One thing you missed about Monsanto suing was they went after small farmers that had always held back their own seeds to plant the next year-never purchased a Monsanto seed. It was found their held back seed contained genetic material under patent because the sm farmers crops had been pollinated by neighboring crops. What this means to farmers now is everyone is required to purchase seed or be sued. Patients are a good thing that sometimes does not end well.
Yeah, they sued a farmer who had proof that he didn't buy their variety, but because his neighbor did and you can't just put up a giant dome to stop pollination his beans had the genetic material of the round up ready variety and by him saving those seeds he broke patent laws...that pissed me off so much when I researched it...the Audacity of it like how TF can you control pollinators?

I think it’s great if an individual/company patent their hybrid so that other rival companies don’t take profits by mass producing of your years of selective breeding hard work. But general people should be an exception for making propagation after buying.
I have a plant friend in the US who has found a Thai Constellation Compacta in a nursery by chance (and probably with some careful observation), it was sold as a regular Thai Con but he told me that it grows very slowly and stays small despite growing in the same conditions as his other Thai Constellation.
I'm so after this plant! Now that I just got the regular Monstera deliciosa 'Compacta' from Japan, I need this one too! Didn't know it went by the name Hola Hola, that might help me find one online...
Interesting topic that you picked considering I am currently looking into patenting something that I am working on. Who I would legally go after would be large commercial growers like costa farms, not the person on Etsy side hussling a few. Taking legal action against anybody that doesn’t have a commercial growing(nursery) license, is essentially just going after your own customer base.
If you do not sue EVERYONE in violation, including the little guy, lawyers for the big guys will show “targeted enforcement” and you will likely lose the lawsuit. “Commercial growers” are anyone with a nursery license, including at home sellers.
Sad reality, but it’s why we have 0 patents for Rio or any other original hybrid/cultivar at Gabriella Plants.
@@shanemaloy It's also why Disney and other large IP holders have to go after small crafters, whether it's on Etsy or selling at craft markets.
It's sad but necessary legal requirement.
There's no letting it go, for the harmless little guy, in IP law. You have to defend every single instance or you face the possibility of losing in court to a blatant large scale blackmarket IP thief.

Some patents are a scam, but most of the time it's the only was to get your reward after years or even decades of work, wether it's gmo, hybridization, selection, exploration etc. The compagny will never go after commoners propagating or even selling their patented houseplants, but after other compagnies propagating the result of their work on an industrial level.

So how can a plant seller know of plants they got are patented and therefore legal to sell propagations from? All the plants I got on Etsy don’t have official tags and there is nothing about patent #. The patent office website is almost impossible to find a plant on and Google searches are not bringing up anything for me either. Are there people out there checking etsy sellers as to whether they are selling patented plants or not?

Search “NYSE’s new investment vehicle-‘natural asset companies’-will tap into ESG fever”, “Bill and Melinda Gates’ Empire of Dirt” and “Barcoding Nature: The Largest Global Land Grab in Human History”. This is pretty much another topic though because it's so incredibly deep and awful.

A question for the comments. How do we provide incentive to people/companies to do the research that results in these seeds with higher yields (and us with food security)? No company is going to go out there and spend millions on research if they don’t get that money back. With climate change and less arable land to grow on we have to find the best ways possible to grow food. Who will provide that service for free? People won’t want to pay taxes for the government to do it (inefficiently). I don’t know the answer, but we all eat food grown from Monsanto seed. Canola. Grain. So what’s the alternative? Spending twice as much for food to stick it to Bayer? Science is expensive, ideally we get help from a philanthropist billionaire 😂.
