      Heroin isn't an enumerated right in the Bill of Rights. That being said, private heroin sales typically don't go through a background check.
      To be intellectualy consistent, I would also question the FDA's broad authority to regulate the private sales of raw milk.
      The real question is, should bureaus have the authority to selectivly amend a law to suit a political purpose. I understand that this rule change may align with your politics, but the ATF doesn't write law. The executive branch shouldn't have the power of reinterpretation for political whims. If the Biden government wants to limit private sales, then Congress needs to pass a law to do so.

      It all started back in the summer if 1993. i was on a field trip to Epcot center. People those days didn't much care for smart phones, because they hadn't been invented.

    there is no “ gun show loophole”. all licensed dealers at a gun show have always been required to run a background check. The “ loophole “ they are referring to is that in some states, like mine, a private individual is legally allowed to sell a firearm privately to another private citizen provided they meet certain requirements.
    At no time could you legally purchase a firearm online and have it sent directly to you unless you are licensed. an online sale goes like this, you buy the firearm. that seller must ship to your local ffl dealer where you must either pass a background check or present your valid concealed carry permit, depending on your state, after that you can take possession. now this applies to legal sales. none of this new rule will stop illegal sales, because it criminalizes what was already illegal.

      You are right about the "gun show loop hole".
      But this new rule is so much more. It actually criminalizes just about every private firearms sale between private citizens if the BATF chooses to see it that way....and it allows for this to occur in civil court where you are not innocent until proven guilty.

      About half the dealers in Indiana shows are individuals that are running there own private business. It's there private collection they are selling. wink wink.

      @@sabinoluevano7447 yes according to the rule in place at the time. Federal and state (nc) law allow it. I mean obviously if someone is buying guns just to resell for a living then that has always required an ffl but to sell your privately owned firearms has always been legal as long as you follow the rules which here in NC state that for a long gun you must make sure the buyer is of legal age and a resident of the state and reasonably believe that person is not a felon.no paperwork needed but advised to take a copy of their drivers license. for handgun it requires you to make sure of the above and that the buyer has a valid concealed carry permit or perchase permit (which was eliminated recently).

    This isn't a new law, it's a rule change. How that works is beyond me, as it seems redefining operative terms like "dealer" invalidates the purpose of a law's initial intent.
    When congress passes a law, who it effects shouldn't be up to presidential or departmental discretion.
    The Brady act defines dealers as such.
    "The term “dealer” means (A) any person engaged in the business of selling firearms at wholesale or retail, (B) any person engaged in the business of repairing firearms or of making or fitting special barrels, stocks, or trigger mechanisms to firearms, or (C) any person who is a pawnbroker. The term “licensed dealer” means any dealer who is licensed under the provisions of this chapter."
    Having a garage sale doesn't make you a momentary retailer. Changing the law by a "rule change" via Chevron deference gives broad authority to a bureau to expand the purview of any given law beyond it's tailored limitations laid out by Congress.
    The exemptions laid out in the Brady act were negotiated specifically so private citizens were not defined as dealers.
    The cavalier hubtis of appointed officals to readily ignore the law as written, and declare that the objective standard of the law is no obstacle in expansion of regulatory powers granted to themselves is beyond contempt.
    The whole reason a proposed bill is subjeted to such rigorous scrutiny and re-writes is to set a clear standard. If the law is subject to Capricious interpretation, then we lose faith in fairness of a government.

    I don't know what gun show loophole they're talking about because I've been to gun shows from Texas to Colorado toTennessee to California and Florida and everyone has required a background check.
    So I don't know what the hell loophole you're talking about, probably just making it up.

      The "gun show loop hole" is what allows a person to purchase a firearm at a gun show with zero background check needed.
      The only way to achieve that is buying the gun from a private seller at these gun shows.
      In some States such as mine, a person that does not make a living off selling guns can sell guns at gun shows.
      Democrats are trying to give more detailed lines on who would be considered a Private seller and not needing to run the background check and who would be required.

      How about the guns that are bought legally by US citizens and are being sold across the Mexican border to the cartels? For some reason all of you gun nuts never talk about that. Mexico only has one gun store and only allows a handful of gun permits a year. The cartels get their guns elsewhere including US citizens. How does the ATF know that, by tracing the serial numbers on the guns that are seized from the cartels. And a lot of these guns are traced back to US citizens who bought them legally. Why do guns nuts always try to hide behind the 2nd amendment? So where does it say in the 2nd amendment that gun owners have the right to shoot and kill innocent people in public? So much for your point.

      In some States a private dealer is allowed to sell guns a gun shows.
      That is what the Democrats are trying to define.
      Who is considered a private gun seller and who is a dealer requiring a background check.
