- The plaintiff claims the defendant illegally sublet her apartment to a tenant who trashed and damaged the place, so the plaintiff is suing. The defendant says the plaintiff agreed to the roommate. The defendant believes that since she didn't cause the damage, she doesn't owe the plaintiff a dime.

The fact that squatters have more rights than the owner of the property is absolutely insane. This has been an issue for decades and still nothing is being done about it!
They were tenants, not squatters. They didn’t just break into the landlord’s house and start living there. Some locations are more landlord friendly than others.

There should be ZERO squatters rights!! you can't stay in someone's property if you dont pay rent or you get asked to leave. You are not allowed yo live rent free.

I had a problem tenant that moved into my attic, I called police and they threatened to arrest me if I why into my house that I notified the tenants to vacate 1 month prior.

Why did the defendant get away with trying to sublet the whole house at a profit to a 3rd party though? That ad misrepresented her authority and the ownership of the home. She’s no innocent.
Because the landlord gave her permission DUH! She didn't invite that woman in without permission AND the landlord didn't attempt to run a background check either.
@@SassyDivine22not necessarily because even if the actual landlord gave her permission for the downstairs the upstairs she definitely didn’t allow that and the defendant tried to pose as if she was the landlord . The pictures were from the upstairs which wasn’t to be sublet not the downstairs.

Why did the defendant get away with it? Because the plaintiff let her 🤦♂️ She gave her back her full security deposit. The only issue the plaintiff had was with “Kim”, not the defendant. Did you watch the case? 🤣
Edit: only issue _at the time_ The defendant placing an ad didn’t seem to bother the plaintiff enough at the time, it was only after the fact that suddenly she was upset with the ad, which still doesn’t make the defendant responsible for Kim’s actions. They need to sue Kim
I believe them when they say that the police ignored this as a criminal mischief vase and said it was civil. They don’t do much.

Judge Million is the BOMB !!! The one who rented originally is responsible because she sublet & the judge will report it to the police for the owner because the police didn't take their complaints seriously!!! Go judge!!!
The defendant isn't responsible because she wasn't subleting. She wasn't collecting any money from the other lady and had permission to move someone in. Plus, she was moved out and her share of the security deposit was returned. That's a "she's out" kind of thing.
The basement tenant will do this to the wrong type of people one day and she won't end up in court but a morgue.

I don’t know if that’s where she will end up but karma sure has a perfect person to visit. She’s absolutely vile and evil. I had to rent a year or so and got back entire security deposit after buying my own first home. I’d never destroy or damage another’s property. Being a landlord is a double edged sword. No thank you with the what I’ve seen on other court cases and what people are capable of other!s property. Those bringing in children no parented decently and animals urinating anf scratching up floors not belonging to them

False. If you break a lease you have an obligation to attempt to mitigate the damages. Some landlord will allow you to leave and not pay extra as long as you find a new tenet for them

Maybe they couldnt locate Kim that’s the only reason I can think of or they really did believe the defendant was responsible since she brought her in and she tried to pose like the landlord at some point (for the upstairs unit)

@@angeloc7486 correct and in the case she tried posing as the landlord by literally putting herself as landlord on the Craigslist listing and tried to sublet both upstairs and downstairs when she only had permission to sublet downstairs.
I believe that the husband did indeed install the basement kitchen because it would be expensive to install a sink where there was no plumbing beforehand. Why would a tenant incur all that cost?
1. Squatters' Rights must be abolished.
2. REALATORS need to be doubly sure they're dealing with the ACTUAL property owners.
The husband has lot to do with this mess. I hate when people are in denial and act like their loved ones are so innocent

The Plaintiff said she didn't bring her husband because she thought he had "nothing to do with it". However, he's the one that dealt with the Defendant 9 out of 10 times. Also, the Officer was right. If the Plaintiff was going to rent out her house and allow the downstairs to be sublet, she really needs to learn about tenant-landlord law. The Defendant says she's probably as upset about the house being destroyed. I highly doubt it. That house was the thing the Plaintiff's parents left her and where she grew up. It must have been heart breaking to go through.

My sisters drug addict neighbors let their 9 yr old go joy riding and he slammed their unregistered, uninsured minivan into my sisters fence and then into the stairs of the home they were renting...breaking the stairs away from the home. When she went to the cops they told her it was civil. When she said a child was involved they told her it was heresay and they would not do a report. And the cop actually yelled at her when she tried to get a case number. She ended up calling 911 and thwy swnt thw fire dept. The fire chief was LIVID that the cops did nothing. The whole area was roped off by the fire dept and the detectives on the scene chewed out the other cops for how they handled or lack of handling... also CPS was called since a minor was involved. So again... im not suprised. Cops have NEVER helped me when I needed it.

It's an unfortunate situation for the lady but that's what happens when a person with absolutely no experience thinks they can become a landlord. She should have sold that house immediately and moved on with her life. My dad owns 10+ rental properties and it's not for the faint of heart. There are so many rules, situations, loopholes you have to be aware of. Cut your loses and move on!!
Experienced landlords have issues with tenants also.
SOme people don't just decide to suddenly 'become' landlords. That house was her childhood home, she wanted to keep it. That's a very valid reason to rent it out, it's disgusting tenants who screwed this up for her. Same happened to us. Trust me we would never, ever be landlords again. We also inherited the place and thought decent people could live there. Didn't happen, even through an agency.
They would have to tear down the drywall to get all the diapers down there.

The defendant wasn’t responsible for the AGREED tenants behavior (they sued the wrong one). I believe the defendant actually took good care of the place and Mike helped her build the kitchen(which will add value to it… that’s why they gave her half of deposit back.

This is like the movie Pacific Heights where a charming psychopath (Michael Keaton) movies in destroys their rental, provokes the husband and gets a restraining order so the man can’t live in his own house and then he terrorizes the wife. They didn’t run a background check which proves you shouldn’t take people at face value.

If that was one of the worst experiences of her entire life, then I would think that she is pretty blessed. That situation sounds bad, but walls can be painted, doorknobs and switch plates don't cost much, the toilet seat is probably $15-$20, ah the fits can be cleaned. That's all material stuff that can be fixed. The house is still the same house. Just my view, I suppose, and I know that people have varying gauges of tolerance.

With all the messy details, this has definitely become one of my favorite episodes - I just keep coming back! So many lessons to learn, here. Looked to see if they ever pursued Kim, or it was ever mentioned or televised for PC, couldnt find it. No closure. Sad panda.

A very similar situation happened to my boyfriend; He had a housemate that he originally let move in with him so she could have custody of her kids, and then she moved in both of her baby daddies as well as the three kids. They barely paid any rent, caused huge damages to the downstairs area that they used, and he couldn't even access the kitchen or bathroom properly; eventually he managed to get a new place, but the girl tried to claim that he needed her agreement to break the lease because she was a co-tennant and not just a roomate; when that didn't work, she claimed that technically they were two separate apartments because he had a half bathroom upstairs and a separate kitchen (he didn't, just had a hot plate set up) - The landlord and my bf had to go through court to get her officially evicted; she's still there and the case is still ongoin, because she got an extention on the case due to "mental hardship" - she got beat up by one of the baby daddies, who wouldn't have even been there if she hadn't invited him in. It's a total mess and my bf may yet have to pay a huge amount of backrent he doesn't actually owe.... :/

I know landlords get a bad rep, but its tenants like "Kim" who ruin things for NORMAL, decent individuals who actually appreciate having a roof over their heads. I've thought about purchasing a multifamily with the purpose of renting it out, but horror stories like this have definitely deterred me from following through🥴
