      He did everything that he could to avoid giving up his DNA. They obtained the DNA at his place of work. Was this bakery a public place, like a store front? If so, then it is public domain.

      @@angelabrolund1373 yeah exactly the woman didn’t break into his house or his personal vehicle to steal his DNA he threw away trash at work. The police should have taken another sample after he was arrested to double confirm because the boss is kind of a bias witness but the collected evidence did proof he committed the crime.

    Once something is put in the trash there's no expectation of privacy at that point so I think that his boss coming and picking it up and giving it to the police was just fine.

    I think the dna retrieval method was perfectly fine. The woman was explicitly clear in saying that the officers weren't asking for her help, she was volunteering it. Plus, he had no reasonable right to privacy at his work, it was a public bakery with numerous employees and customers present all the time. It's no different than police getting a cup off a table after a suspect dines at a restaurant. Props to her for helping out! And thanks to the judge for making the right call and keeping the dna evidence in!

    DNA is DNA. If you don't want to get caught then dont do the crime. Your right to privacy goes out the door the very second that crime is committed. This guy obviously had something to hide and his secret caught up to him. As individuals we have the right to live our life with out the fear of another harming or killing us. Criminals be out there doing the most so yeah I don't have a problem with the way his DNA was collected. Thank you for going so in depth with this case. Wishing Mandy's loved ones peace and comfort.

    I believe that as long as a crime wasn’t being committed WHILE obtaining the DNA (ie. breaking and entering into his home or vehicle to obtain it), the DNA should be admissible in any court.
    BTW…that was an AMAZING 2-part series! You had me a little bummed when I realized at the end of part one that it wasn’t going to be the end of the story. BUT there was no way that I could sleep not knowing the ending so I OBVIOUSLY came back! Great job Girl !!!!!!!😊

    I think any DNA collected should be viable, regardless of how it’s collected. If you aren’t guilty it wouldn’t be a problem.

    I love Kim, she did what I hope any good human being would do. I feel so bad for her, why would people even get mad at her? She helped put the person responsible behind bars!

    I think the police should be able to get dna this way. All the rights of victims have been taken away with their murder!

    I think the way they got the DNA was just fine, you did a wonderful job as always remembering Mandy and Tim was obviously a violent, angry person and truly deserves to rot in prison.

    I think difference between true crime peeps like him and us is that we research and realize you pretty much always get caught so don’t do it, he watches it and says yes yes I did it right

    The DNA thing, it’s the same as the Bryan Kohberger case. Trash is public property 🤷🏼‍♀️ Don’t do the crime if you can’t do the time! Waited for this part 2 for what feels like forever!! Thanks Britt!! Happy 4th!!

    Legally, when you decide to throw something away, you no longer claim ownership of it and it's free game, especially for police. Kim deserves a medal for her persistence and diligence and those officers better send her flowers on her birthday every year for VOLUNTARILY, out of the goodness of her heart and love for her community, doing the legwork for them to get this jerk caught and brought to justice.
    If Kim had taken the cup or can from his desk or his vehicle, that would be a different story. But she waited until he relinquished ownership of it to the trash bin so she could get it legally. Bravo, Kim 👏

    I think she was incredible brave, getting his DNA like that, and I´m very glad that she did. She brought closure to a whole family. RIP Mandy. Happy week favorite Brittney and Fellow Brat-packers, stay safe.

    I think they should be able to collect it anyway they have to do it either you did it or you didn't. And I don't think that very often they are setting people up

    I'm so glad this case was finally solved for the family. I think it's just fine the way that the DNA was obtained here, once you throw something away I feel like you have no expectation of privacy over that item after that, that might not be the exact proper way of saying that but I can't think of another way to put it.

