Elon being a giant baby that he is sometimes, didn't fund the for profit entity and hence didn't get any equity. He simply berated the Open AI team for making no progress and left. Elon didn't care for Open AI until ChatGPT exploded. Yeah, its a bit shady to convert your non-profit to for profit, but Elon doesn't have a solid case here.
The for profit entity would not exist without the resources poured into the non profit in which Elon poured the most. So he created the value and was asked to invest more money to own a part of the for profit arm that only existed because of his and a lot of other generous peoples donations. Sounds legit.
