  • The House Energy and Commerce Committee is hearing from intelligence officials Thursday about concerns of TikTok's parent company, ByteDance, and its ties to China that raises national security concerns. A bipartisan bill would require TikTok to separate itself from ByteDance or risk being banned from U.S. app stores. CBS News legal contributor Jessica Levinson has more.

    I don’t expect the people from “freedom” world the mighty USA, need to use VPN to visit an app like the “no freedom” China citizens do.
    So why claim all these beautiful words or concepts? Like free market or freedom of speech?
    USA are now banning electric cars from China too, and local companies can’t buy the batteries made in China, did the batteries spy US too?

      Yes both are dangerous. But they are not looked at the same way. Cigarettes are already heavily regulated, though, TikTok is not.

      I disagree. They are targeting foreign apps compared to native ones. A big brother situation would be getting rid of apps in our own nation that have differing opinions which they are not doing. So they are not controlling our thoughts rather they are afraid of what influence China could have on the youth.     If it’s a security threat for our country, by all means go for it. No one likes to be frisked at the airport, but if it’s going to keep us safe, go for it. And yes I agree this would have to apply to all companies (even domestic ones)… companies should have no right to invade our privacy or collect our data.

    There has to be a balance between "free expression" and National Security. If someone is exploiting free speech through a platform as China is doing with TikTok, which is affecting National Security, National Security should take priority, then TikTok. Free Speech is not being banned, just one platform used for that speech. It's likened to turning off a microphone, just get another... The conversation may take place elsewhere without ban.

      As soon as I heard about this, I totally understood how and why they were doing this, and honestly was kinda confused with how many people were unquestioningly calling it unconstitutional. There is a case for freedom of speech, but it isn’t at all certain to work, especially when possibly at odds with national security, which is definitely something that has the potential to supersede freedom of speech.

      It is not banning speech it is creating US oversight, to move the data traffic to the US. We are creating nationalized data routing to secure the western powers cyber infrastructure in many different ways, this is one, a security risk because lots of people told not to use it because of possible espionage use it anyway because of its popularity.

      Congress has the power to regulate 'interstate commerce,' and since the bill only deals with entities' selling or transfer of American's personal information to overseas adversaries, it doesn't run afoul of the Constitution. The 1st Amendment says you have the right to say something and the government can't stop you. Whatever users currently say on TikTok, there is no legal burden on them saying those things anywhere else. I still have a feeling that this is gonna die on the floor, 'cause that's how these things usually go, but at the very least a new company (or at least one that is no longer HQ'd in China) will be hopefully subject to US law or the laws of another state that is not our adversary.

      @@Michael-pi8ps The legal question which would come before a court would basically be 'Does banning (though I find it far more likely that the platform be divested instead) a social media platform *for being involved with adversarial foreign powers* place an undue burden on the ability of citizens to associate with whom they choose?'
      I find it unlikely that a court would rule that way, due to the requirements that a platform be owned and operated by a company under the influence or operating primarily from an adversarial power. The state would be able to argue that users would be able to freely associate with the same people on other platforms, and I don't see how (again, with the condition that the platform is owned by adversarial powers) that places an undue burden on the ability to associate.
      Of course, I'm not a lawyer and this is nothing but conjecture and my understanding of the Constitution's interpretation of the rights (the court has indeed ruled Freedom of Association to be a necessary part of the Freedom of Speech) protected from infringement in the 1st Amendment.
      I use the undue burden standard, because if I recall correctly that is also the standard applied to the ability of local governments to limit the time and location of peaceful protests to certain areas and times within their jurisdiction.

    Does the Commerce Committee ever consider the blowback from such a ban? Example, China bans iphone sales in retaliation citing similar concern. And what will this do to our ballooning trade deficit? I'm more concerned with what my gov can do with my private data than a foreign entity, which is nothing.

      The problem isn't user data, it is the fact that China could use TikTok to spread pro-China propaganda. China outright banning iPhone sales would be a massive escalation. China is in a rough economic state as of recently, they are in no shape to do anything as drastic. If anything, banning TikTok would just level the playing field. US social media apps are either banned or heavily restricted in China, is it really fair that Chinese apps are allowed in the US?

    But the Supreme Court case, Citizens United, stated that corporations do in fact have 1st Amendment rights.
    The 1st Amendment protects everyone within the United States. A person of Chinese citizenship could walk down the street singing the praises of China and wishing for the downfall of America; and it would be legal.
