      Honestly, that was good for Fox. Proving malice is a lot harder then proving someone lied.
      Yes. Their claims were verifiably false. If Fox could prove that they were legitimate, they would have done so one of the numerous times they tried to get this dismissed.
      Even just proving they didn’t lie maliciously was as simple as showing enough evidence that they could reasonably believe they were telling the truth, but they instead decided to settle. Hell, released text messaged showed that the anchors didn’t believe the election was stolen which totally destroyed their case.

      Sure, that's the case, I mean fox also gets the weather wrong at times. The point of the statement was to remind the jury that just because fox News was wrong doesn't mean they lied. This is pretty standard stuff, and the reason they settled has more to do with the spotlight rather than the authenticity of fox News. Most business will give you a lot of money to avoid going to court.

    One of the most interesting factors in Fox's core statement in their initial defense prior to settlement was that, according to them, their viewers know that their coverage is just entertainment and not actually real news, and therefore they shouldn't be held responsible if anyone takes what they say seriously...

      ​@@itsSw1m yup, and elon musk vreated another one by buying twitter. Because all of the other republican social medias were very small and not popular. And most people only use social medias that are established and popular. So they complained that it was difficult or nearly impossible to spread their beliefs publicly on a wide scale - especially during the pandemic when everything was locked down, you could not go to a town hall or bar, or club or park or church or really anywhere to talk about your beliefs and the upcoming election, the only places you could talk about your beliefs to a large audience were on the social media platforms that were already cemented in the culture like Twitter, Facebook, Instagram etc.
      When republicans conplained about this, they were told "build your own social media platform" and they DID......then they were removed off both the Apple and Android app stores, then the servers and networks they were on shutdown andnthey were told "build your own internet servers and networks if you want to have your own social media" and "go build your own app store, buikd your own phones, build your own OS etc".
      Which was a lot of work, so Elon just bought twitter instead, so that way he could create a conservative-inclusive social media network without actually having to "build your own app, build your own servers and networks, build your own app store, build your own OS, build your own phones etc.".

    They worded the acknowledgment in such a way that their base can still argue that Fox News tells the truth. Dominion should have forced them to admit that they lied in more plain language.

      @@Scuba_Tim88 Reality has a bias. Fox is objectively worse than others, when it comes to lies. The others might be biased in their reporting and in their choice of subjects to cover, but rarely do they blatently lie like Fox routinely does.
      If I'm biased, so are the jugdes who have condemned Fox times and times again. Curious how there are almost no lawsuit of that kind targeting the other networks, right ?
      Don't try to be neutral, try to be objective.

      @@tyoung9012 you can say whatever you want about THE GOVERNMENT. That’s what the first amendment protects. To my knowledge the extent of this is essentially up to but not including causing rebellion (aka treason). So you can make false claims about the us government, so long as you aren’t saying to kill the president or something. (A caveat here is this could be restricted in times or war or if the information being shared is a risk to national security). The first amendment says NOTHING about what you can say about another private entity though. The first amendment doesn’t protect your ability to say bad things about another private entity, true or not, to any capacity. Other laws do protect you there depending on the circumstance, but that is not the first amendment. The first amendment does also protect you from states in a similar way it protects you from the federal government, as a result of one of the clauses in the 14th amendment.
      But the first amendment has zero bearing on one private entity saying something about another. Fox News vs dominion? The first amendment protects nothing in that interaction. All the first amendment essentially does is protect private entities from being sued by the federal (or state) government for defamation or libel. In terms of free speech that’s the extent of it (obviously it protects peoples freedom of expression in religious and other things in addition, but again, that’s only from the federal government. You are never protected from another private entity by the first amendment, though you’re often protected in similar ways by other laws)

    My favorite document from this case was the internal memo by a Fox executive when they were looking for times when they talked about the election in an unbiased way. It’s something like “I’ve spent two weeks straight going through our shows. North Korea puts out less biased news than us.”

    I was reading this one short novel series that takes place some 40 years into an alternate future and it openly said that after a law that made it mandatory for news channels to openly label opinion pieces as opinion pieces, Fox news fucking died.

      I’m surprised others didn’t die considering are era of news channels. Bias will be found everywhere, I cannot trust anything these days. Not a single one of them has it. Yes his father lived there but he did not live with his father, and did not stay with his father while he was there. He had no reason at the time to be in Kenosha and was not in Kenosha prior to the riots but traveled to Kenosha when the riots broke out. So yes, it is completely reasonable to me to say he sought out the situation. He was not in and had no reason to be in Kenosha, riots broke out and he traveled to Kenosha. He traveled to Kenosha because there were riots. He sought out that situation and put himself in it.
      And yes, the rifle that was purchased for Kyle, because he could not legally purchase one, by the same friend who’s house he traveled to at the time of the riots, which he sought out. The rifle that was bought as a gift for when Kyle would be old enough (because some how you wouldn’t be able to buy him one once he was of age) and kept in an unsecured location out in the open of that friends basement.

      It's not "saying things I don't like" it's "spreading false information (possibly knowing it was false) that cost a private company its reputation and being held liable for billions of dollars in lost opportunities". If it was your business tell me you'd take that sitting down.
      The case wasn't even going to be about what Fox said, it was going to be about whether or not they knew they were lying. And it's stupidly hard to prove knowing intent to a court's standards, so if Fox had any confidence at all in their sources they would have won

But it’s really depends on weather or not there is people willing to check on the process, and people willing to pay (your taxes). I mean, look at Florida 2000, that was on paper. Also, the citizens thing is dumb. Go fill out an election register and see if you could get in without proof of citizenship. Politicians who promote those points just want to pray on your fears and make it harder on average for busy citizens to vote.

      They do check that and recounts are normally done by hand.

      They recounted the votes twice in 7 of the states and Biden won all three times (the original and two recounts).
      You can recount votes until the sun explodes, doesn’t change the fact that Trump lost.
