No one wins in this case. It's sad. Being a military brat, then navy wife, I've seen to much of this. The judge was wrong though, the military (his command, unit, etc) can and will intervene depending the situation. There is truth in each of their stories. But the fact remains that the wife is the closest next of kin. They werent married even a year, so I'm sure this discussion never came up, on the other hand, the moment you sign your life away to the military you have to fill out next of kin, and have you make a will. Most do talk about what their will says and what they want. We spoke about it very soon after he joined as well as when we got married. We also bring the subject up if we feel our minds have changed. I would like to go to the body farm in Memphis TN when I go, and my husband wants to be cremated and toss half in the ocean and the other half stay with me so he can... in his words "keep half so I can keep an eye on you, I'll haunt you in a good way, " lol. Anyways, mom over stepped her boundaries bc of her grief. And the wife, well, girl you cant do these things to a mother. I hope your next mother/father in law will be treated with more respect.
The Army took Perfect Care of me and my Fiance's remains when he gave his all! They offered to fly me to Germany where his body had been taken. I chose to let his Air Crew escort him home to the USA. The Army flew me to Dover to meet his body on arrival. We chose to bury him at Arlington National, but had been offered by the Army to fly him "Angel Flight" back to his home State of Texas. During his Final trip home, Chris was never alone, There was ALWAYS a member of the Army with Chris' body. The US Army takes care of their Fallen!

The military always supplies a beautiful headstone for fallen soldiers. My dad served in WW2 and lived a great life after the war. The military supplied a fabulous headstone.
Sadly enough it's the truth, war is a bitch, no parent should ever bury her kid, it's the worst thing that can happen. It happen very close to me almost 30 years ago, still can't talk about it and there's no day it's not going to my mind like it was yesterday, every single detail like watching a movie. I don't know why I watch this, it's like my heart is tearing in peaces. No one can judge here not informed and knowing every detail. I cant imagine this is real becourse most people a not able to talk about the death from your child.

There is a lot more to this store as it pertains to the relationship between the widow and her inlaws. they are not as nice and upstanding as they seemed. just take the comments that the father-in-law made to the widow. There's a common situation where you think you know a person after dating them, then you get married and find out what kind of a person they really are. The fact that he stayed married to her until he was killed is commendable, as it shows that he cared about her. I don't think the wife is all bad (most people are a mixture of bad and good), but what she did to her husband's burial place was despicable and truly evil. Judge JP was right in telling her off. And the woman's excuse for why she didn't put a marker on her husband's grave is lame. You don't need a Scripture on the grave, even if it was a favorite, it is better to just put a headstone on the grave than to let the grave be unmarked for something trivial. The man deserves a marked grave, and he wasn't getting even that. This is one of those cases where you have to shake your head and disbelief that something like this could ever happen. I have nothing but sympathy for that poor young man's parents. I send my condolences to the widow also, even though this trial has put her in a place where it is very hard for anyone to feel sympathy for her, because her act was infamous and disgusting.
Wrong... when there is a disagreement of remains the military does in fact take jurisdiction. However, the spouse does have the final decisions unless there is a POA beforehand.

I am a military wife and when a soldier dies the military is there whether you like it or not, they pay for the funeral and if you do have to pay out of pocket, they reimburse you. there is no reason he shouldn't have a headstone. that's an awful wife and a disgrace of a woman.

The judge said it right. The widow was trying to say that the military took over and said they would handle notifications, but the judge said the military doesn't automatically do that. The spouse has to ask for them to do that. The judge had it right.

