I've seen this happen IRL. The defendent was seated at the Def table but the Witness pointed out the Paralegal or Assistant council member as the defendent.

@@yup001 Hate to be "that guy" but Better Call Saul is a TV Show and Saul is a fictional character. Mike knows the law better than someone TV Show writer. Not saying the show sucks, just being realistic, If Better Call Saul was based on true events, Saul would have been punished for his little act.

Best way to do it is to actually hide the client, ask the person to spot him, and then show the client up. This way, you completely eliminate luck, and if the person really knew the client, he would say he's not amongst them.
I love how Mike doesn't says things like 'oh this is not how it's done' like I have seen among other professional videos, but just points out a better way it could have proceeded in real life.

its not better. this method has a fault inbuilt. accidentally the correct person can be pointed out. sauls method was foolproof

Yeah it's like when I see a military movie. It's never going to be accurate. You gotta make allowances for the fact it's a movie and not everything accurate does well in a movie.

@@yup001 well mike legitimately said his method is a way to avoid the lawyer getting in trouble for pulling the stunt off. He didn't discredit Saul's method at all and actually said it works to get the defendant off but the lawyer would face consequences, you pull a stunt like that enough times in real life you would eventually be disbarred

It's not about justice, it's about who the better lawyer is.
This reflects a problem of judicial arrogance and bias, that should disqualify judges who put procedural demands ahead of substantive due process, and fundamental issues of justice.

Just to let anyone who hasn't seen this know, he was attempting and succeeded to get a mistrial for one reason or another so continuing the trial the right way would have been suitable here.

He didn’t even get away with it. It got a mistrial which was what he wanted
Yeah, I read about an incident where exactly this kind of thing happened, and the lawyer got in BIG trouble.
I don't think that was fair, because witness identification is a crucial part of many criminal cases, and if you (the defense attorney) have to tip off the prosecutor and judge that you're going to perform this kind of test, it ruins the test.
If the defendant has already been identified in a lineup, this probably won't be permitted by the judge or strongly objected to by the prosecutor. The witness has the right to object based on the same grounds. But, it's worth a try.
I heard of a situation where the lawyer grabbed a law student, to be their assistant, and for the court day, had them wear a certain outfit, and style their hair a certain way. When the student actually met the client - same outfit, same hair style, and both of them had a similar build, which caused a witness to pick the student over the client.

The prosecutor would not agree. Often the prosecutor asks the witness to point out whom he saw. And he counts on the bias of just having to point at the defendant's chair. The judge might allow it over the prosecutor's objections.

Some may, but this would probably create a counter argument for the defense.
Something like
"You don't really seem to have a lot of faith in your witness if you don't trust their ability to point out my client"
[Take this with a grain of salt, I've been to a few trials but I don't have any legal experience myself. This is just what I would probably do as the defense]
Well, they are relying on their clients testimony to be persuasive and taken as fact so it would be hard to deny this kind of move unless you want to imply that your own witness isn't credible.

What lawyer would let you test their witness like that though
They could object to a particular form of cross examination, but they'd have to have a reason in law (or rules of procedure) for doing so other than "I'm not confident my witness will get it right." If they don't, the judge will overrule their objection.
The entire point of cross examination is for the opposite side to get to undermine your witnesses and your case. You kinda have to let them at it.

I like the time that there was no decoy and when the witness was looking around to try to find the guy who committed the crime and not finding him in his correct seat. The defendant noticed that the guy was struggling and helpfully raised his hand to help the guy locate him. So helpful and also caused him loose his case.
