- Sarah brought a parking ticket to Chief Judge Frank Caprio but the judge thought the ticket was ridiculous. Sarah explained the clock in her car said it was 10:00 a.m. when she tried to park in the spot that was a no parking zone from 8:00 to 10:00 a.m. She was fined for stopping her car two seconds before parking there became legal. According to footage from the show, the judge gave her a hard time anyway, joking to the court inspector: "What does justice demand in this case, is it jail?" #InsideEdition

I once got pulled over while visiting Oregon for reckless driving at 20MPH... I was trying to find a hotel and didn't know where to turn so I would pull off to the side at every intersection...
the illusion is that they spent money in "processing". that ticket literally spent less than 5 minutes in the chain of processing. though these organizations inflate costs/time to continue claiming they need more tax revenues.
Well she ends up paying for court fees--not the tax payers. Next time she will learn to set her clock correctly.

The job of a judge is to determine whether a law has been violated, not to bend the law, change the law, remove a law or make new laws. "Common sense" doesn't enter the equation. The law has nothing to do with "common sense".

But seriously, a judge is perfectly within his rights to dismiss a ticket that was issued within *_two seconds_* of the cutoff time. And we as a society need judges to be able to use common sense to administer the laws effectively and fairly and to do justice. Indeed, it was the total *_lack_* of common sense on the part of the meter maid that got the motorist and the judge into this situation. That ticket should never have been issued in the first place.

@@yumri4 Thing is, if the parking officer or w/e it's called in English hadn't been in that street for a couple of hours, he or she have no way of knowing if she had just been there for a minute or been there for 2 hours already, unless they actually saw her park, in which case issuing the ticket is a huge face palm indeed. That said, with less than a minute to go, they really should have given her the benefit of the doubt. I mean, two seconds left? Really?

Stephen Ray Whaaaa haaaaaa best yet! Cracks me up! Where I am from the courts have guidelines for enforcement that includes margins of error and such. So parking with in 15 mins is not getting a ticket or any speeding should be over 10 above posted speed. If not it is an automatic dismissal unless there is a real pressing reason why it is necessary. The local Judges did not want to waste any time at all on the minor silly infractions.

Judge Caprio is the best. He's extremely fair & compassionate. However, he knows a B.S. story when he hears it. Another words, do not try to pull the wool over his eyes...because he'll see right through it & he may give a decision that wouldn't be in favor of the defendant!

Unless the meter maid was standing at the spot when this woman pulled in and immediately wrote the ticket, something's fishy.
It was automated. Wasn't an actual person that issued the ticket. If you watch some of the other videos of this judge you will see him using a computer screen to witness the violations like running red lights. So this city obviously has automated ticket processes and this was one of them. This scenario is so rare that using the cameras instead of a real person to watch parking spaces all day is of course much less expensive and they likely issue far more tickets this way.

@@impreza316 For such a small time measurement to be valid in court I would still plead that unless it is tuned to an electronic clock by radio control or GPS time then the time is open to dispute. Regardless, a nasty, officious individual for issuing the ticket.

This reminds me of a case my father's attorney talked about. He was also a judge in a small town & he heard a minor in consumption case. The guy who was contesting the ticket was in the bar 3 minutes before midnight of his 21st birthday. He told the cop who wrote the ticket "Do you really think 3 minutes makes that much difference on a person's maturity level? Case dismissed."
Law should be: if a person issues a wrongful ticket, they must pay the sum of that ticket.

Apparently it was an automated thing, not an actual parking... person (idk the English term) writing her a ticket.
Argument 1: there is a reasonable doubt as to the actual time.
Argument 2: even if argument fails, the principle of “de minimis non curat lex” would likely apply.

Wow, what a great and wonderful judge. I met a justice like this good man. But not for a traffic violation but to get my disability for my medical condition I had suffered from before getting the correct diagnosis after 23 years of suffering.
