      I'm studying to be a lawyer and I don't like that much to wear suits .
      I rather use blazer and then pants to feel comfortable when I attend the cases and
      I think death sentence is something justice because it does teach criminals the consequences of their doings BUT otherwise it is bad for few people who disagree with it because they said is agaisnt to the right of life , BUT I tell them when Hitler came up there in the war he didn't care about how many people were there and how many lives died due to the war , well he didn't .
      However Americans used the same actions to defeat the war " that was killing" .
      So death sentence for dangerous people is a justice to achieve but life imprisonment is kinda like a slow death to the agressor and people says , I mean family of the victim in Japan , USA says NO death sentence and electric chair

      @@Sniperboy5551 what if we execute an innocent person? You can’t overturn a death sentence, it’s a permanent punishment.
      The justice system is not perfect, mistakes happen, innocent people are sent to prison.

    The scene actually did get a mistrial! That's what Saul was going for here. After he walks away, it cuts to him coming back to the empty court room, except Kim stayed and he says something along the lines of "Music to my ears: mistrial"

    I remember hearing back in the 80's of a poisoning case. State had the vial of poison used exhibit A. In his closing summary defense lawyer pointed out that the prosecution stated that only a small amount of the poison was enough to kill a man. Defense lawyer then proceeds to down the whole bottle, thereby challenging the validity of the whole prosecution. Once the jury left he proceeded to leave room and immediately get his stomach pumped. I think they used a variant of that story in Breaking Bad where Gus Fring does something similar (poison then detox). Nice stories. Great TV. not entirely real world workable.

      Reminds me of Clement Vallandingham, a lawyer in the 1870s who famously died re-enacting how he believed the victim of a murder case accidentally shot himself, and in the process accidentally shot himself in front of his fellow defense attorneys (not actually in court, as the legend later went on to be).
      Suffice it to say, it was extremely compelling evidence, and the defendant was indeed aquitted.

    When I was in law school I recall a case when the lawyer had a third party sit in the defendant’s chair, the witness, predictably misidentified the defendant. The case was dismissed, the lawyer faced sanctions.

      The lawyer must first get permission from the court to do that. Otherwise, the judge takes a dim view of it.

    Marc Victor actually did this in Arizona. He wrote about it on his blog. The judge didn't take any issue with it but the prosecutor filed a bar complaint that was dismissed.

      "I recently tried a case for a client who was charged with a crime arising out of a barroom brawl. I suspected the arresting police officer wouldn’t be able to identify my client at the trial but would nonetheless testify under oath that he could. On the day of trial, I asked my client to sit in the back row of the courtroom while his uninvolved friend accompanied me at the defense table. I informed the court my client was present in the courtroom and we were ready for trial.
      As expected, the officer testified under oath that the friend sitting next to me was the man he arrested. He was absolutely certain. I immediately informed the court that I did not agree the officer had identified my client. After the government rested its case, the friend testified revealing his identity. After some expected legal wrangling, the judge entered a judgment of acquittal. My client was thrilled. The aggravated prosecutor stormed out of the courtroom."

If the cops who are testifying can't see through this ruse and decide to commit perjury by their own volition, that's entirely on them and it absolutely does and should undermine the credibiliy of the case. If you can't convict without using lying cops, your case is meritless.

    Bob odenkirk is an incredible actor. Even in things besides comedy. I watched Nobody and it was great. You can tell he did most of his own stunts and when he had fight scenes they looked genuine. He looked like he was getting hurt too but still being a total badass.

    My dad when he was young was a bit of a drinker. He rear ended someone and so they followed him home. I forget if it was criminal or civil, but he ended up having to go to court and so he lawyered up. The lawyer asked if they actually saw him and so he asked the people if they could identify the driver. The lawyer had his brother look almost identical for this so they chose the wrong guy. He at least got out of that DUI or whatever it was.

    I live in Abq. I live on the 2nd floor of an apt building. My balcony looks down on Saul's "Omaha" apartment, the one he escapes from in the last ep! I could have dropped water balloons on him! You can see my balcony a couple of minutes into BCS 1.1, about 2:20 in, on a dark and snowy night.

      @@ramiroramirez23 There were a lot of trucks and about 100 staff. They had posted on our doors that if light bothers you in the middle of the night, call the number (and they would put you in a hotel). Filming was in the middle of the night, so there was no issue with regular people walking through. The building manager and I were invited to eat from the food carts behind the director's tent, which was set up in the driveway of the house across the street. I also watched them film that time when Saul changed his license plate. I eventually got cold and went inside at about 0400. I think maybe police cars were set to prevent cars from driving on that strip of road.

    Way back in the day when I was a naughty little girl, my lawyer did the same trick. One cop couldn't indentify me, however the second one mind you it was after a break was able to identify me after looking around the courtroom for what seemed like an eternity. It almost worked. Probably would have worked if it was a jury, however my lawyer, as clever as he was chose judge-only. I can laugh about it now. When I saw this I literally had to LOL. This is straight-up 100% true. It happened in British Columbia Canada in 1992 or 93 I want to say. I could ask for the particulars to prove it. This was also approved by the judge beforehand as there was reason to believe mistaken identity which was my defense. I'll never forget my lawyer. His name is David J. Walsoff. The last four digits of his law firm phone number spelled HELP and yes, he also looked a bit like Saul. I just love that guy. Hahahaha 😂😂😂

    You should do a reaction to the courtroom comedy 'My Cousin Vinny.' It's probably not accurate but it is freaking hillarious with wonderful performance by Joe Pesci and Marisa Tomei who rightfully and well-deservedly won an Oscar for her performance. If you haven't seen it before, I'm sure it'll have you in stitches, especially his opening arguments.

    I just started binging Better Call Saul years after finishing Breaking Bad. I didn’t think I would like it as much, I was wrong, it’s so good! I recently got Covid and have gotten nearly done with season 4. Today I saw Bob Odenkirk did an interview on Hot Ones, it was great! I highly recommend it if you’re a fan of his work!

    That anecdote about the mistaken identity reminds me of an old addage in pretty much every serious legal discussion for criminal cases: "Never ask a witness a question you don't know the answer to."
    That would *definitely* include the question, "Can you identify the defendant?"

    The only time I have seen the judge permit something like that was when there was a question as to whether the person in court was the person named in the indictment or complaint; in other words, the wrong "John Smith" was arrested.

    Start witness saw everything. Prosecutor never confirms which crime they witnessed. Now, that's a mistake you don't make twice.

    The witness can’t tell the impostor from the defendant but everyone could apparently tell that Gene Takavic is Saul Goodman and he looked significantly different 😂

    I do appreciate that you can see the fun in a show even if it isn't necessarily realistic. While swapping out the defendant for someone else would cause a mistrial, you still say that it, "makes for great TV," which is does. It's such a big brain move. Who wouldn't want to do something like that in an actual court of law if it didn't cause a mistrial? Eyewitness accounts tend to be so fallible that doing something like that has to be at least *one* lawyer's fantasy.

    Interestingly after that case i believe theres a scene where hes in the hallway and says "the two best words in the english language: mis trial" so that was his intention

    Is Bruce the only lawyer on TH-cam who actually works as a lawyer? I tried some of these other channels but they are clearly kids who got a law degree and then turned on their camera.

      I enjoy watching real-life criminal defense attorney Scott Reisch on "Crime Talk with Scott Reisch". Bruce is far more "real", using vulgarities, telling stories about his own experiences, etc.