This was very hard to watch. I'm a vet who took place in the initial invasion and was in Iraq for a year. I was disabled from an IED that also caused a fellow soldier to lose his leg. Many soldiers get married before they go to war because not only do they get paid more, but the wife will receive benefits. While she may have just been avoiding things because she didn't want to reminded of the event, it appears more likely that she did not have the love for him that he deserved, especially posthumously. Regardless of either lack of love or strength, she was most certainly in the wrong. We have to do things we don't want to do in times of adversity. This soldier deserved better.
As harsh as situations like this are, it's informative television.. you learn something. If you're a soldier you might want to make sure your burial arrangements are written in stone & provided to you wife for certain. Everyone deserves to be buried where they want to, especially those who make the greatest sacrifice.
before I deployed the 1st time I went to a lawyer and set everything I wanted in writing along with my will. luckily I didn't have to use it but I had friends who didn't and the whores they married before leaving did everything that blond piece of garbage did and worse. I did everything I could to help the families but it is what it is.

No, I've read about this couple. They did care for each other. It was that she didn't get along with the in-laws and couldn't put aside differences once Brandon died. I don't think she was happy he was killed and did love him and didn't marry him for money. If he was still alive, they would still be married and maybe have kids.

I lost my brother to an IED over in Iraq in 2003. I'm so fortunate that he came home in one piece, although it was a closed casket. As a veteran and from a family of veterans, this is absolutely disgusting.
This was really hard to watch, I started to cry. My dad and mom are both veterans. My sister is a combat medic, my older brother just started serving. So to see a man who died protecting this country mistreated like this, it just makes me mad.
Where she was, how they found out how he died, his age all these things have nothing to do with the case. Once you’re married that person is your immediate family and rest of your family is extended. Your spouse should have full authority & say about a burial.
Dal V but I believe in this particular circumstance the spouse should have let the family bury him in Nebraska. The daughter in law and son of the plaintiffs did not have children and were only married a short time. She would have gone on with her life and remarried and most likely had her own family. The son should've been buried where his parents and relatives could visit his grave. It is obvious that the spouse did not care by how she neglected to maintain the gravesite, not even putting a headstone on it, therefore just wanted him buried in California out of spite. In the long run, she would probably not care anymore and not visit his grave at all. She would just go about living her life using his death benefits, while his parents would not get to visit his gravesite since it is so far away.
This “judge” behaves unprofessionally. It is irritating how she constantly interrupts the widow and incorrectly and aggressively re-states bits of what is said. This wasn’t arbitration it was bullying for tv. Shame on that judge.
As his lawfully wedded wife, she gets death benefits, legal possession of the body (or what remains) and can bury him wherever she wants. Grave stones, while pretty, only serve the same purpose as a grave marker. Some people wait a while before getting a grave stone. Yes, the mother wants the son moved, but the wife has to agree. If she doesn't want to, then they have to let it go. As far as the mother getting charged for stuff, there's not enough info provided to get the whole story. So the reasoning is questionable.
While there is no excuse for not getting the headstone, there is WAY more to this story that isnt being told. The parents wanted him buried in Nebraska, and probably raised holy hell when the wife refused. And probably were miserable to her from day one. Been there, in laws can be your worst nightmare. She should have done the headstone, no doubt about it, but dont think she is the only one at fault here.

The so called judge is a disgrace. The mother said she didn't ask for specifics of the additional parts, but the judge kept pushing for the information. How cruel. And when you ask a question allow the person to finish.
The young widow trusted the military and funeral home to do the right thing, she was in over her head to arrange burial so young and with the loss of her husband. I think the in laws are reacting to their loss by attacking her. I hope the widow never has to deal with that family again after this.

It maybe, but that doesn't give an excuse for the widow to be willing to transfer ownership of her husband's grave site to his parents for 15k! I mean ok, parents don't always agree with their kid's partner, they can hate each other's guts while the couple strive forward in life! But in this case the husband/son was dead, they had some misunderstandings, ok! But the questions start to rise against the wife when/why she agrees to transfer the ownership of the grave site by selling it!?? Why? That was her mistake! True. This is jungle justice. Everytime the widow tries to explain herself, the Judge shuts her up. I'm glad our country follows fair procedure where the Judge is to stay impartial, not to interfere in the proceedings just merely listening to all parties and then to make an informed decision.

