    Or the homeowner can lock himself in the house, refuse to vacate, and tell the HOA "Come and get it! Smith, Wesson, and me are looking forward to it!"

    Thank you for protecting homeowners. Homeowner Associations can foreclose on homes for pennies on the dollar without the homeowner knowing, even if the homeowner is wealthy. The owner may not learn about the foreclosure until the home is sold. This violates the 5th Amendment, due process of the law. No one door knocks. No one tapes notices to tenants doors. And the notices look like junk mail. You should see the notices yourself. No return calls from the HOAs. No response when sending checks to the HOA’s. There are many requirements written in NRS116 but there are loopholes in the law. Many companies are predatory. Lobby groups support these laws and they are funded by large investors.

Please join the benevolent Senator Spearman, Representative Thomas, D'Silva, Brown-May, Gray, and O'Neill in supporting the new Nevada bill S.B. 175. This bill requires homeowner associations to abide by strict guidelines and foreclosure requirements, especially when foreclosing on seniors, veterans, and the disabled.

    my dues are not behind, they claim fines make late paymetsf or unpaid dues. all bank records. fines are not unpaid dues.

    What if the buyer was never told during closing there was an HOA and even in the closing papers under “ is there a HOA” it’s marked NO but the buyer after moving in is getting mail from the HOA reporting late payments? Is the buyer responsible to pay these fees and if they don’t do they have a case since the closing papers said there wasn’t one?

    The original HOA changed and the new one sent a foreclosure notice . Isn’t once the original hoa closed and we didn’t resign to the money pit . How’re we liable with no authority of signatures

      Because when you sign and agree to the HOA, you agree the board has the ultimate authority. So pay your HOA, or move out is your best bet.

    What if you were referred to collections for 2 missed assessments and the collections agency is charged 125% of the amount due for fees and $90 per payment and $500 to setup a payment plan?

      You need to read your CC&Rs & Corporation By-laws. Those, along with State Statutes on Condominium/Homeowners Associations dictate exactly what the HOA and their attorneys can do, and cannot do. Your "Rights" go away when you buy into an HOA, and Their Rules are the Rules of the Day!

    The best way to avoid a foreclosure is to pay your fees/dues/bills.
