      Honestly, I don't believe that the defendant caused the damage to her car. The chips just don't make sense for someone hitting the car with their hands. The defendant was wrong to do anything other than to just keep driving, but the planttiff was definitely not innocent. She shouldn't have received anything.

      Actually, you're not. It's only legal to use your horn for warning purposes such someone is trying to merge into your lane and you're warning them that you're there. What the woman described wasn't a legally justifed reason for honking her horn since she slammed on her brakes and then honked. Then she honked her horn again, long after the event happened. That's why the Judge said she felt no sympathy for the woman because she antagonized the defendant with the second honking and all of this would've been avoided if she didn't do that.

As a mom that's the first thing she should have said. I believe she did throw the coins at his car. He was very angry after that point and his actions were based on that. I doubt he goes max crazy just over her honking the horn. I also believe she gave him the finger or something. Her story is very unbelievable when she claims she just "Beeped and looked ahead." She also didn't answer the question the first time when asked about throwing the coins. She said "We weren't even in a position to throw coins" I feel like she's a liar and he needs anger management. Both are crazy. And I see the Karen part because she immediately called the cops and didn't take any of the blame for the incident. @@VladmirPoopN

    @tazlolol 6 หลายเดือนก่อน +50

    Being someone who lives in the south, it's common sense to only use the horn as an alert, not an "HEY YOU ALMOST HIT ME, HOW DARE YOU BREAK CHECK" reminder when getting in the clear. That's how you get shot.
    If she had honked when the incident happened, I'd get where these comments are coming from, but the plaintiff honked while passing the car once it looked like she could get away safely. Not while being break checked, not while almost being hit, but after all of that when she was in the clear. Horn's are not meant to get the last word in, that's how these situations happen.
    There is a level of being the victim, but it is possible for a victim to become an antagonist. You don't get a free chance to go after someone because you were victimized first. She chose to poke the bear because she thought that he wouldn't keep acting aggressive towards her and honestly she had ZERO reason to believe that.

    • @ultimatecouponlady
      @ultimatecouponlady 6 หลายเดือนก่อน +2

      @@VladmirPoopN She honked twice. First when she was cut off and second once she was in the clear and passing him. That's getting the last word in, not a reaction to the event that scared her in the first place.
      -------------
      Plaintiffs words between 1:42-2:45: They were on a one lane road and approached a traffic light, the lane then splits into two lanes. She goes in the right lane, He was in left lane and then cut her off while traveling after aggressively moving his steering wheel at her. She slammed her brakes and honked her horn (THIS one is reactionary) as he came into her lane.
      They proceed, defendant is in front of her now due to cutting her off. He starts break checking her. Road forks to a straight lane and a left turn lane, he puts his left indicator on to make a left hand turn, she proceeds to keep going in the lane she is in due to having a green light.
      She passes him, he was on the left, and she honks her horn at him wall passing. He then gets out of the left lane and proceeds to chase. "I passed him, he was on the left and I honked my horn at him" "I just looked straight ahead and beeped the horn and continued down the road"
      She even says she was glad the defendant was turning but then STILL chose to honk at him.
      ---------------------
      It's not the first honk that spiraled this, that one made sense and was used in a way horns are meant to be used "Hey woah buddy, you're cutting me off! Watch out!". It was the second one. The completely unnecessary one, the non-reactionary, non-purposeful, completely out of annoyance and stress one. This one was used as a "Get off the road DBag! You're a terrible driver." It was making a statement, not an alert.
      It is 100% possible to start as a victim and become an antagonist, ESPECIALLY when the victim thinks they're in the clear. This is incredibly common in road rage cases, dashcam youtube channels like dashcam lessons and megadrivingschool show that this happens A LOT where the initial victim becomes the antagonist.
      And no, I would vote for Sanders if given the chance.

    My wife, 3 of our kids and I were driving home one night. I was in the passenger seat dozing off. We came into a construction zone where 5 lanes merged into 1. My wife had gotten all the way into the right lane which was the only lane moving. As we crept forward 5 feet at a time we came up to an entrance ramp on the right side. 2 lanes on the left were still merging into our lane and then there was a right lane merging into our lane too. My wife let one of the cars on the right merge in. After creeping up another 5 or 10 feet she slowed up and let a 2nd car merge in. I was laying with my head against the passenger window when I noticed that a semi behind us was right on our rear bumper. His headlights looked as if they were about to hit us. We were at a dead stop at this point as everyone tried to merge from both sides. All of a sudden I heard someone at my wife's door yelling and calling her a stupid bitch. I immediately sat up and looked this greasy little man straight in the eyes. He saw me, turned and ran for his truck. I threw the door open and tried to run after him. The seat belt caught me and pulled me back into the seat. I unlatched it and took off after him. By the time I got to his door he was safely in the cab and locked inside. I pounded on the door but he wouldn't come out. I remember people in the cars next us laughing and one guy yelling, "Kick his ass". OK, I've never been involved in road rage before or since, but this little man thought he was going to bully a woman and her kids and didn't realize a man was in the car. He ran like a little girl when he was confronted. And to the judges point, as I stood outside of his truck it all of a sudden dawned on me that the guy might be armed. I walked back to our van trying to be tough but honestly I was a little bit scared he was going to jump back out with a gun. We drove on through the construction, the trucker actually let a couple cars get between us and afterwards we drove home. It's just a story now. Road rage is stupid but in that moment I went into protection mode and nothing else mattered at all. Was I right? I could have died but I will protect my wife and kid's at all cost.

Multiple courts have determined that the flashing of the brights by that driver was their communication, their legal communication and their freedom of speech to the other drivers.
