The defendant and his buddy mechanic never gave the boy any paperwork. Hence his mother's involvement in presenting inadmissible paperwork like bank statements and text messages. The dealer did a shady deal and took advantage of the naive boy who wanted that JDM car and ended up trusting both the car dealer and mechanic. The mechanic is avoiding the mother and son, not handing out any solid paperwork and is taking sides with his car dealer buddy. Point to note, the boy took the car and the engine started leaking oil. That motor requires a complete overhaul and rebuild. Maybe he wanted to add an aftermarket exhaust and the defendant pinned everything on that. I once had a "friend" I purchased a bike from. Honda CBR1000RR and I trusted the guy when he said that the bike required a bit of work to stop a tiny amount of oil leaking from the gear shifter. He said his mechanic would fix it in a couple of days and the repair costs would be adjusted in the deal. Little did I know, the engine had seized once, the entire head assembly was twice replaced and later repaired, the head gasket was blown, two cylinders were leaking fuel and the pistons were damaged beyond repair. The project costed me a new engine which was almost the price I had originally paid for the bike. Had the bike repainted because his mechanic accidentally backed his truck into the bike which also broke the visor and headlight and ruined the paint on the fuel tank. It took me over 4 months to get the bike in running condition only to find out that the paperwork and registration documents were only duplicates as the previous owner had misplaced them. Turned out it was a stolen bike and my "friend" was selling the bike for one of his childhood friends. The chassis number didn't match the number on the documents which turned out to be duplicates copies of some fake documents. I learned my lesson the hardest way and I'm glad I was only just 18 back then. Never again will I make a similar mistake, ever!
@@Zebness990 it’s very common those used car dealers will exploit certain people I had a Cadillac that didn’t even last 2 months I just brought the car to the dealership left the keys in it never had any bills or identity theft problems never got charged for a repo never had a lawsuit or anything I bout a shitty car for 3k from a dealership so it was legal but they understood that the car was a lemon and didn’t even question why I would just leave a car by the front door

Being a Mechanic's Daughter everything that was fixed and had to be looked at was written on a work order....Name, Address and contact number of the customer was put on the work order....I worked over 20 years with my father's business...Tax purposes and such...We weren't a dealership though we were just a Volvo Repair shop in VT....I filed the work orders every day when I went to the shop...It was my job after my father put it in our books old school...The seller and his mechanic friend are pretty shady....Nothing was written on Notebook paper...even estimates were written on our work orders...Our customers got a copy and we kept the hard copy for when they came in to do the work...I feel this kid being taken for a ride and I havent even finished the video

Yeah yeah yeah I know the mistakes probably made by the buyer but I don't care, scamming a youngster without enough life experience is extremely evil and wrong. Poor kid. I have made big mistakes in my younger days, but past is the past. I was surrounded by predators, I was too kind hearted and thought that the world ressembled my fairytale inside world of peace and love everybody. I was older but innocent and ignorant when I was divorcing, raising 3 children alone, I was always isolated (new country, learning a new language 3x during my childhood and got married at 17), Anyway I went to a bank to borrow 10'000 sfr and lend it to someone who whined on my shoulder, saying that he hasn't seen his dad since years and now he needed an urgent heart surgery in France blablabla. Of course I never got paid back and ended up almost dying of hunger every month after paying off the bank during 3 years, raising my kids. I didn't think that I'd never receive child support either. So many dumb mistakes when your surrounding growing up doesn't teach you anything, not prepared for adult responsibilities. Anyway I still made it. No family, no diplomas no car, no nothing but thanks to myself I quickly learned from my mistakes and evolved. Found great jobs (University, state job, hospital job) and in no time built a stable happy home for myself and my children. I brought that guy to court in the attempt to be paid back the 10 000 sfr, but the witness who cosigned the document I prepared saying that I lent the sum to this person, and another person witnessed that it was true, well she refused to witness in court.. I lost the case. Well I was resilient, and knew that it was my own fault, I should be angry at my own self. Who would refuse 10 000 sfr if an idiot lent it to you this easily?? We drank a coffee together and wished each other good luck and bye 😂 I have no precious energy to waste on hating anyone. To each their Karma.
I worked on cars for 18 years professionally. The cam seal oil leak that the defendant "paid" for should have included at minimum the ENTIRE timing belt job parts/labor included because the oil contaminated the timing belt causing the belt having to be replaced. The mechanic knows this, but is being shady trying to protect the defendant. The judge has absolutely no knowledge of cars, and should have gotten a third party expert in on this case. The plaintiffs, even tho they seem unorganized and not to bright ARE owned money

I could tell the defendant was sketchy from the moment he started speaking. I believe that the plaintiff was scammed by a con man and his sidekick mechanic into buying a trash car. Not only is it sus that they never had real receipts but the mechanic purposefully ignoring therir texts and calls. The defendant knew that this boy and his mom were completely clueless and took advantage of that.
I saw one where the plaintiff was suing for $7.50 for a comb because she felt she had been dissed by the defendant. That one definitely was NOT about the money.

