This was a planned robbery,they acted in common purpose which was of robbing of gold dealers.He ddnt explain who was the buyer and who was the seller bcz ndipo pane nyaya futi ipapo…These 3 purported as sellers and that deceased person was a buyer…They approached the deceased in the pretext that they had gold and wanted to sell to him and they started negotiating about the price.They created a scene of a misunderstanding between buyer n seller…Did the 3 had the gold???A big NO…It was a zheti…The 2nd accused produced the pistol and told the buyer that they wer CIDs n buyer asked for identification which they failed to produce.They encircled the deceased that’s when the girlfriend Ketai MNyauyanga and friend of the deceased Langton Bvukumbwe took to their heels n left the deceased person behind in the hands of these 3 heartless robbers.The 2nd accused pulled the trigger hitting the deceased on the face and he died instantly…The 2 heard that gunshot also….They searched him and stole $300 usd that he wanted to use in paying these 3 for their non existent gold…they stole 5.5 grams gold and a gold scale then disappeared in the night…They made a mistake of buying airtime near that crime scene which the police capitalized on and used the card to trace these 3 heartless criminals…This man was the provider of the 2 fire arms…To destroy or obliterate the claim that he was in possession of the fire arms not for the purpose of robbery,The 2 fire arms wer in his possession illegally he was a security guard in Harare and he reported that the fire arms wer missing 2 weeks prior to the commission of the crime….He lied to the bosses that the fire arms wer stolen while he knew very well his ill motives to go and robe the gold dealers using the arms …Anogona hake asina intention to kill the deceased but just robbing him…Asi second accused akabava auraya mufi…So the court hainei kuti ndiani auraya..They use that doctrine of common purpose.As long makaronga mese kunoita robbery,as long u wer there at the crime scene,so chatongwa uyo newewo same same…Ngavafe avo havana basa…Pfuti akadziba kubasa 2 weeks bfore vapara mhosva uyo meaning ndezvekuronga…He travelled all the way from Harare to the place of crime for that purpose of robbing…The gun they used is a Luger grand pistol.
