    This is one of the most important documents of every business. A properly structured employment agreement will add clarity, reliability and predictability into the employment relations within your business as well as will provide material protection to your business interests.
    Every employment agreement must have certain provisions and definitions explained in this video. Here is the list of topics that require your particular attention when preparing your employment agreement:
    a. Definition of a position, expectations, KPI’s and reporting hierarchy of the business;
    b. Compensation package - including salary, commissions, bonuses, benefits and more;
    c. Incorporate corporate policies and procedures into the agreement, make sure you can update them later with the immediate effect on relations with an employee;
    d. Define leaves of absence - types, length, payment privileges and more;
    e. Define employer’s right to request medical confirmation in certain situations;
    f. Termination of employment - with cause and without cause, procedure, obligations;
    g. NDA, non-solicitation, non-compete;
    h. Ownership of inventions and creations (where applicable).
    These are only the basic provisions that every agreement must include. Your particular circumstances will require additional provisions, terms and definitions.

    if we work freelance/part-time at place which is non-competitior of your employer then does breach contract??

      Depends which contract and what it says... But if you work for non-competing employer, why would your previous one care?????

      @@businessincanada-doitright1822 Not previous , current , if we are currently working somewhere and want to pursue freelance/part-time at place which is non-competittor of our current employer . Then is it ok??

      @@businessincanada-doitright1822 Contract says that we cannot work part-time or get involved in any buissnes without permission from the company , but if we take permission employer may release heat during our employement as employee is working somewhere else because he may b not satisfied with us so isn't it better to do it without permission??

    If you signed an employment agreement, and are being held accountable for a breach of the contract can you be held liable, if you were a 1099 the whole time?

    I was never on a contract and I'm not required to pay anything back to the business company hours of work I did and now the government want to tax me extra hell no

      Which is technically good for you. By the law, there is an employment agreement whether in writing or not. Make sure that when your employment is terminated, you receive a proper legal advise of the terms of severance.

    When it comes to non compete etc, can it be given at the end of employment?

      Luis, generally, when it comes to non-compete, these are mostly unenforceable provisions that most courts in Canada had refused to enforce, except for very limited circumstances (short period of time, small geographical area and more).
      With regards to your question - yes, you can provide it at termination, but there should be some sort of consideration that you pay for a consent to not compete in order to make it enforceable (see my general comment above :-) ).

If I decide to leave my current employment to go work at a different company that does the same thing, could my current company force me to sign a non disclosure or non compete or something along that line, before leaving or when I leave?

      I’m just trying to understand how these work. In my mind I would think it’s something that would be stated in the beginning of employment when i sign on to work to the company.

      Luis, employment contract, just as any other contract is at freedom of the Parties - you can decide when to agree, what to agree, how to agree. So, essentially, it is possible to sign a non-compete at the end of employment, but!!!
      First, you have to think about the nature of the bargain - if your employer wants you not to compete (work for a competitor), it means you will not be able to earn your income - then the employer should PAY for it. You can negotiate a nice termination package in exchange to your agreement to not compete.
      Otherwise - they cannot "force" you to sign an agreement....