I mean....sounds about right...most shops have a labor fee anywhere from 75-150 an hour on average so...and thats from spending all my life in side shops and dealerships as a tech. That being said the seller is clearly a crook but the kid and his mom are also very ignorant when it comes to cars so next time they should either not go to a rinkiedink car lot or take someone that knows a thing or two about cars with them.
So basically they brought a shitty car from a sketchy dealer and his con mechanic. I believe everything from the plaintiff's side but unfortunately the judge can't make a case out of you without hard evidence. At least it is only a couple thousands. Not a bad price for a life lesson.
My first car was a lemon I was pressured into buying to the tune of 600 dollars. Pressured into buying bc my mother bought the sob story of the woman being a single mother and needing help, it was such a good car, she put loads of new parts into it, it was perfect for a new driver---- It overheated and died on the highway in minutes.

In this case I don’t think the judge understood that the check engine light went on the next day so it would NOT pass inspection hence you can’t register a car w/o a positive inspection.

I own a repair shop, and I am often NOT in the office but out in the SHOP. I caught that as soon as he said this on the phone, he said " I am not in my office at the moment" hinting that he was out in the shop area working on cars. He is mostly likely a small independent one or two man shop who also doubles a mechanic himself. Its not out of the question for a Shop Owner to be in the shop while taking phone calls. As he was discussing with the judge the matter, he then walks back to his office to collect the file for the customer, while talking to the judge, he pulls the file, the reciept, and texts it to her when prompted. And its quite normal for small shops to simply write a list of parts and labor items on a piece of paper quickly itemizing what is being done, by evidence of the text, the judge had the information she needed, and the plaintiff confirmed the information was correct. If anyone was lieing here, it was the plaintiff.
Autozone sells the egr line tube 598-302 for $151.99. They also sell one (598-130) for $46.49. The egr valve itself is $35.99. It took me two minutes to find these parts. Also the junk yards are littered with Mitsubishis. Go yank the part off of a wreck.
Nobody unfortunately knows how to do that any more. My hubs (a former mechanic) started by watching/helping his Dad, Uncle, G-Pa performing their shade tree mechanics. Don't see much of that any more. Hubs says now it's less mechanical and more electrical.
She dropped the ball. Mechanic said deler paid the 550.00. Dealer said he paid 115.00. So lying... They were working together and are charging up the ying yang for a lemon. Never go to the mechnic the dealer uses. I felt for this kid, you could see the con from a mile away.

I agree ... I think despite this being small claims and TV, they should still take it seriously, especially when they are suing someone. The plaintiff has the burden of proof ... sure, the defendant can make a claim that he paid for everything he was supposed to when the plaintiff had no proof, because that's really what the judge wanted. It's also mind boggling when people show up to small claims without any paperwork ... they don't form their case at all. I feel bad for both the son and the mother. They don't know what they don't know. If that was my mom guiding me at 22, we would have had all the paperwork - receipts, documents, anything and everything ... it really does pay to know the system and to know it well.

@@bojaxsun so what, most judges do not, thats why they treat the SHOP OWNER as the expert, it is very tough to win a legal case in a court room where you sue a Repair Shop or Dealership. Cause they are experts in their field, and you the customer need to show burden of proof they intended to do you wrong. That Judge will take their comments as fact at all times. And its true - in order to access the EGR TUBE - you have to pull the engine from the car, cause its tucked down beneath the fire wall. It would have been a waste of time for the mechanic, and costly to pull that engine for a Measurement. I would have told the customer to go to a junk yard and locate a good used EGR TUBE, if they are even available, cause they are known to fail, mostly cause they rust, get contaminated from dirt, crud, oil, and carbon. I cannot find where the Dealer nor the shop did anything wrong, other than try to help a customer...
The same situation happened to my neighbor across the street. They bought a car from someone they loosely knew for their kid but after a few weeks it ended up needing a new transmission or something. They can't really blame the seller, he offered no warranty. My neighbor checked it out personally and purchased it anyway. It was pure as-is and the caveat emptor principle was applied. And given the make and model of car they bought they should have done more research into its well-known problems . . .

