So is a contract voidable if an estate agent doesn't correspond to a counter offer you made to the buyers and then they lost interest because the estate agents didn't get back to them, but later, you are made aware you lost a potential buyer because of obligations not met in the contract signed?
@@gtkid3289 Good question. I would recommend you spend some time studying up the practice of disclosures. That seems to be a popular topic on the state exam. I would also be drilling the mock state exams we have in our state exam prep package. Those will get you used to the types of questions you'll see on the exam.
That doesn't quite fit because the steak and eggs were not offered. They were given to me in the example without the offer to modify my order. If the server said something like, "We don't have ham and eggs, but we have steak and eggs" that would be an accurate representation of a modification to the contract. Offer of a modification to the contract requires that there be an offer from one party to modify the contract. If there was never an offer made from the server, then the steak and eggs are voidable. Luckily, I love steak and eggs. Especially with a hot cup of coffee! Hope that makes sense!
