  • Welcome to Audit The Audit, where we sort out the who and what and the right and wrong of police interactions. Help us grow and educate more citizens and officers on the proper officer interaction conduct by liking this video and/or subscribing.
The various Circuit Courts of America have ruled multiple time that the right to film the police is protected under the First Amendment. Some officers attempt to use a widely misinterpreted 8th Circuit Court ruling to dispute that, which often ends up in a lawsuit.
This video is for educational purposes, and is in no way intended to provoke, instigate, or shock the viewer. This video was created to educate citizens and law enforcement officers on the civilian rights protected under the First Amendment, the rulings of circuit courts, and various interpretations of related case law. This video does not seek to demonize any party involved in this specific interaction.
Bear in mind that the facts presented in my videos are not indicative of my personal opinion, and I do not always agree with the outcome, people, or judgements of any interaction. My videos should not be construed as legal advice, they are merely a presentation of facts as I understand them. That said, enjoy the video!

If you know you've got the law on your side, there's nothing to be afraid of. Especially when you take the approach he did where you ask, "If I do X, will you arrest me?" and then comply under duress. You don't have to actually get arrested to have a case; you just have to have the officer threaten arrest. That makes it pretty reasonably safe for you to get into one of these altercations, challenge the officer, and even file a lawsuit without having to worry about jail time.

We need the ability to fight back against this legally. I should be able to defend myself, up to lethal force, the same as them and until that happens nothing will change. The 2nd amendment was meant for this exact reason, so the Supreme Court should be ruling that a citizen can use the same force a applied to them in response to an unlawful detainment. They need to fear for their lives for violating a persons rights. Without that fear nothing happens and nothing changes. The same applies for the government. If you have a town or government entity with more then 1/2 the people in disagreement with the way it’s being run, you should be able to go in and shut it down. They are supposed to serve us, so it’s us that should be able terminate their position. That rights been taken away though. That’s why they all act this way. They’ve been given immunity from the peoples wrath and consequences. Back in the day if this happened the officer would be drug into the street and never heard from again. I do have other questions too. Like why do some people have missing number plates on their cars? How would red light cameras work in that case? Or speed cameras? Here, a car without a number plate would be pulled up within a few days of seeing this.
I also see cops have a special registration? This doesn't make sense either. The roads are built on safety for all, not safety minus some vehicles? Plus the cop cars have very dark tint? Don't they know that's unsafe in the front windows? I don't get it?
I have more questions too, but overall I see that you must have individual laws. Some people have different laws or something? Its the strangest system ever, and its promoted by your government. Clearly its out of whack with community expectations. Even the cop uniforms are different all over the place! How would people know who's a cop and who isn't? Plus I notice your police don't wear high vis. jackets at night, instead they wear dark clothing? It makes no sense at all.

Actually it might have been from a particularly tall toddler too, with a lego movie background on their professional work device.
(While I say that, I'm sure that isn't actually restricted... but do you really need a custom background on a work-only laptop in what is likely the most serious, most no-nonsense job?)

It's always telling when a cop wants to keep citizens from recording. That usually means they are used to making false accusations and tampering with their bodycam.