Kid should have taken his car to an independent mechanic because I am a bit suss on what was really wrong with the car. They say they fixed the leak by replacing the cam shaft seal in October and the car is still in the shop in December waiting on payment for a cam shaft seal, water pump and timing belt. All mechanics will recommend changing a water pump with a timing belt, because the water pump has to come out with the timing belt. Now why did they replace the cam shaft seal in October and then need to pull apart the engine again to change the cam shaft seal they put in, plus a new timing belt and water pump. The question now is, did they damage or put the timing belt on wrong or was the timing belt past it's used by date and really should have been changed before the car even went onto the lot? I looked up timing belt interval for his car 60,000 to 100,000 miles or 7 to 10 years, his car was older than 10 years so unless someone previously had done it the car yard should have done it. On another note, why oh why do kids have to mechanically modify their cars as soon as they buy them?
@Christian Tovar He paid $2400 for it, I think he was also trying to get some of his repair money as well. I don't know a lot about cars, just more or less from helping my brother-in-law repair my cars in the past, I buy the parts and beer, plus get my hands dirty while he does the bulk of the work. But timing belts I have always kept an interest in because they can be expensive to replace and sometimes a lot more often. It pays to know the cost and the reasoning for the cost of the expensive consumables on your car, I now have a timing chain which thankfully should last the life of the engine.

Being a Mechanic's Daughter everything that was fixed and had to be looked at was written on a work order....Name, Address and contact number of the customer was put on the work order....I worked over 20 years with my father's business...Tax purposes and such...We weren't a dealership though we were just a Volvo Repair shop in VT....I filed the work orders every day when I went to the shop...It was my job after my father put it in our books old school...The seller and his mechanic friend are pretty shady....Nothing was written on Notebook paper...even estimates were written on our work orders...Our customers got a copy and we kept the hard copy for when they came in to do the work...I feel this kid being taken for a ride and I havent even finished the video

I have made big mistakes in my younger days, but past is the past. I was surrounded by predators, I was too kind hearted and thought that the world ressembled my fairytale inside world of peace and love everybody.
I was older but innocent and ignorant when I was divorcing, raising 3 children alone, I was always isolated (new country, learning a new language 3x during my childhood and got married at 17),
Anyway I went to a bank to borrow 10'000 sfr and lend it to someone who whined on my shoulder, saying that he hasn't seen his dad since years and now he needed an urgent heart surgery in France blablabla. Of course I never got paid back and ended up almost dying of hunger every month after paying off the bank during 3 years, raising my kids. I didn't think that I'd never receive child support either. So many dumb mistakes when your surrounding growing up doesn't teach you anything, not prepared for adult responsibilities. Anyway I still made it. No family, no diplomas no car, no nothing but thanks to myself I quickly learned from my mistakes and evolved. Found great jobs (University, state job, hospital job) and in no time built a stable happy home for myself and my children.
I brought that guy to court in the attempt to be paid back the 10 000 sfr, but the witness who cosigned the document I prepared saying that I lent the sum to this person, and another person witnessed that it was true, well she refused to witness in court.. I lost the case. Well I was resilient, and knew that it was my own fault, I should be angry at my own self. Who would refuse 10 000 sfr if an idiot lent it to you this easily?? We drank a coffee together and wished each other good luck and bye 😂 I have no precious energy to waste on hating anyone. To each their Karma.

I worked on cars for 18 years professionally. The cam seal oil leak that the defendant "paid" for should have included at minimum the ENTIRE timing belt job parts/labor included because the oil contaminated the timing belt causing the belt having to be replaced. The mechanic knows this, but is being shady trying to protect the defendant. The judge has absolutely no knowledge of cars, and should have gotten a third party expert in on this case. The plaintiffs, even tho they seem unorganized and not to bright ARE owned money

I could tell the defendant was sketchy from the moment he started speaking. I believe that the plaintiff was scammed by a con man and his sidekick mechanic into buying a trash car. I mean....sounds about right...most shops have a labor fee anywhere from 75-150 an hour on average so...and thats from spending all my life in side shops and dealerships as a tech. Pressured into buying bc my mother bought the sob story of the woman being a single mother and needing help, it was such a good car, she put loads of new parts into it, it was perfect for a new driver----
It overheated and died on the highway in minutes.

