The advantage of real democracy is the ability to criticize the government with impunity. And this is very good. In Russia, criticizing Putin is punishable by 20 years in prison. Trump wants to repeat Putin’s experience and build a Russian model in the United States.
This is so obvious and has been since pre 2016. That’s a lot of time for people to see this. So many in positions to stop this are not and they are failing what will have been the US, past tense. Soon enough I think

The Supreme Court is not a “trier of facts”; they are supposed to be ruling strictly on questions of LAW. Are the laws valid & constitutional? How do the laws get applied? That’s the point Alito was making, and he is 100% correct.

Alito’s hypothetical suggests Trump is not being prosecuted because he broke the law but because his opponent is “bitter.” That’s scary.

Also, if the POTUS has immunity, he doesn’t need to misuse the DOJ if he wants to go after the former POTUS. But he can engage in way more nefarious ways to deal with the FPOTUS. And I think the Justices who didn’t agree with Trump’s lawyers position ought to have made that clear.

Alito then insinuates that AGs, special investigators, federal prosecutors, grand juries, judges, selected jurors, appellate judges (including the highest of those: the SCOTUS justices themselves) are all mostly corrupt and would accept political persecution. That he thinks the whole justice system is flawed. Is this because he thinks he might engage in such things himself?
Further, if the POTUS is immune, he doesn’t need to misuse the DOJ to persecute the FPOTUS, but can use SEAL Team 6.

It's more that the people who put the right wing justices on the bench. the Federalist Society and the Heritage Foundation, need Trump as POTUS in order to enact their master plan: The far right so-called Christian conservative takeover of the USA. Project 2025 all hinges on Trump becoming president and having absolute immunity from prosecution.

Again, I have to say that Allito seems to have no confidence in the judicial system by his hypothetical…being criminally prosecuted is not possible without a crime. Am I the only one hearing this? We watched the whole process these past 2 years. Prosecutors must provide evidence OF A CRIME to a grand jury, who must recommend indictment OF A CRIME. No crime, no possibility of prosecution. So all future Presidents need not fear prosecution, and therefore seek to stay in office by NOT COMMITTING CRIMES. Right?!?

This is a very fair and important question. I wish that there was something that could be done, but I just don’t know what can be done at this point. we can try to add justices to the bench which should be done, but at this point it’s going to look like politically motivated balancing which I guess it would be. It’s a scary situation that we’re in as a country, anyone who has had a malignant narcissist close to them in their lives, knows the damage and destruction that that kind of human being will wreak on everyone and everything around them. This time it’s on a national scale and it’s absolutely terrifying.

It is absolutely within the power of the political branches to set the size of SCOTUS, and to limit its jurisdiction over the types of cases not enumerated to it in Article III.

What justice alito postulates only applies, up to this point in history, former president trump. No other president would have entertained the idea of seeking revenge on his or her political rival. No other president would have entertained the idea of going after his or her critics in the press or media. To call his musings facetious and disingenuous would be a massive understatement.

Hypotheticals have their place; but at some point, for the sake of clarity for the American people, the actual facts before them, from this case, specifically, need to be addressed.

We must face the reality that none of the US Constitution's framers gave a thought to the idea of a partisan Supreme Court. Such a thing would have been beyond their wildest imaginings. The country is attempting to run its most important courts, here in the highly partisan third decade of the 21st Century, based on the status quo of the final decade of the 18th Century. It's absurd.
