My friend just got in a wreck due to a drunk driver. She was coming home late after a night of work, and a drunk driver swerved into her lane, she swerved due to panic and flipped in her car and got stuck in a ditch. The drunk driver just drove off. I was a defense attorney for 20 years and represented hundreds of DWI clients. While the vast majority were just normal people who truly did not know they were impaired, did not do badly on field sobriety tests, and had relatively low (but still over the limit) B.A.C. They made a mistake and were generally very remorseful. If I managed to find a flaw in the breath test (and believe me those machines are NOT infallible) and got the charge reduced to reckless driving, I had no problem at all doing so. But there were a handful like this woman and representing them made me sick to my stomach. I've even had idiots show up to court drunk for their DWI case, having DRIVEN to court! (Two got arrested leaving the courtroom.) Eventually I decided I'd had enough and now I'm working on getting back to teaching math. Every defendant in this country is entitled to legal representation but it's women like this that made me quit.
All I read was "defense attorney". I stopped reading because people like you are the reason people get killed/raped/beaten, whatever. You plead for their freedom to go out and do it again and to HELL with the victim. It makes me sick.

I know, that sucks. What is worse, if he were to not be alive -- it would only add an extra year. Involuntary Manslaughter, even while intoxicated is Min. 5 years (With a damn good lawyer).
FUN FACTS: for anyone who curious what ultimately happened, Maria Aguilera ended up accepting another plea deal: 5 years in prison, 3 years of probation, 200 hours community service, substance abuse counselling. But wait, there's more! This report on the case was severely lacking. I don't criticize WPLG Local 10 for not saying what the defendant's ultimate sentence was, because they aren't time travellers, and had no way at the time of this reporting to know. However, this report was weak. They didn't explain the details of the plea deal that got canceller, anything about the accident, and didn't show the defendant's odd or disrespectful behavior in court that lead to the judge bringing down the hammer of gavels onto the confused cranium of the criminal cr-something or other. But wait - here's the more! The accident that cost Perez his legs wasn't just an accident: he was coaching his son's baseball team and got hit ON THE FIELD. Two other people were also injured, with Perez the worst. The original plea deal was for 4 years of prison, 1 year house arrest, 2 years probation, 300 hours community service, substance abuse counselling. So basically her house arrest was turned into prison time, she got an extra year of probation, but dropped 100 hours of community service hours. That concludes this edition of FUN FACTS.
Thank you, Judy, for kindly explaining what actually happened in the end with this horrible case💔:( Also, please ignore the mean "Grammar Police" in the comments since he did NOT bother with any facts, except for being UNkind🙄!!
Thank you for filling in the blanks! There's absolutely NO excuse for anyone to get in a car and drive impaired - "buzzed driving" or solidly self-aware plastered... And the ridiculous thing is that those who do know that they are actually not in a state to drive , that they aren't "themselves",otherwise the issue of convincing themselves wouldn't enter their minds at all when they turn that key.. and every dui driver will tell that they had that conversation with themselves because they already knew it. My mother , years ago, had a drinking issue and I thank God she never tried to drive home. She had her "neighborhood" bar and that's where her friends all were. But I do give her credit because she would go to her car, get in and lock herself in and sleep it off. She never drove. I have a special interest here , I feel, since I graduated from South Dade High, but in 1978,years before this principal was there.. but it still pisses me off. I say throw the book at them, they kill and main people who are innocent and we love and care about
Well obviously they didn't know what the ultimate sentence was, since this video is about her failing to get a plea deal, which means the trial is still ahead.
I don't see what's wrong with Judy's grammar here. Baffled by that comment. Agree that this news report was very weak. Kept waiting for them to actually play the video of Aguilera, but the payoff just never comes. I was impressed with the reporter's ability to strike a relatively neutral tone when reporting on the woman who crippled his uncle.

in texas, its zero tolerance, not only do you get fined over $10,000 and spend time in prison, but you also deal with muuuuch higher insurance premium and license suspension, and you kill someone while DUI, you get locked up for a looooong time, and if you refuse a breathalyzer or sobriety test you go to jail, it can affect you for the rest of your life and if you harm someone in the process, you can kiss your old life good bye! its extremely frowned upon when trying to gain employment too. I always say "if you can afford to go out to a bar, then you can afford an uber, lyft, taxi, etc" and its soooo much cheaper than a $10,000 fine too, but you avoid expensive bar tabs and uber fees all together if you just drink at home, and its cheaper too than going to a bar