In this case I don’t think the judge understood that the check engine light went on the next day so it would NOT pass inspection hence you can’t register a car w/o a positive inspection.

I own a repair shop, and I am often NOT in the office but out in the SHOP. I caught that as soon as he said this on the phone, he said " I am not in my office at the moment" hinting that he was out in the shop area working on cars. He is mostly likely a small independent one or two man shop who also doubles a mechanic himself. Its not out of the question for a Shop Owner to be in the shop while taking phone calls. As he was discussing with the judge the matter, he then walks back to his office to collect the file for the customer, while talking to the judge, he pulls the file, the reciept, and texts it to her when prompted. And its quite normal for small shops to simply write a list of parts and labor items on a piece of paper quickly itemizing what is being done, by evidence of the text, the judge had the information she needed, and the plaintiff confirmed the information was correct. If anyone was lieing here, it was the plaintiff.

Autozone sells the egr line tube 598-302 for $151.99. They also sell one (598-130) for $46.49. The egr valve itself is $35.99. It took me two minutes to find these parts. Also the junk yards are littered with Mitsubishis. Go yank the part off of a wreck.
Nobody unfortunately knows how to do that any more. My hubs (a former mechanic) started by watching/helping his Dad, Uncle, G-Pa performing their shade tree mechanics. Don't see much of that any more. Hubs says now it's less mechanical and more electrical.

The issue often is not having the tools to do the job. Even if you rent them, working on it in apartments parking lot or some side street is a pain.

The plaintiff has the burden of proof ... sure, the defendant can make a claim that he paid for everything he was supposed to when the plaintiff had no proof, because that's really what the judge wanted.
It's also mind boggling when people show up to small claims without any paperwork ... they don't form their case at all. I feel bad for both the son and the mother. They don't know what they don't know. @@bojaxsun so what, most judges do not, thats why they treat the SHOP OWNER as the expert, it is very tough to win a legal case in a court room where you sue a Repair Shop or Dealership. Cause they are experts in their field, and you the customer need to show burden of proof they intended to do you wrong. That Judge will take their comments as fact at all times.
And its true - in order to access the EGR TUBE - you have to pull the engine from the car, cause its tucked down beneath the fire wall. It would have been a waste of time for the mechanic, and costly to pull that engine for a Measurement. I would have told the customer to go to a junk yard and locate a good used EGR TUBE, if they are even available, cause they are known to fail, mostly cause they rust, get contaminated from dirt, crud, oil, and carbon.
I cannot find where the Dealer nor the shop did anything wrong, other than try to help a customer...

The same situation happened to my neighbor across the street. They bought a car from someone they loosely knew for their kid but after a few weeks it ended up needing a new transmission or something. They can't really blame the seller, he offered no warranty. My neighbor checked it out personally and purchased it anyway. It was pure as-is and the caveat emptor principle was applied. And given the make and model of car they bought they should have done more research into its well-known problems . . .

Kid should have taken his car to an independent mechanic because I am a bit suss on what was really wrong with the car. They say they fixed the leak by replacing the cam shaft seal in October and the car is still in the shop in December waiting on payment for a cam shaft seal, water pump and timing belt. All mechanics will recommend changing a water pump with a timing belt, because the water pump has to come out with the timing belt. Now why did they replace the cam shaft seal in October and then need to pull apart the engine again to change the cam shaft seal they put in, plus a new timing belt and water pump. The question now is, did they damage or put the timing belt on wrong or was the timing belt past it's used by date and really should have been changed before the car even went onto the lot? I looked up timing belt interval for his car 60,000 to 100,000 miles or 7 to 10 years, his car was older than 10 years so unless someone previously had done it the car yard should have done it.
On another note, why oh why do kids have to mechanically modify their cars as soon as they buy them?
@Christian Tovar He paid $2400 for it, I think he was also trying to get some of his repair money as well. I don't know a lot about cars, just more or less from helping my brother-in-law repair my cars in the past, I buy the parts and beer, plus get my hands dirty while he does the bulk of the work. But timing belts I have always kept an interest in because they can be expensive to replace and sometimes a lot more often. It pays to know the cost and the reasoning for the cost of the expensive consumables on your car, I now have a timing chain which thankfully should last the life of the engine.
Particularly if the vehicle isn't paid off.
I’m thinking that too. You just got it. Make sure it runs before you try to modify a car made in 2001. You can make things worse by modifying a car when you know nothing about cars
