Contract Rescission

Either by agreement or by seeking relief from a court of law- a contract may be rescinded if certain conditions are met. If rescinded the parties are put back to their position before the contract was entered so if things were exchanged they are returned. It's a right you can enforce but it can't be used to get you out of something you entered foolishly or when you simply change your mind.

What are the consumer rights to cancel terminate a noncancelable travel membership contract? Request for termination done 2 days after contract was signed in south carolina. Per SC law, not subject to any right of rescission. We got blindsided from the aggressive/persuasive sales presentation. Pls. Help . Thanks

Barriers to contract parties agreeing to rescind would be where one side does not agree that there was any mistake. Barriers to a court finding and ordering rescission could be a finding that there was not any misrepresentation or mistake made.
