      unfortunately, most states allow evictions for any reason. HUD has a different list of requirements.

      @@SmedleyButlerIII Yeah, I peaked that, I'm not sure that's allowed. But it depends on your city & state.. Even without the current world issue, it makes no sense if they already accepted the new tenant & the tenant has moved in. U can't suddenly just back track, based on what really is essentially bad credit.
      There must have been more, that wasn't said, like for example, an agreement she could've made to pay off the previous owed money even after she moved to a new place.

      Smedley Butler III Even if you owe money to another landlord they can’t kick you out as long as your current with your knew one and they would have to give her back her first and last and that current month as well. Also the judge ruled in her favor so they would owe her money for the many days that she did not have access to her home. Also even if they change the key they would have allow her to get her items out of her home or she could sue them for theft of personal property. There is something call the renters bill of rights. Renters are not slaves people I have been renting all my life. If your Lord Accepted you at signing they cannot kick out of past rent due at another place that is why they check your rent history. Also even if they allow to move in and it’s there property it seem really strange that they would not demand that full payment at the time at signing. That is what they do to black people all the time. 🤷🏿‍♀️ I wanted to move to a different city, I don’t have a job but plan to get one there. They said would not rent to me because I don’t have a job in that city. I told them that makes no since I’m going to get a job there but I need and address to work people. They said I should move in with a relative. Not everyone has them to move in with. I told$ them they are nuts I just want to rent an apartment why are you telling me to move in with others? Then he told me to get a boyfriend to live with. I then asked him if I could pay a lease up in full and what were their options. He said would have to sign a 12 month lease and pay up in full. I told him that is like 30,000 dollars, why would I pay that much money to lease an apartment? So then I decided that I would have to look for a house because these complex’s are out of their mind. 🤦🏿‍♀️ This happened two weeks ago.

      As a landlord, why should I keep dead beats in my rentals? Example, one guy never stopped working but because of this pandemic he hasn't paid a dime. He had messed with the water lines coming in the house, including the wires going to the well. Blew up a $400 water pump. I refuse to fix his water and won't. Going to court this week in hopes of getting him evicted!

    Landlord should have been mandated to give the tenants access to their apartments within 24 hours or he need to return the monies OR face seriously penalties. For every day that they are denied access he should be locked up equally! I can’t stand when people try to get over on people.

    • @KataRina-qd4vn
      @KataRina-qd4vn 4 ปีที่แล้ว +1

      There's generally a 10 day notice required for my state. Locking people out is considered "self help evictions" which is not legal. I'm a landlord too. Depending on the type of tenants you have, it can really shape your view when you meet lots of bad eggs. I'm willing to work with the tenants I have today, but I've met a few people who abuse the court systems and simply have no intention of paying near the end of their lease, costing me almost $3000. In this line of work, if you show sympathy, it can cost you. That's why landlords are like this.

      Usually the tenant will be held financially liable for any optional re-keys during the lease. The landlord is also usually the one who contracts the locksmith, mainly so the landlord can ensure they get their copy of the new key. Most locksmiths won't even think about doing business with renters in an apartment complex. Regarding her rights, this may fall into an "otherwise provided by law" situation since the landlord failed to uphold the conditions of the lease with an unlawful eviction.

      Perhaps she is renting from the same management company as her prior apartment. They may have discovered unknown 'damage' - landlords do this all the time - and are now seeking payment. Things such as a very old rug, perhaps more than 20 years old, that now has a stain discovered after the tenant moves out. The landlord will file suit to be compensated and request to be paid. An old rug may well be worthless, but the landlord will ask for a new rug and produce a receipt, for $1800 or so, and the former tenant will have to pay it,or fight the matter in court.

      Rent-seeking is speculative. Land owners aren't owed money from the government because someone can't pay them rent. In fact...if I were to make a prediction...the whole "business" of rent-seeking is going to be flipped on its head. These renters aren't engaging in a luxury purchase; these are their homes. Why are land speculators extracting wealth from others simply because they need to occupy a dwelling? I have news for you: having a dwelling is a natural right. The fact that the government honors these "contracts"is actually a violation of the spirit in which the Constitution was written. You want to build wealth: try contributing something of value to the economy and not be a vampire. Change is coming.

    This is why you never do section 8. I hate that people don't have a place to stay but these landlords also got to make their money. All the money that is due. As a landlord myself after the insurance, mortgage interest, maintenance, etc there is not much profit left. If you don't pay, you should leave. Were the stimulus checks for the landlord or were they earmarked to help those with housing issues? I got a stimulus check and fortunately no evictions. I get to keep the money. If the tenant doesn't pay, than magically I am responsible and then I have to? It all depends to what this stimulus check was earmarked for. It is TO the landlord it should be given to the landlord for themselves. If it is to the tenant then give it to the tenant so they can pay for housing.

    I would consult a lawyer for an illegal eviction. Because the "landlord" filed papers on you (they) are in the system forever and have them pay for all to costs to have it completely erased and try and seek a judgment for the illegal eviction. I believe this is straight forward contract law so no pain and suffering, but perhaps if you had to live on the street and all money paid out of pocket should be reimbursed and if you (they) have never been in the system an argument could be made for defamation of character more so if the record can't be purged. I am not a lawyer and this is not legal advice, see my first sentence.

    The landlords who took this federal money with conditions then still evicted their tenants were clearly in the wrong. However, I think landlords, especially ones who are not large corporations, should have the right ro evict nonpaying tenants. Why should the landlords take huge financial hits if the tenants can't pay? All you're doing is shifting the burden, and smaller landlords will likely go broke.