RE HEADSTONE: My father, who served in WWII and Korea, passed away in 1999. I handled his affairs after his death. He was entitled to a military headstone, which I ordered from the VA. After many calls, it finally came 9 months later. Unfortunately, my father's middle name (which is unusual) was misspelled. My mother requested that the VA fix it. So I sent it back. We finally got the headstone on my father's grave about 1.5 years after death.RE GRAVESITE: Prior to any family deaths, my mother had purchased 4 grave "spaces". Three of them were allocated to my brother, father and mother. In checking with my other siblings, they had already made other arrangements, or didn't want to be buried there. So with power of attorney I sold the remaining plot.

I have 2 sons who are both actively serving. Both are married. BOTH had to make wills before being deployed. BOTH had to assign someone to take care of their funerals. Being Jewish, we don't place a headstone until a year after the funeral. There doesn't seem to be any winners in this case. The Judge was rude and extremely rude to to the Widow. She clearly lack knowage in how the military deals with funerals and burials.
That is the same in New Zealand Maori customs aswell a year after for the headstone to go down really for the ground to harden up after its settled down. I don't think the judge was rude, she was angry at the wife for taking his payout saying openly that she paid for his funeral when infact that was covered by her husband's payout not her personally. Then had the audacity to ask her husband's mother to pay for his plot is even more pathetic especially when shes still left him in an unmarked burial plot because she can't get her shit together
It's true in this case unfortunately. That woman is a disgusting human being for how little care she had for her husband after his death and not taking care of the grave site. I felt that the Judge didn’t hear the whole story. She got angry and didn’t ask more questions. The spouse was young and possibly didn’t know how to act properly. She’d already made up her mind. Do I think the wife handled it the way she should have? No. I don’t. But it was wrong the way the judge kept attacking and interrupting her, but not once did she do that to the mother. Shows bias, and that’s unprofessional. She failed in her impartiality.

Zoey Rampage what you need to understand is that the Army get to decide what happens after the death. Lemme let you know what it is like in the Army. We have a form called a DD93. This is called the Record of Emergency Data. This list all beneficiaries for death benefits. It also contains a section for DOR, which stand for Deposition of Remains. This section is filled out by the soldier and it decides who has control over the body after it is processed by Dover AFB. There is also a form called the SGLV that list life insurance beneficiaries. I can guarantee the mother was not listed on any of these forms or she would of had control of everything. Every part of these forms are dictated by what the SOLDIER wants only. The wife should of had complete and legal control of the After death process. The mother had no right to ask for the remains to be removed. This judge over stepped her bounds and if I was the wife I would go the the state AG or Washington Military District IG.

As hard as it is to hear for the parents, the wife is the person who has rights to remains. Unfortunately the military deals with this regularly, they handle this stuff because they know the pain that goes with burying a son or daughter.
I knew there was going to be something bad about the wife when the judge asked her "...How long after that does the body come home...?" Rather than say "he came home", the wife actually referred to the deceased by saying "...it arrived February the 9th...". In my opinion the right response from some one who really loved him would have been "He arrived home on on February the 9th". I know the difference between "it" and "he" is subtle, but to me it seems as she regarded him as you would luggage or a parcel, not as the remains of loved one who had died tragically.

I completely agree. When she claimed that his parents are getting money too. Well, honey, their money isn't decreasing your amount of money. They are entitled to money as surviving parents, and that has NOTHING to do with a surviving spouse's money. When she was complaining about having to pay for the funeral, yes, you are required to pay up front and then sent paperwork on how to be reimbursed. She also admitted, the military paid $6.500 towards his funeral. They also would have paid for his headstone if she had gotten one. I hope his parents were able to submit the claim to get him a proper headstone paid by the military. The widowed wife seemed very spiteful!