    I love this case! I relate to the manager and the moms at the pool…small town took him down. Also I like like your hair you changed it up the really dark makes your skin look really healthy ❤

    Okay the DNA would be inadmissible IF Kim wasn’t the manager. As the boss she can make the call to allow the police in without a warrant anyway. Technically it’s the owner of the property but I’d go with it. If she had just been a lay employee then sure not in. Go Kim, take down the disgusting man

    Invasion of privacy claim: fair. Claiming they were sexually active: fair. But that's just the paralegal side of me, and you I'm sure. Lord, the thought of that judge going the other way and acknowledging even one of those claims resulting in this monster going free is just SO scary. TOOOOO close for comfort imo.
    *I know you've got a long list but I always mention David Elmquist cuz Sherrilyn Dale (I THINK Gavin did, not sure off the top of my head) is the only one that has told his story and the family needs help so bad, just getting the word out so they can get an investigation for their sons murder. ox

    This case is so similar to Rachel Cooke, who went missing in Georgetown, Texas while on her winter break in 2002. Very interesting case, lots of suspects, but still unsolved.

    No problem here with how DNA collected - it was in the garbage which is a public area and no longer his property. The fact that a private citizen retrieved it means nothing frankly. If he wanted to protect it then he should have kept it. It wasn’t stolen from him, he was not tricked into giving it up, it was trash on company property and she was an employee so no trespass issues.
    On a lighter not, Dossier is a great perfume - scent lasts a long time. Black Orchid by Tom Ford so expensive, but is my signature fragrance - I am less trench coat and stiletto and more grannies in tennis shoes lol but it does make one feel a bit more sexy, even at66!

    Getting the DNA in that fashion was great...you catch a monster any way u can..im soo happy for her family that her killer got caught..
    Also ive noticed from listening to all these stories that alot of these killers are cut from the same cloth..its freaking scary..especially as a dad to a 13 year old girl...

    I see people grabbing garbage once it's put in the trash all the time. As far as I know once something is in the trash it Is free for anyone to take. So, I'm not sure what legal grounds he would have to stand on?

    The DNA question is hard. Our rights to privacy are essential. I think there have to be laws in place that mandate that while DNA can be collected in pursuit of a serious crime, it can’t be shared beyond that in any way. But with people getting genetic testing through a variety of companies, it’s becoming a moot point. Familial DNA can peg a killer too.

    You should have no expectation to privacy of your trash once out of your own hands and off your property. Obviously this was used to get a search warrant to get his DNA for more controlled and indisputable results.

    Well it was trash. After you discard something in the garbage it becomes public property. Supreme Court had already ruled on that. I'm a trash man. Cops had me save trash 2 times. Once on a suspected pedophile and once on a drug dealer. What I found surprising was his wife. She was kinda hot...he was just an old bald fat guy.

    My thoughts on the debates around domestic abuse victims in situations like this specifically should be to examine the reasons why they "support" their abusers. I think more research and focus should be from this angle. Because it's a running theme.
    I think I understand, from my own personal experience (albeit anecdotal) combined with the true crime content I watch, the victims of domestic abuse often end up dead, even after they leave. That's one extreme end of the spectrum. The other points on the spectrum include those women who
    *don't end up dead and do leave/get out, *those who don't end up dead but stay and end up warped, codependent etc, and *those who end up willing participants in the abuse towards others (in varying degrees).
    The psychology behind all this fascinates me.

    I agree with most everyone in the comments. Once trash is thrown away, it’s anyone’s game. The DNA was good. I do wonder why the cops didn’t just get the warrant to force him to provide the dna. That was odd to me.

    it sounds to me that the DNA was offered by the young lady that gave it. She figured out why they were looking into that guy and what they were trying to do. It should be a legal offering

    So it is definitely a gray area about the DNA BUT I will say anything discarded outside the home is like public property now right? What's the difference if he wouldve thrown it away on the side of the road? Just because it was at his job doesnt entitle him to more privacy. I guess I kind of see it as get that dna at all costs. If you have nothing to hide why be so weird about it?

    I think how they got the DNA is perfectly fine. They can get it from the trash, they can get it from food or utensils you leave in a restaurant, Cigarettes, so someone getting it for them shouldn't matter. As long as they can prove it's his which they can by getting a warrant to prove that it is his.
