at a underpaid job and wants to move at the state I am in. What would you recommend?     Hello! Me and my boyfriend we’re both from Peru. We have been together for a long time and I’m getting my citizenship next year (I’m a permanent resident right now). I wanted him to come live with me and establish our family here. We are engaged but I’m not sure if it’s better for us to get married in Peru and bring him here or apply for the fiancé visa and wait to process and get him here.     I have never been married my partner has and is divorced.. I'm a single parent so custodian of my child.. my partner a US citizen if we were married outside US then green card takes longer verses being married in US correct? Obviously with my child it's better to be married and I presume then he can apply to sponsor us? But I cannot work on a fiance visa? Legally we would want to all be together in US..

    I have a question that I want to ask you. Me and my girlfriend's situation. We are both missionaries, I am 21, I live in Oregon and am a US citizen. She is 23, from and lives in Mexico, she has a visitors visa. She can't come back to the US because Immigration told her that she has came too many times to the US. So she is right now in Uganda serving there, and will be back in Mexico in May because she lives there. I want to propose to her in May and we want to marry in Mexico because her whole family lives in Mexico.
    What steps do you suggest? I honestly don't know what to do. Is there any way you can help me? I can call or anything.

    Just a pro-tip, not a good idea to just reply to everyone with canned responses. This comment section is full of legitimate questions and a lot are duplicates. If you answered one of them, instead of just telling people to call your office (I get it, it's a marketing trick, but looks scammy), you'd help a lot more people out and could get more business.

    Hello. Very informative video. I know marriage on a b2 visa and staying in the USA is considered illegal/fraud marriage. Wondering what if the couple is same sex and same sex marriage isn't allowed in foreign partners home country. Am I understanding correctly that if the US citizen lives abroad together with their spouse, the US citizen has to move back to the US in order to have a US domicile and be able to sponsor the CR1 for the foreign spouse? This would imply that during the whole CR1 process, the couple will have to live in different countries even tho they are married? Thank you