The mother is the first one that brought up the fact that there were additional remains found, she's the first one to mention that she had ownership of the second set of remains and that the wife had ownership of the grave. I'm sorry but I think this is a case of a mother who didn't want to let the wife have the control that she should have as a wife. If it was all about money, it would have been easier and less obvious for her to keep contact with the soldier’s family. As a Casulaty Affairs Officer it is the decision of the widow. Parents have absolutely no decision. The widow has a Casualty Officer assigned. All decisons are on the widow. Now the widow does recieve Surviors Benefits and this includes since he was active duty military she gets everything. The headstone is part of the administrative process that the widow is responsible. The parents again have sadly no rights.

He’d want his kids and his wife to have a place to come to remember and love him.

No one wins in this case. It's sad. Being a military brat, then navy wife, I've seen to much of this.
The judge was wrong though, the military (his command, unit, etc) can and will intervene depending the situation. There is truth in each of their stories. But the fact remains that the wife is the closest next of kin. They werent married even a year, so I'm sure this discussion never came up, on the other hand, the moment you sign your life away to the military you have to fill out next of kin, and have you make a will.
Most do talk about what their will says and what they want. We spoke about it very soon after he joined as well as when we got married. We also bring the subject up if we feel our minds have changed. I would like to go to the body farm in Memphis TN when I go, and my husband wants to be cremated and toss half in the ocean and the other half stay with me so he can... in his words "keep half so I can keep an eye on you, I'll haunt you in a good way, " lol.

The Army took Perfect Care of me and my Fiance's remains when he gave his all! They offered to fly me to Germany where his body had been taken. I chose to let his Air Crew escort him home to the USA. The Army flew me to Dover to meet his body on arrival. We chose to bury him at Arlington National, but had been offered by the Army to fly him "Angel Flight" back to his home State of Texas. During his Final trip home, Chris was never alone, There was ALWAYS a member of the Army with Chris' body. The US Army takes care of their Fallen!

There's a common situation where you think you know a person after dating them, then you get married and find out what kind of a person they really are. The fact that he stayed married to her until he was killed is commendable, as it shows that he cared about her. I don't think the wife is all bad (most people are a mixture of bad and good), but what she did to her husband's burial place was despicable and truly evil. Judge JP was right in telling her off. And the woman's excuse for why she didn't put a marker on her husband's grave is lame. You don't need a Scripture on the grave, even if it was a favorite, it is better to just put a headstone on the grave than to let the grave be unmarked for something trivial. The man deserves a marked grave, and he wasn't getting even that. This is one of those cases where you have to shake your head and disbelief that something like this could ever happen. I have nothing but sympathy for that poor young man's parents. I send my condolences to the widow also, even though this trial has put her in a place where it is very hard for anyone to feel sympathy for her, because her act was infamous and disgusting.

I am a military wife and when a soldier dies the military is there whether you like it or not, they pay for the funeral and if you do have to pay out of pocket, they reimburse you. there is no reason he shouldn't have a headstone. that's an awful wife and a disgrace of a woman.

This was very hard to watch. I'm a vet who took place in the initial invasion and was in Iraq for a year. I was disabled from an IED that also caused a fellow soldier to lose his leg.
Many soldiers get married before they go to war because not only do they get paid more, but the wife will receive benefits. While she may have just been avoiding things because she didn't want to reminded of the event, it appears more likely that she did not have the love for him that he deserved, especially posthumously.
Regardless of either lack of love or strength, she was most certainly in the wrong. We have to do things we don't want to do in times of adversity. This soldier deserved better.

before I deployed the 1st time I went to a lawyer and set everything I wanted in writing along with my will. luckily I didn't have to use it but I had friends who didn't and the whores they married before leaving did everything that blond piece of garbage did and worse. I did everything I could to help the families but it is what it is.

No, I've read about this couple. They did care for each other. It was that she didn't get along with the in-laws and couldn't put aside differences once Brandon died. This was really hard to watch, I started to cry. My dad and mom are both veterans. My sister is a combat medic, my older brother just started serving. So to see a man who died protecting this country mistreated like this, it just makes me mad.
Where she was, how they found out how he died, his age all these things have nothing to do with the case. Once you’re married that person is your immediate family and rest of your family is extended. Your spouse should have full authority & say about a burial.

