  • The plaintiffs rented a house from the defendant but decided not to renew the lease. The plaintiffs are in court because the defendant won't return the security deposit they're owed, so they're suing. The defendant argues the plaintiffs didn't give him 60 days' notice, so he doesn't owe anything. The defendant is countersuing for loss of rent

      Actually, the LL has 30 days after tenants leave to give them a certified letter explaining what was taken out of the deposit, and month to month, the tenants can leave within 30 days of notice to move out.

      Exactly he's a smooth talker and acts really nice and then stabs you in the back. I know so many people who had lovely landlords until it came time to leave, it seems the landlords take it personally and do everything to keep that money, which was never theirs. They only get to dip into it if there are damages.

      Yep. When I was a renter I was cheated by two separate landlords. The first one kept money for things that weren’t’ even in the contract. I didn’t pursue. I was in the middle of a divorce and was too stressed to deal with a cheating landlord too. The second time the landlord kept ALL of my security deposit and I took them to court. I won! They lied at the court hearing saying there was all kinds of damage and I had kept very careful documentation that included dated move out pictures. I don’t care how nice you think your landlords is. In NC 90% of the time they are crooks. Document and take pictures! (And a warning: DON’T rent in N.C.!).

      Can't comingle funds from rental properties and personal funds.. as a landlord with many properties, he should know this... all funds should be held in an escrow account that is separate from his personal account...

      @@bgat911 Landlords SHOULDN'T commingle funds. As this clip shows the reality is most landlords probably do use any deposits as additional rental income or a year-long, interest-free loan. I have never received a deposit back with any interest. Landlords pocket the deposit, hoping it never has to be repaid.

When they left he allowed a section 8 tenant to move in and used the excuse of not getting money for several months from the government as reason to withhold their deposit and security.

    My daughter's landlord was keeping her security deposit too. We took them to court and were awarded double, which they also didn't have and had to make monthly payments. Renters, don't take crap from your landlords!!

      On the other hand, we once rented out our beautiful home in Ohio when we were transferred to Florida. We even paid a property manager. The renters paid with bad checks or didn't pay at all. We had to pay to go to court to have them evicted. They hadn't paid their electric bill for months. The freezer and refrigerator were full of rotten meat and other food. I had to clean all that. They left disgusting furniture and mail that was addressed to other people , and clothes. Not to mention, they never mowed the grass. The neighbors complained about the grass and I had to pay someone to go out and cut the (half acre) lawn. We had been renters a couple of times and always left the houses better than they were when we moved in. I would never want to be a landlord again!

    I think that landlords not holding a security deposit in an account is often why they don’t want to give it back. They have spent it. The landlord doesn’t seem to understand the difference between 15 days and 60 days!
