  • The plaintiff moved in with the defendant and says the defendant was nice at first, but then became a nightmare roommate. She claims the defendant acted like a dictator and made her feel uncomfortable. She eventually moved out and is now suing for double her security deposit. The defendant argues the plaintiff was a terrible roommate and caused tons of damage around the apartment.

      Most non-lawyers in small claims court don't know how to collect and present evidence. Therefore, they often ramble. It's the judge's job to manage the courtroom.

      Welcome to the American welfare system where they they literally told my aunt who had given birth and had surgery back to back so she couldn't work for a while and denied her food stamps because she is married and told her if she divorces my uncle (who was working but wasn't making enough) they'll give it to her. My aunt yelled at them "You'd rather destroy my family then help me" Won't give it to a woman who said she only needs them until she's recovered and can go back to work but will give it to bums for a lifetime who don't wanna work and keeps popping out babies for the welfare.

      That's called evidence of a pattern of behavior. Very good character reference in light of no other tenant statements. You have to assume that the statements are true, especially if they're limited. Defendant clearly knew about the website.

    The plaintiff rehearsed her "speech" very well but didn't say anything meaningful. JM was kind in her remarks. I don't believe a word the plaintiff said. The body language is telling. She is so annoying. JM had her number early on. That being said, I don't think the defendant is blameless either. The plaintiff's reaction to the verdict indicates she can't be pleased. I don't think I've ever seen/heard anyone who rambles on like she does.

      I thought the same thing. The first speech she gave was prepared and wasn't anything about the case. She just wanted to brand the landlord as evil before it started. JJ would have shut it down once she started and it wasn't answering the question.

    The plaintiff wanted to tell the judge her "feelings" about the defendant instead of sticking to the "facts". She came off like a drama queen. I don't understand how the floor is the landlord's fault - maybe it was the AC thawing - but you clean up the water and inform your landlord that it happened right away! I would however like to have heard about the defendants "threat" of having her pay $3700, or was she being overly dramatic about that too.

      the landlord is responsible for fixing the AC and making sure its drained proper. You can't expect a tenant to deal with that. A maintenance person or AC/HVAC person who is trained and knowledgeable deals with that

Also, I have the impression that landlords who accept Section 8 can't ignore needed repairs as the checks will stop in an instant if everything isn't just right per Section 8 regulations. So her trying to pretend the landlord ignored valid requests for repair doesn't wash.

    Love watching Judge Milian; however, Judge Judy would've NEVER let the plaintiff get on her soapbox and personally attack the defendant.
    It was tacky, rude, and not necessary. The plaintiff came off as a rude brat from the start. 🙄
    Also, Judge Milian let the plaintiff tell her what the defendant was thinking. You can't say what someone is thinking.
    Last thought, the Judge laughed with the plaintiff when she mentioned the plaintiff calling the defendant "nasty." Judge Milian really let the plaintiff cross lines in this case. JMHO.

    The plaintiff's main problem is that she was trying too hard to make herself look & sound intelligent, of which she failed miserably when she couldn't pronounce the word "Thaw/Thawed. As soon as I heard the plaintiff's opening statement which had absolutely nothing to do with the case or the judge's question, I just shook my head. She went on a likewise incoherent rant again when speaking with Doug at the end of the show. LOL

    I had a tenant who recently moved out to a bigger and newer home. I got a message from them thanking us for the service we provided. I too take care of all the maintenance requests for our properties and will be the first to call a contractor is it's over my head. There's nothing wrong with that. This is why we can address any issues in a 12 hour time frame.
    We had to keep their deposit because we did have floor damage, Did not know how it got there but it wasn't there when the tenant moved in.

A counselor came out to help me fill everything out and get the housing voucher. There might be programs that provide the sec deposit but section doesn't. Luckily cancer centers of America sent me a check for the deposit.

    This case was so similar to what I am going through right now. I lived in an old tri-plex for 16 1/2 years , 14 of those were great. I had no problem until my landlord had a stroke and his son took over. He wanted the old tenants to move out so that he could raise the rent. During the pandemic! He constantly reminded me that he was the property owner and could do whatever he wanted with his property including entering the property whenever he wanted to. He stole my trash repeatedly, refused to make repairs in a timely manner, and met me with disbelief every time I reported a problem. He was awful reporting false accusations to housing, threatening me because of what other tenants did, even went as far as threatening to kill himself because he had all these properties that no one was helping him with. He has postponed out court date 3 times, but this time we are scheduled to go to court this year 2024. I just want him to know that some people know their rights and that although I am not rich like he is I can still fight back for my civil rights. He returned my security deposit in full, and after almost 17 years the place was still in great condition. In fact a new tenant moved in a month later.

    Im glad the plaintiff stood up for herself. Even though she was nervous and rambled. When the judge commented that she could take care of herself and probably knew a lawyer, the plaintiff's face showed the fact that she was truly scared and refused to be taken advantage of. Glad the defendant didn’t get that extra 3k out of her!!!

    Of course section 8 would pay for somebody to live in a high-end apartment. Public assistance in this country is disgusting. Not that there aren't people that don't need help, but the help of these people get is more than middle class working people get and it's just not fair. I spent 8 years serving this country in the Marine Corps, and I'll never forget when I was transferred stations in California to the city of Lemoore, The best place I could find myself to rent was a crappy one bedroom apartment in a complex that was falling apart for $1,600 a month. There was a town two towns over from me that had a bunch of brand new apartment complexes built. Four and five bedroom apartments that were absolutely beautiful with community pools and community rec centers. The average rent for those four to five bedroom houses was about $1,200 a month. But because I made about $2,000 a year too much I didn't qualify to live there. So all these public assistance families, working minimum wage or not even working at all when they are fully physically capable, many of which who were even undocumented immigrants because I'm telling you that town was like little Mexico. I'm not being racist either, I'm Hispanic myself. But that town really was like little Mexico. Most of the stores carried products with Spanish printing on the labels. So here was this community of people, making zero effort to acclimate themselves to life in the United States. Instead they had made their community into what their country was like. But they got to live in the lap of luxury, while I had to live in squalor. The middle class is all but forgotten in this country. The people who get all the advantage are the rich and the poor. The rich get richer and the poor squander all the free money, food, and housing that they get. And it's the middle class that foots the bill for all of it.

    Yup, words like that will destroy a landlord. On national TV, you don't want anyone describing you like that. The plaintiff took her words pretty far.

    Ive had rentals and the plaintiff gives me nightmares
