Well almost 10% of people who respond to online ads from unlicensed sellers would fail a background check. That's the point of this. Not the gun show sellers, but people who aren't officially sellers there that skirt the system and still make profits from selling guns. What is the big deal about making sure gun buyers get background checked? I just bought my 4th firearm in 4 months and I have zero problem when the gun shop runs me through NICS. That's the system doing its job.
ATF is already violating federal law by creating a registry from 4473 forms. They are prohibited by Congressional legislation from doing that, but they do it anyway. This new rule is simply another example of the Executive Branch usurping power it does not have. The change in the statute that occurred in 2022 did not grant this kind of authority to rule by Executive Decree. It pisses them off that they don't know who purchases or owns every gun in the country. The crazy thing is that ATF is now insisting that anyone who sells a single firearm must first obtain an FFL, while at the same time ATF is actively putting FFLs out of business over paperwork errors. Once this rule goes into effect (before it gets thrown out in the federal courts) the best solution is to have EVERY gun owner send in an application for an FFL. Imagine, ATF being flooded with tens of millions of FFL applications. They will not be able to handle the volume, which brings to mind the old saying, "Be careful what you ask for."

The best part is how they didn't even tell you everything the new law states. If a private citizen sells their personally owned firearm for more than they paid for it. They're now considered a "firearms dealer" and will be charged with a felony for selling firearms without a license. Don't forget the $250,000 fine.
That's not how it works. Making a profit is not illegal. What's a problem is pretending that you're just selling from a personal collection when it is in fact a sales inventory. Selling a personal firearm is not a problem, or selling several. The problem begins when you start repurchasing the same models and selling them over and over sending them onto buyers almost as soon as you receive them.

I've read through some of this new rule and it is very confusing. Some of it makes it seem like you could go to jail just for selling one gun without paperwork. Another section makes it seem like it is ok only if you do it occasionally. Which is it and what is their definition of "occasionally" ? The federal government probably wants this new rule to be vague and confusing so people are afraid of even attempting private sales and it allows them to enforce the rule anyway they see fit.

Private sellers can only sell specific weapons (bolt actions, single shot, shotguns, muzzle loaders) without the need for an ffl\background check; however, they still require a valid ID to verify they're of age. ATF agents are also posted at every gun show to verify purchases and check bags at the doors.

The vast majority doesn't even know about this new rule and many never will. Also there are many ways to solve a murder. With this new rule, how are they possibly going to know what you sold to who and for how much? Even if there were a registration (which I'm sure they will try as well), there is no possible way for them to know unless you tell them or keep it documented. MAYBE if you have a vengeful ex-girlfriend or wife or knows about such a transaction? But hearsay is not admissible in court.

A private seller should be allowed to sell a firearm as long as the seller is not engaged in the business of dealing in firearms. What is happening is all about grabbing control. The "gun show loophole" means that a person who isn't legally able to purchase a firearm can go to a gun show and buy one anyway because there's no background check required

Private sellers can only sell specific weapons (bolt actions, single shot, shotguns, muzzle loaders) without the need for an ffl\background check; however, they still require a valid ID to verify they're of age. ATF agents are also posted at every gun show to verify purchases and check bags at the doors.