Murder is when you plan someones death, what she did is manslaughter. You cant just make up any old charge, the Judge would have thrown a murder charge out and rightly so, it was no murder, attempter murder or any other kind of murder as it was no previously planned.
Right. Yank the plea deal cuz she shows up to court high, yet lets her walk out?? Wtf!! I went to high school with a guy who got 3 dui's in as many weeks, getting majorly injured (and injuring 2 old ladies) in the accident that got him his 3rd. From someone like me who has bipolar and anxiety, she can pull the Bipolar excuse all she wants but our doctors tell us bipolar patients how important it is to stay away from alcohol and she continued to drive under the influence of alcohol there for I hope she’s still in prison.
As a bipolar person too, I absolutely agree, the only thing I don't get is why everyone was outraged that she was medicated. She NEEDS to be medicated, she DOESN'T need to mix her meds with alcohol. If she didn't take meds she could explode into full blown mania and potentially do more damage than she already did
I got caught dui, I deserved everything the judge gave me, I didn't like it...but don't drink and drive and you have nothing to worry about. and she is a mess? what about the guy that lost his legs?
All she had to do was keep her mouth shut besides saying "Yes your honor" and she couldn't even do that. No self control and a big mouth, have fun behind bars.
I have bipolar depression and I don’t go around having selfish moods swings. Nor do I drink and drive. I don’t drink at all because alcohol is a downer and causes manic episodes. Bipolar depression or not you can control ur emotions, it’s hard but very possible
it’s different for everyone, but i don’t think she even tried to get help other than the anxiety meds. everyone should be in therapy even if they have meds. meds are temporary.
Also if she was acting this way because of the medication that would suggest that either she was taking the medication incorrectly or this was a new prescription, both scenarios are pretty irresponsible when you're about to show up in court. If she wasn't competent before the medication or it was otherwise immediately necessary that could have been conveyed to the judge beforehand and accommodations might have been made.
Being in the customer service profession for 30+ years I can 100% tell you that there's a SCARY amount of people without a lick of common sense and live in their own little bubble. It's amazing how some people live long enough to be adults without winning a Darwin award. Then think about all those people breeding, popping out kids to teach the next generation about how to be stupid and irresponsible.
I get that you’re trying to be snarky but this is kinda dumb. They were both disasters. One was a worse disaster. It’s like someone saying “my roof got torn off by a tornado. They can both be disasters.
I have a dwi from when I was 22. I’ve been an alcoholic since I was 18, and I’ve been struggling with sobriety since then. But not a day goes by I’m not grateful for the officer who arrested me that night. The idea that my selfish, negligent, and irresponsible behavior could have resulted in someone’s life being lost or ruined causes me to cringe regularly. Unfortunately repeat offenders like this require severe legal intervention, because if a night in jail isn’t the wake up call you need, then the next step is a day in court with a family in mourning. Please, if you have a friend or family member who is “fine to drive” “driven more drunk than this” or whatever, take their keys! Alcoholics have normalized and justified their behavior, and it will not stop until someone’s dead. Be safe everyone, and seek help if you need it. There is no shame in it.
I wish you the best with your sobriety. It's definitely not easy, but it IS possible. Take it one day at a time, and try to make each day a little better than the last. I'm glad you came to your senses and are no longer endangering peoples lives on the road. I made the mistake of driving while buzzed a few times and I was so very lucky that I didn't hurt myself or someone else. It's such an incredibly stupid thing to do, and completely avoidable!!
I've been sober 20 years. It wasn't easy and I fought with the staff constantly during my 30 day rehab. Those wonderful folks!! They saw I was struggling, angry, understood and set boundaries. Never drank again. It's worth it. I'm a very happy positive person.
She went to jail for five years and three years probation. She got out February 2023.. She wasgiven an ankle monitor that detected whether or not she had been drinking. She tampered with and was rearrested for parole violation. When tested for alcohol she had triple the legal limit in her system.

Some people quite literally do not ever learn, bottom line. Some people just do not have the capacity. When your own bad choice causes an innocent man to lose his legs... and your sitting there acting like that, just crazy.
also....Never criticize your meal....whether it be a restaurant or Mcds....to the waitress or waiter or front counter order taker. Rejected food is "improved behind the counter with special treatment".
I don't see a husband with that woman. Most likely the son had no one good to guide him in his childhood. Very disgraceful that she abused substances and caused a man to lose the ability to use his legs and endangered many more. Very shameful that she abused substances on the day of the plea deal which fell through. Very ungrateful for not even trying to take accountability for her actions while only thinking about herself, with her son having her as a mother, being an embarrassment to their family. Some people should not be allowed to breed.
I don't really care about his "compassion". A person like this needs to be off the streets as long as possible in order to protect other people. If you can't stay home drunk or come to court in a timely manner, you are the type of person who would take the keys of a car and drive drunk or drugged out again.

Baffled by that comment.

in texas, its zero tolerance, not only do you get fined over $10,000 and spend time in prison, but you also deal with muuuuch higher insurance premium and license suspension, and you kill someone while DUI, you get locked up for a looooong time, and if you refuse a breathalyzer or sobriety test you go to jail, it can affect you for the rest of your life and if you harm someone in the process, you can kiss your old life good bye! its extremely frowned upon when trying to gain employment too. I always say "if you can afford to go out to a bar, then you can afford an uber, lyft, taxi, etc" and its soooo much cheaper than a $10,000 fine too, but you avoid expensive bar tabs and uber fees all together if you just drink at home, and its cheaper too than going to a bar

