    Judge Simpson is one of the nicest judges out there. He is friendly, fair, and he's even got a good sense of humor. He doesn't just get mad over little things, so if you manage to piss him off then you know you messed up because it takes a lot to get him to that point!

    This guy is the reason some people think lawyers are slime buckets. He dug in at the end ,asking the judge if he’ll be handling the hearing. That sounded to me like he wants a different judge. He wants one that won’t call him out on his bs. He had the nerve to ask that. Wow!

    Ahh yes, The age old "No crime was committed... but if there WAS a crime committed, my client didn't do it... but if she DID do it then the case should be dismissed cuz of witness tampering...     I’ve worked with many attorneys and been in many courtrooms and never have I ever seen such an insufferable drama queen (complete with dramatic hand movements) attorney……ever!
    I hope he was appointed and not retained because his client should be worried.

    I love how this judge takes a minute to regroup, and then he comes back to school attorneys. He's everything they need in order to become-and remain successful. That's what he teaches.

      My Judge's Bench book has 2 great secret comments in the sidebar of the article on citing attorneys for contempt- 1. If you are losing temper take a break, count to 10. v2) Except undermost severe situations, an apology should end the matter.

      Not quite. He said he is not asking for the report, which the prosecutor said will happen eventually, but rather the communication of the prosecutor with the victim. It sounds reasonable to me. To say that the prosecutor doesn't have the communication is ridiculous.

      @@volodyanarchist You need to listen more carefully. He is asking for emails between the alleged victim and a detective. He has no evidence that such emails exist other than his client says that an IT employee says that he saw the emails but they do not bring in the IT employee.

      If that is the case then the defence is still entitled to those emails if they exist. I hope they summon the detective to ask if those emails are there. If they are, they can refile the motion.
      I agree that demanding that the prosecutor does the collection for them was a mistake. Prosecutor must turn over the evidence they already have, but compelling them to collect something extra would turn the prosecutor's job into impossible feat.

      Everything should be turned over. The prosecution brought this on themselves.
      The charge is against a local government employee and it’s saying she committed a felony while doing her local government duties.
      Guess what Michigan State law says? Anything that pertains to the way government is being conducted is open to the public. AND you don’t have to know it already exists - you can ask for it in general.
      What you have here is too many people afraid to tell the boss no (the Sheriff and the other employee that went to the Sheriff instead of the town council). Now it looks bad.
      Judge Simpson is too mad. The reason is there are a few other cases involving the way this Sheriff has worked as well as full-filling public information requests so the anger is part worry that there are parts of the government not working correctly and people who didn’t stop it will have their reputation tarnished.
      Lay with dogs, you get fleas. The prosecution doesn’t even understand the crime he’s charging. The township used ONE computer for the whole council and the employee who made the complaint signed into their personnel Outlook account and left it running for months.
      They probably can’t even prove who sent the email in question and they’ve brought a felony against a local government worker on the word of another local government worker who side stepped the township completely to make a complaint.
      All their communications are open record. If the township had been given a chance to address it first, they would have had a closed meeting. But nope. A friend of the Sheriff is going to get felony charges against a coworker and now the prosecutor doesn’t want to be involved and knows nothing about what the Detective has done.
      Ya’ll are crazy with picking and choosing which laws to follow.

      I agree! Love hearing words said that I haven’t heard or used in years! Given the times we currently live, witnessing a ( albeit ridiculous in the lawyer’s motion ) critical analysis of court and municipal ethics was refreshing. Also reinforced my decision to stay way out of local politics!

    She illegally accessed hathaway's email and sent some private emails of his to her own address, but doesn't consider that a crime.
    These newly requested emails were probably discovered in a similar way. The defense attorney knows this.

    I always thought they had to present evidence to make that kind of motion. Like an affidavit from one party who took part in the communication stating under oath the communication exists. Otherwise it’s just gossip.

      Addendum. At almost 28 minutes which includes the judge recessing to give this idiot time to contain himself and the frank response of the People, this yahoo does a backhanded and lengthy apology and still says shenanigan especially mentioning another prosecutor.
      If he isn’t careful, he is going to end up getting sanctioned by his false deliberate sideways accusations.

      we saw the same thing from every lawyers and trump in every case that he had before the court and trumps followers believed it all and still do. expect to see this more often in the future since it worked for the president elect. it worked so well that even after the 34 count convictions, the two judgements in the e g carroll case and int he NY fraud case that his follower still claim it was all a conspiracy and voted for him. with it being so successful why would any good lawyer not use these same tactics.

    The defense attorney is asking for information that the prosecutor does not have. He should be submitting a FOIA request to the city instead.

    Judge Simpson has the patience of Job. Presenting conspiracy theories in court is tantamount to lying. Using hearsay from the defendant to attempt to accuse the prosecutor of withholding evidence is not based on legal practice. Mr. Wavy Hands should find another line of work.
