Visa EB-3 is designed for skilled and unskilled employees. That means that almost everybody can qualify for this kind of visa. As long as you have a high school diploma you are able to qualify as an unskilled worker.
The biggest disadvantage of this visa is the time that is needed for you to get the stamp in the passport. EB3 visa process takes up to two and a half years.
EB-3 visa criteria:
Visa EB3 has requirements both for the employee and for the employer. I suggest starting the discussion from the employer’s criteria. Firstly, the employer has to prove the business need and why does the company want to hire you.

If you filed concurrently with 485, then there is no need for that. If you filed I-140 with the request through the embassy, then it is yes.

What I am saying is that if you filed at the same time as 485, then it is not necessary.
But if you filed I-140 with the request through the embassy, then yes, you have to go to Trinidad for an interview.

USCIS says “ Skilled workers” are persons whose jobs require a minimum of 2 years training or experience”.

@@shamayevlaw hmm it sucks to be an EW applicant here in the Philippines. We do not stand a chance in visa allocation because nurses are priority here. They would rather spend their time interviewing nurses and give the visa allocation to them than giving us a visa interview date.

The first 3 stages of the EB-3 visa cannot be accelerated in any way. The process will take about a year or even more.
It is only the I-140 petition review stage for the EB-3 visa that can be expedited.

Does the other candidate actually have to accept a job offer, or is the foreign candidate's EB-3 PERM-application already discarded when the minimum requirements for the job are met in the other applying candidate?