The daughter in law and son of the plaintiffs did not have children and were only married a short time. She would have gone on with her life and remarried and most likely had her own family. The son should've been buried where his parents and relatives could visit his grave. It is obvious that the spouse did not care by how she neglected to maintain the gravesite, not even putting a headstone on it, therefore just wanted him buried in California out of spite. In the long run, she would probably not care anymore and not visit his grave at all. She would just go about living her life using his death benefits, while his parents would not get to visit his gravesite since it is so far away.

As his lawfully wedded wife, she gets death benefits, legal possession of the body (or what remains) and can bury him wherever she wants. Grave stones, while pretty, only serve the same purpose as a grave marker. Some people wait a while before getting a grave stone.

The parents wanted him buried in Nebraska, and probably raised holy hell when the wife refused. And probably were miserable to her from day one. Been there, in laws can be your worst nightmare. The young widow trusted the military and funeral home to do the right thing, she was in over her head to arrange burial so young and with the loss of her husband. I think the in laws are reacting to their loss by attacking her. I hope the widow never has to deal with that family again after this.

It maybe, but that doesn't give an excuse for the widow to be willing to transfer ownership of her husband's grave site to his parents for 15k! I mean ok, parents don't always agree with their kid's partner, they can hate each other's guts while the couple strive forward in life! But in this case the husband/son was dead, they had some misunderstandings, ok! But the questions start to rise against the wife when/why she agrees to transfer the ownership of the grave site by selling it!?? Why? That was her mistake! If she somehow agreed to do the transfer, she should've done it free of charge! She already got 400k from the military, why she needed to charge the parents another 15k?

True. This is jungle justice. Everytime the widow tries to explain herself, the Judge shuts her up. I'm glad our country follows fair procedure where the Judge is to stay impartial, not to interfere in the proceedings just merely listening to all parties and then to make an informed decision.

She is also dealing with grief and that completely went over anyone's head. Do tell if you knew how to manage a burial and settle estates and whatever else is needed at that age.

RE HEADSTONE: My father, who served in WWII and Korea, passed away in 1999. I handled his affairs after his death. He was entitled to a military headstone, which I ordered from the VA. After many calls, it finally came 9 months later. Unfortunately, my father's middle name (which is unusual) was misspelled. My mother requested that the VA fix it. So I sent it back. We finally got the headstone on my father's grave about 1.5 years after death.RE GRAVESITE: Prior to any family deaths, my mother had purchased 4 grave "spaces". Three of them were allocated to my brother, father and mother. In checking with my other siblings, they had already made other arrangements, or didn't want to be buried there. So with power of attorney I sold the remaining plot.

I have 2 sons who are both actively serving. Both are married. BOTH had to make wills before being deployed. BOTH had to assign someone to take care of their funerals.
Being Jewish, we don't place a headstone until a year after the funeral.

The Judge was rude and extremely rude to to the Widow. She clearly lack knowage in how the military deals with funerals and burials.

I don't think the judge was rude, she was angry at the wife for taking his payout saying openly that she paid for his funeral when infact that was covered by her husband's payout not her personally. Then had the audacity to ask her husband's mother to pay for his plot is even more pathetic especially when shes still left him in an unmarked burial plot because she can't get her shit together

It's true in this case unfortunately. That woman is a disgusting human being for how little care she had for her husband after his death and not taking care of the grave site. I think after like 2 months, any person would give up on finding it and put one regardless. And if you do find it in the future, you can always update it. I felt that the Judge didn’t hear the whole story. She got angry and didn’t ask more questions. The spouse was young and possibly didn’t know how to act properly. Mother in Law should have been the better person all along I bet she didn’t like the idea of the young marriage. Mom in Law was just too over the top.