Anyways, while he's going to court for these cases, he's super medicated and still using drugs, and the judge noticed and ordered a drug test. He popped for meth, being that he was prescribed everything else he was dirty for, and that judge locked him up til his sentencing, and gave him 8 yrs... This broad took a man's legs..
@Darren Gilliam bass doesn't make things deeper 🤦♂️🤦♂️🤦♂️

@wkruit1 yep.
Forever jail time not lots.
Lost his legs and still being generous? No words...
Beyond generous I may say.But she messed up herself again.
It's perfectly possible to be generous without legs, you silly sausage.
@@rokasb6907 No, that's not what they meant. They meant that he was generous toward the coward who ruined him. She took his legs, and he asked for a plea deal. That shows you what kind of person he is. The only thing she truly deserves would be the maximum sentence. You sound like a "silly sausage," whatever that means.
no sympathy for anyone drinking and driving. Maximum penalties for all of them.
This country is way too easy on drunk drivers.
We've sentenced a couple of people to death for 8+ DUI's, it just depends on the state
@J A umm
@J A Sherlock has cracked the code
@keereekee dude you should be so proud of yourself that's so amazing
@J A Exactly if you live an area without good public transportation, you can't swing a cat without hitting someone who's had a dui. America's love of alcohol and private transportation do not mix. This is why I can't wait until self-driving cars are a viable option so we can stop pouring untold amounts of grief and resources into dealing with DUIs.
WHY COULDN'T THESE PEOPLE CALL UBER OR LIFT OR EVEN A FRIEND
And lack of common sense
you would have to pick up your car the next day which can be highly inconvenient.
I don't think people like these even have decent friends. If they do, they're prolly the same in terms of idiocy. What a disgrace!
Kind of impossible when your blacked out pissed drunk, it’s like your body goes into auto drive and you have no control or memory
OmG I remember the day this happened! So sad to see this is still dragging on and the woman who hit the poor guy and made him lose his legs is the one acting like she’s the victim , good for the judge 👍🏻
@robert jackson o God ya ya ofcourse , I’m in Florida and it just went down to 40 degrees the other night and ofcourse just my luck my car breaks down ,in the middle of the night no less. I was stuck out their for 6 hours. I was gonna light myself on fire just to get warm .idk why I shared that but anyways good luck with the storm an have a nice day :)
I feel for her attorney though. She was trying so hard to shut her up.
Yep definitely obvious at time stamp of 1:13 where the attorney literally grabs her arm

She deserves no mercy. And because of her mental state, she will never admit to any wrongful behavior
My Father lost a leg in a car accident 40 years ago the man who hit him did not get jail time either. Courts don't care.
So sorry to hear that, it's completely unfair, loosing a leg affects every part of your life 😥

Why was she allowed to LEAVE ??? SHE'S DRUGGED UP ON COURT !!! WTF ???
I have bipolar depression and I don’t go around having selfish moods swings. Nor do I drink and drive. I don’t drink at all because alcohol is a downer and causes manic episodes. Bipolar depression or not you can control ur emotions, it’s hard but very possible
My neighbour has that condition and he drinks, I've seen what it can do to him!
it’s different for everyone, but i don’t think she even tried to get help other than the anxiety meds. everyone should be in therapy even if they have meds. meds are temporary.
Yes, that's exactly why I don't drink either. I have bipolar and I am very, very against DUI.
"this day was a disaster"
What about the guy that lost both of his legs?
Guess we just have different outlooks on what a disaster is.

your opinion means nothing to anyone
Both can be disasters, it’s just that one is so much worse than the other.
@@thechamp6923 and I'm sure nobody cares about your opinion either
I get that you’re trying to be snarky but this is kinda dumb. They were both disasters. One was a worse disaster. It’s like someone saying “my roof got torn off by a tornado. It was a disaster” and you reply “oh yeah? Well our tornado swallowed the entire city whole and killed everyone except me. Guess we have different definitions of disaster”.
And
I've been sober 20 years.
The judge did the right thing, this woman ruined another person's life, and then can't make it to court on time? Let her sit in jail and receive her treatments.
LOL. The son says " no comment" like he and his mom are celebrities. Somebody obviously doesn't know the difference between famous and notorious!
Not sure that was her "son". Looks more like her gay daughter. Just saying.
No comment just means no comment.. What else should he have said to somebody that was asking questions he didn't want to answer??
I was thinking "androgynous". Like the thing in the last "Terminator" movie.

No plea deals for DWI defendants. They chose to drink or do drugs and then drive. Now let them serve time for the crimes.
@Some One beautifully said!
@Some One drunk people and their enablers tend to make little sense.
@Some One if you listen carefully there was a passing remark that she was facing 4 years. I think that is what the plea deal was for.
@Truth Thank you for the truth, legend.

Shes late for court and she messed up again
When your own attorney openly describes you as being "a mess," you've got big problems.
That guy has a heart of gold. She didn’t deserve his compassion.
It's never about who deserves it, it's only about who's giving it.
I don't really care about his "compassion". A person like this needs to be off the streets as long as possible in order to protect other people. If you can't stay home drunk or come to court in a timely manner, you are the type of person who would take the keys of a car and drive drunk or drugged out again.
She just wasting everybody time in court even her own lawyer.
