BB Barrister is British trained. It’s not our English Rule of Law or our English constitution. We should all sit back & understand why did they remove from learning our English constitution & the bill of rights from our Education system?

It’s difficult to figure out if Daniel is just virtue signalling his supposed worthiness by not using a transcript that he hasn’t acquired officially, genuinely unaware of everyone’s rights to access these documents, or actually intentionally misleading us, perhaps as part of a wider conspiracy to keep us ignorant of the real workings of the judicial system.
We must reasonably assume that the truth has to be one of these. And none present him in a good light do they?

I still fail to understand the relationship between the bar association which is a private club and the judiciary who are working in the public? When one sees the client list of the international bar association one can hardly expect any independence from the judiciary supposedly acting in the public interest.

This analysis is defective and it's not Daniel who is under a misunderstanding.
The Open Justice Licence licences the use of "Information" (as defined in the definitions section of the licence).
"Information", for the purposes of the licence, is "information protected by copyright or by database right offered for use under the terms of this licence, namely court judgments and tribunal decisions published by the Keeper of Public Records on The National Archives website".
The transcript of the judgement doesn't fall within the definition of Information unless and until published on the National Archives website and so the Open Justice Licence does not create a licence to use the transcript.

    • @marchorn466
      @marchorn466 4 หลายเดือนก่อน

It falls under open justice principle and applies to any judgement transcript under Crown copy right even when paid for by a member of the public. It is a public document. All judgments are public record as are other court documents

@@marchorn466 That's not what the licence says. It's very clear as to what it covers.

@@DenisonBarracksPerimeterFence If you are worried then don't use it then -
      equity is substance over form...
Once a judgement is transcribed it is a public document and just because it is not yet on National archives is not an issue they have an obligation... If it were that would be a simple case of discrimination and breach of duty to provide public records...
You cannot get higher authority than the supreme court which is included in our free training...
"Under our common law system judgments are a source of law, and access to them is a
fundamental right central to the rule of law and the principle of open justice. In August
2019, the Supreme Court reiterated this importance in the case Cape Intermediate
Holdings Ltd v Dring, emphasising that, at the very minimum, the public should have
access to court judgments and tribunal decisions.