That was one of the many things that the wife was about to say but the judge Cut Her Off. Listen to the video again, when the wife tried to answer about what money they received as a result of the soldier's death, she said that her part was $400,000 and it alluded to the mother getting part of the insurance death benefit. Me just making a wild-ass yes, I would say maybe there was a half-million-dollar policy and a hundred thousand of it went to the mother? Point is we won't know because the judge kept interfering with the wife's testimony.

She kept asking the wife questions but kept interrupting her while she tried to explain. The judge didn’t do that to the mother. And her practically yelling at the wife? Unprofessional. Only time she raised her voice at the parents is when the Jewish comment was brought up. In the end, instead of keeping going after the father to answer the question, the mother stepped in and the judge dropped that issue, immediately listening to the mother without interruption. She’d already made up her mind. Do I think the wife handled it the way she should have? No. I don’t. But it was wrong the way the judge kept attacking and interrupting her, but not once did she do that to the mother. Shows bias, and that’s unprofessional. She failed in her impartiality.

Zoey Rampage what you need to understand is that the Army get to decide what happens after the death. Lemme let you know what it is like in the Army. We have a form called a DD93. This is called the Record of Emergency Data. This list all beneficiaries for death benefits. It also contains a section for DOR, which stand for Deposition of Remains. This section is filled out by the soldier and it decides who has control over the body after it is processed by Dover AFB. There is also a form called the SGLV that list life insurance beneficiaries. I can guarantee the mother was not listed on any of these forms or she would of had control of everything. Every part of these forms are dictated by what the SOLDIER wants only. The wife should of had complete and legal control of the After death process. The mother had no right to ask for the remains to be removed. This judge over stepped her bounds and if I was the wife I would go the the state AG or Washington Military District IG.

She may have wanted to know in order to understand why the grave needed to be reopened. Or, to see what kind of person each of them were. The widowed wife could have much more tact. As a military veteran, I assumed it was his legs; however, there were many way she could have told the judge without being so blunt and uncaring of her in-laws.

As hard as it is to hear for the parents, the wife is the person who has rights to remains. Unfortunately the military deals with this regularly, they handle this stuff because they know the pain that goes with burying a son or daughter.

I knew there was going to be something bad about the wife when the judge asked her "...How long after that does the body come home...?" Rather than say "he came home", the wife actually referred to the deceased by saying "...it arrived February the 9th...". In my opinion the right response from some one who really loved him would have been "He arrived home on on February the 9th". I know the difference between "it" and "he" is subtle, but to me it seems as she regarded him as you would luggage or a parcel, not as the remains of loved one who had died tragically.

Actually it's distancing language. It's difficult to think of a body being the person you loved. You would be surprised how common it is for a person to be unable to refer to a person's remains by name.

They are entitled to money as surviving parents, and that has NOTHING to do with a surviving spouse's money. When she was complaining about having to pay for the funeral, yes, you are required to pay up front and then sent paperwork on how to be reimbursed. She also admitted, the military paid $6.500 towards his funeral. They also would have paid for his headstone if she had gotten one. I hope his parents were able to submit the claim to get him a proper headstone paid by the military. The widowed wife seemed very spiteful!

The mother is the first one that brought up the fact that there were additional remains found, she's the first one to mention that she had ownership of the second set of remains and that the wife had ownership of the grave. I'm sorry but I think this is a case of a mother who didn't want to let the wife have the control that she should have as a wife. She keeps saying the wife is playing games maybe she was mourning, maybe she was depressed, you don't know why she's not answering her phone she just lost her husband

What I can’t understand is why didn’t she notified. If it was all about money, it would have been easier and less obvious for her to keep contact with the soldier’s family. To move out a year, or 2 after the death and slowly cutting calls, while building her new life.

As a Casulaty Affairs Officer it is the decision of the widow. Parents have absolutely no decision. The widow has a Casualty Officer assigned. All decisons are on the widow. Now the widow does recieve Surviors Benefits and this includes since he was active duty military she gets everything. The headstone is part of the administrative process that the widow is responsible. The parents again have sadly no rights.
