Quite frankly, I'm not too sure the mom's scenario is legit. It's a shame for the kid because BOTH parents are very unstable.

@@Josie-6 According to her, she is in some program and taking classes, she was very vague and paused when saying so. I don't quite trust her statement. She went to jail during that period, not him. Both parents aren't ideal.

take the child out of the equation, it's a simple contract case. he did not abide by the contract so why wouldn't she sue him??

Sometimes parents don't do the right thing! My son's ex claimed their daughter when the mother only had her 2 months out of the year. My son filed an appeal with the IRS and had receipts to prove everything. IRS sent him his money and mom had to pay it back plus fines. They didn't fight or argue about it. She knew she wasn't entitled to claim her but thought if she got her taxes in right away she'd get the money and there'd be nothing done. Idk why this woman didn't appeal it with the IRS
It's a problem that comes up with every single split family, why feel bad for the kids? It's like feeling bad for the kids when one parent pays child support, so that doesn't make any sense at all. I am the primary custodial parent of my children, but my ex wife makes more money than me. So, I claim the kids every year so that she doesn't have to pay child support. There's a formula that provides for this, so there really shouldn't be a fight about it at all to begin with.

The money should be deposited into an account for the child. When they become an adult, then they can use it for what they need. These types of parents will spend it on themselves!

It’s sad because immediately I could tell both of the parents have drug problems. It sounds like the mom wants to turn her life around, and for the sake of the child, I truly hope she did so. It’s never too late to turn things around ❤
That’s why Judy ruled for her. She was satisfied by her answers and wanted her to get the money to help her. She would have ruled for the guy if he had kept his job.

The tax year that's in dispute is 2017. If he wants credit for the 3 months mom spent in jail in 2018, he would need to claim that in 2019.

This is one of those cases where we just think about the child and can’t cheer either for the plaintiff or the defendant.

If you have a kid, and the kid’s father steals $2,000 from you, you wouldn’t turn around and say that he can keep the money because you care about the child, not the money. Children are expensive. The $2,000 he stole can go a long way. There is no reason that she shouldn’t go after him to get the money back.
They can't fight over the child, they both are super lousy in that department, none would be able to build a case.

Hmmmm. Judging by her quirky shakable behavior, I really don't think so.
Judy got this absolutely correct. If the papers said whoever has the child majority of the year gets to claim them he'd have a case. But they chose to alternate.
There are two issues. IRS rules and state court.
After 2009, the IRS stopped recognizing state court decrees. The child is 6 and this was 2018 or so.
The IRS rules would gave designated the father the custodial parent - the parent with whom the child spent the greater number of nights.
By IRS rules, the decree is irrelevant and Dad properly claimed. Basic federalism - the federal IRS is not bound by a state court decree.
In a civil dispute, IRS telephone assistors will tell taxpayers to go to court to resolve differences between what happened and the decree says.
Both parties got the tax law wrong, but Judge Judy correctly decided based on the civil court decree and agreement, despite her seething disdain for these two ne’er-do-well - a disdain I share.
God help this child.

Judge Judy always has a way of making cases simple. This is the sort of situation where I would not know what the actual law is, so I'm glad JJ is here to made it understandable.

I wish the best for the daughter, but have to give credit to the mom for seemingly trying to make things right in her life. When JJ said marginal parents, she nodded in agreement. Thats how you know she's taken accountability and has been staying clean. Drug use is almost always the consequence of a rough background. Good on her for improving despite the past. It's respectable.
I guess you haven't met many people like that and don't know that they are constantly appearing to be doing the right thing and take accountability. I'm not saying she isn't, but the way she was holding herself really doesn't speak to her positive development

JJ was relatively gentle with these two fragile people. I was impressed with how honest they were with their answers and so was Judge Judy. The judges skill and experience and humanity is so evident in this case.

I appreciate that the mom is genuinely trying. He was pretty slippery to claim her on her mother’s year with the excuse that mom was in jail when she wasn’t in jail until the following year, which was already his.

She needs money to take care of her daughter, and he stole from her. She absolutely deserves its back, and people who say she’s a bad parent for “fighting over money,” need to get a fucking grip. It’s like you’re just annoyed I said something you didn’t like and decided you had to argue for the sake of arguing because nothing I said is negated by your comment. Saying that the mother deserves to have her money back and that getting sober is a good thing doesn’t in any way shape or form imply that what she did in the past wasn’t shitty or that the little girl isn’t the one being harmed the most by her parents’ actions. What I DID say is that it’s her money, she deserves it back, and that saying a broke parent doesn’t care about their child because she wants the money her ex stole (which she needs in order to take care of said child) is fucking moronic. If anything, blame the dad who knew it belonged to her and decided to make her take him to court because he cared more about keeping the money than giving it to her to use for their child.
I feel bad for the poor innocent child. I pray that the plaintiff’s mother and sister are somewhat sane so the poor kid has a chance in life.

2:00 I knew she was a user from the moment the case started and the father looks like one too but not as bad as the plaintiff. Hopefully the child grows up and does not follow in their parents footsteps and repeat the cycle of dysfunction.

The plaintiff showed right away that she uses/used drugs. I know a couple just like this and she looks like the mother and he looks like the dad and they were marginal parents as well. Thank goodness their daughter turned out great. Hope this little girl turns out just as great.

That’s his dependent. The agreement was 50-50 custody, and she did not do that. On the federal level, the tiebreaker rules would be in his favor. Says so on the IRS site that they typically do not acknowledge any court documents on a state level.
She didn’t go to jail until 2018 and this is about the 2017 tax year so the IRS wouldn’t have sided with him.

Here is what I find hysterical. I work my ass off work 12 hour shifts in the hospital and pay a boat load in taxes. I pray each year that I don’t owe. If I do get a refund, I’m doing a jig. My sister, on the other hand, doesn’t work at all, has a dead beat boyfriend and 2 kids and collects welfare. She gets back $8000 in tax refund, every single year!! $8000!!!!! 🤯
