►Description
Solicitor General Tushar Mehta was involved in a high-intensity argument in the Supreme Court today on the 12th day of hearings of petitions challenging the scrapping of Article 370 in Jammu and Kashmir, the restoration of statehood and the holding of an Assembly election.
Mr Mehta, arguing for the government, had informed the court an election could be conducted - a key demand of critics of the centre's J&K policy - at any time and that the decision was in the hands of central and state poll bodies. On a timeline for statehood, Mr Mehta, however, said the government is "unable to give an exact time period for conversion".
The Solicitor General, in his opening remarks for the day, also read out government data to highlight the improved law-and-order situation in J&K and noted there were "52 organised bands in 2018 and now it is nil".
The Chief Justice played the role of peacemaker in this debate, saying, "Constitutional issue will be dealt only with the constitutional angle and not on the basis of the policy decisions."

Eventhough state assembly was not their the representatives from the state are in the legislature assembly in the center as MP. Their concrance consultation and recommendation is for presidential order is assumed.
Consultation, concurrance & Recommendations are not binding on the President of India !!! There is absolutely NO doubt that the President is the Supreme Sovereign Authority !!!

Mr. Mehta is mainly referring the status of princely states which predominantly were under the provincial control of British rule with no independence of internal or external action to speak off. One surprises how a gorgious princely state like jk with all independent powers to conduct internal governance and full competence to conclude treaties and declare war against enemy states , is referred under same catagory of provisions /acts of national constitution. Framers of Indian constitution infact invented and incorporated article 370 to deal with the jk state's relations with union government within federal structure based on division of powers and as provided by accession document. Hence I suppose he is keeping cort before the horse and trying to wing the legal argument.
Sir,Govt side the explanation putforth by sh.Tushar Mehta SG and AG are worth appreciating .Hope,SC will deliver judgment in favour of Govt reg.Article 370,35A.
