    I canceled Disney plus, Hulu, and ESPN plus after hearing this. I also cancelled an October trip of 4 nights at the Contemporary. This is a dirty lawyer type of trick. Let them lose customers if this is how they conduct business.

      Nah, he will be suing for millions.
      50k is just the threshold used to determine which court hears the case.
      So, they need to declare up front whether they are seeking more or less than 50k.
      If this DOES go to trial, I suspect they will be forced to pay in the hundreds of millions as punitive damages given how repugnant the average juror will find this.

      @@brutishfossil5022my understanding is that the discovery of the fine print when you sign up for Disney+ is the core issue, not the accident itself. Apparently, the fine print prevents you from suing Disney and since they signed up for it several years ago it still holds today because it’s a life long contract (as my understanding goes).

      It's a restaurant called "Ragland Road" at Disney Springs, a shopping area with tons of third party retail and restaurant locations. The employees of these third-party vendors do not work for Disney. To be clear, I am not defending what Disney is pulling.

      That is not the issue. It is where the issue can be fought. A jury trial is more likely to side with the plaintiffs and gain more money than an Arbitrator. Also it cannot be appealed.

Then you can bet this bs 1 month trial from years ago won't stand up in court as a reason to arbitrate because he agreed to the TOS of said free trial that he canceled when the free trial was over. These companies think they can basically say if you take this free trial we own you and there's nothing you can do period. I'd personally love to be there when the judge sees this in their court.

      But I assure you that it's illegal in many states and in many countries. Binding arbitration is generally used when both parties of the contract are formally and materially equal (i.e. two big corporations, or two salesmen with more or less the same resources). But not when one party is disproportionately stronger than the other one.

    Talk about a load of miss information. The end of a trail period is also the end of the terms of service contract. It’s not binding unless you decide to make a permanent agreement for services.

    This brings attention not only to Disney but all corporations that use binding arbitration and automatic terms and conditions upon the signing up or purchase of a product. What’s the point of signing a contract if you can sneak it in instead? Why can’t the average consumer do the same to companies with terms and conditions: “by accepting payment from me, John Doe, your company agrees to the following terms and conditions…” That would be wild, right? But that’s what companies do to consumers. Why does it seem like companies have more rights than consumers?

    So if I have Disney+ and for example, broke my leg because they were negligent with a ride in Disney land or they were dumping wastes in my backyard, I can't sue them because i have a subscription to their streaming service?     But this whole news story is framing this situation incredibly out of context. The lawsuit is against the restaurant itself. Makes sense. Then they tried to include Disney since the restaurant was operating on Disney property. So, in other words, the restaurant wasnt directly owned by Disney.

    The death didn't happen at Disney World; it happened at Disney Springs. Two totally different things considering the restaurant wasn't owned or operated by Disney. People get up in arms about large corporations putting these fine print things in their terms and conditions (and I hate it as much as the next guy) but this is why they do it. Lets be honest with ourselves here; frivolous litigation has gotten out of hand in this country and it costs corporations billions of dollars in settlements every year which just ultimately gets passed on to the consumer. And yes this lawsuit is frivolous in the sense that they are suing Disney because they have a large pocket book rather than the restaurant owner and operator. This family should absolutely be seeking damages for their lost loved one due to the negligence on the part of the restaurant, but sue the right people.

      Disney Spring is apart of Disneyworld. I park in the Orange garage. Deep pockets theory will always be the strategy in civil litigation. The sole reason people go to dine at the properties is because of the association with Disney. Even the McDonalds on the property is one of a kind power by solar energy.

      Absolutely right. Most people skip over the fact that the family is actually suing the restaurant. Not disney. However the likelihood is that their attorney will go for the deeper pockets, which is disney. If the attorney names disney on the lawsuit and it goes to arbitration, then that's where the disney plus will come into place. It's bad press but at the end of the day, why should disney pay when the restaurant was negligent. That's why they have their own insurance

    I understand the anger and frustration of the family. I fully support holding the restaurant responsible. However I disagree with suing Disney. As they don’t own or operate the restaurant. If the restaurant employees made the mistake are they being sued. If not why not?

      Nothing in there was life threatening. It says they can still go after them hard, but in arbitration instead of a courtroom. They go before a judge/attorney either way. The only loss is that a jury isn't involved.
