    Hi...and thanks for the information. And what about current college students or the ones who have already graduated with 4 yrs college degree who did not qualified for DACA and are still undocumented?

      Thank you for your question, Augusto Arsenio! If the college student entered the U.S. while under the age of 18, it is possible they qualify under the American Dream and Promise Act. See my other video on that proposed law which has passed the House of Representatives, but still has to pass the Senate.

    Hi, I am currently in the US on J1 visa, working as a Post-Doctoral in Physics (STEM). Am I eligible for this law of Green Card? How long it would take to implement this law?

      Dear Manpreet Singh, this is just a proposal in Congress. Due to the process of debate and compromise, we do not know the requirements of the final bill, or even if it will pass. Stay tuned, we will see how the proposal develops. Thank you for your question.

    Hi Heidi, thank you so much.
    I am currently on F1 STEM OPT and work for a leading tech company. I am interested in pursuing a PhD and want to understand if it is possible to continue working part-time in any firm outside the university if I start a PhD. I know there are many companies who offer this but I’m not sure if that’s the case for international students too.

      Dear Akriti Marwaha, if you were to start your STEM PhD, the university's International Student Office would have to give you permission to work. It is not up to the company, it is up to the DSO (Designated School Official). You need to find out about the college or university's policy

      Dear Pooja Shukla, no it has not passed. However, we do have good news as the Biden administration has announced that it will be modifying the requirements for those with STEM degrees who are applying for the O-1 alien of extraordinary ability and the NIW (National Interest Waiver) to make it easier for STEM grads.

    HI... I will finish my Phd in Physics next year from a US university. I got my F1 visa in 2016, i would have to renew it soon .But, If this bill is passed, i can apply for a green card as well. Am i correct?

      Dear Ashish Ganghettiwar, the proposal would re-cature millions of unused visa numbers for the family preferences, and would also increase the total visa numbers each year for employment-based cases from 140,000 to 170,000 and change the per-country limits from 7 percent to 20 percent of the total, greatly benefiting Indians and Chinese who have been suffering very long backlogs in employment-based visa numbers.

      Dear Ashish Gangshettiwar, also foreign graduates with advanced STEM degrees would not be subject to the numerical limits. So if your employer does a PERM labor certification, once it is approved you can apply for the green card immediately.

      Dear Harris N369, no one really knows. The Democrats are talking about including immigration provisions in the upcoming budget bill, which would allow the provisions to be passed with a simple majority and avoid a Republican filibuster. But we do not know which immigration provisions will be included or the outcome.

      Dear Majid Ali, it is not clear from your question whether you are currently in the US or in Pakistan. The proposal is for those who completed the PhD from a US university. However, if you have a job offer from a company or organization here, you may be eligible for temporary status and the green card.       No, it is not. However, USCIS has announced that it will provide special consideration to applicants in the STEM fields for the NIW (National Interest Waiver) and O-1s.

    hi mam, may i ask whether there is a chance for the non STEM phd holders like applied linguistics to get HB1 visa and then permanent residence in USA?

      I had the same question. How would this work? And how long would the wait be for non STEM PhD holders like phd in clinical/counselling Psychology (for example) to get an H1B and PR in the United States (especially for Indian nationals)? Would love to know. Thanks a lot for this really informative video! Really appreciate it!

      @@dhritigraj Yes, whether you are STEM or not, you have the same chance of getting an H-1B visa number. Right now, in terms of the backlog in visa numbers for Indian nationals, it does not matter if you are STEM or not. There is pending legislation, the America Competes Act, which would exempt STEM PhDs from the limits on visa numbers for the employment preferences for the green card. The fact that all the STEM PhDs are exempt from the visa limits, means that the backlog would shorten for those with non-STEM degrees. However, this is just legislation which has not yet been signed into law.
