The questions aren't well-formed. Wayne may remember the events he being asked about, but he easily may not recall the dates. So when he's asked, "Do you remember being arrested on such and such date?" The true answer could be "no" because while he may remember being arrested, he cannot confirm the date. He's not being uncooperative, he's simply being truthful. Want a better answer, ask a better question.
I had an attorney in a deposition tell me kf they "try an ask a question to 'box you in' I'll tap your foot under the table and you end your response with 'as far as I recall right now' or 'to the best of my recollection" so you don't get trapped with a tricky series of questions.." He must've tapped my foot on over 50% of the questions. I was suing for an injury suffered in a traffic accident!
