ശക്തമാണ്. ആരെയും പേടിക്കേണ്ടല്ലോ . ആതുകൊണ്ടാണ് നടന്നു 20 വർഷത്തോളമായ അഴിമതി കേസ് സുപ്രീം കോടതിയില് 50 തവണ മാറ്റിവെക്ക പ്പെടുന്നത് . ഇദ്ദേഹം പറയുന്നത് കേട്ടാൽ ചിരി വരും. സ്വന്തം സിസ്റ്റം മഹത്തരമെന്ന് സ്വയം പുകഴത്തൽ . നമ്മുടേത് ലോകത്തിലേക്കു ഏറ്റവും നല്ല ഭരണഘടനയയാ ത്രെ . അതുകൊണ്ടാണ് ഗോവിനടച്ഛാമിമാരെ ചിക്കൻ മട്ടൻ മുതലായവ കൊടുത്തു പോറ്റുന്ന അവസ്ഥ കൊല്ലപ്പെട്ടവരുടെ വേണ്ടപ്പെട്ടവർ കാണേണ്ടി വരുന്നത് . ക്രിമിനാലുകൾക് ഇഷ്ടം പോലെ ജാമ്യം, അതായത് അടുത്ത കൊലപാതകമോ കൊള്ളയോ നടത്താനുള്ള ധാർമിക അനുവാദം. കോടികൾകടുത്തു remuneration വാങ്ങുന്ന സുപ്രീം കോടതി വക്കീലന്മാർ ഉള്ള രാജ്യം . ഇന്ത്യ യെപ്പോലെ നീതി നീതി ലഭിക്കുന്ന കോടതികള് ലോകത്തെവിടെയുമില്ലത്രേ. എന്തൊരു തമാശ.

Think of the actress case- years passed by- no justice is delivered.
Imagine the other day the criminal who had around 50 cases against him was left free inthe public to commit more crimes and he brutally killed an innocent lady on her way to meet her sick husband.

കോടതിയിൽ നിന്ന് നീതി ലഭിക്കാൻ ഇവിടെ ചെയ്യുന്ന വിധം വിചിത്രമായി തോന്നുന്നു. ഇതിനു കാരണമായി ജഡ്ജി മാരുടെ കഴീവുകുറവുകൊൻട്മാതൃമലല. അതൃസംഗീർണമാണ്. അതുകൊണ്ട് അത് തെറ്റായി നിർവചിക്കുകയും ഇനി അത് തിരുത്താൻ മേൽ കോടതികളിൽ കേറി ഇറങ്ങി പാടുപെടും. നിവർത്തി ഇല്ലാതെ അംഗീകരിക്കേണ്ടി വരും.

ഞങ്ങൾ 6 പേർ റിട്ടയർമെൻ്റ് പ്രായത്തിലുള്ള അപാകത പരിഹരിച്ചു കിട്ടാൻ കേരള ഹൈക്കോടതിയെ സമീപിച്ചു എന്നാൽ നാല് പേർ ഉൾപ്പെട്ട ആദ്യം കോടതിയെ സമീപിച്ച ഒരാളെയും അതിൽ കക്ഷി ചേർന്ന രണ്ട് പേരിൽ എനിക്കും നീതി ലഭിച്ചില്ല. എന്നാൽ കേസ് കോടതിയിൽ നിലനിൽക്കെ ഞങ്ങൾ രണ്ട് പേരെ മാറ്റി നിർത്തിക്കൊണ്ട് അനർഹരായവർക്ക് പോലും റിട്ടയർമെൻ്റ് പ്രായം 60 ആക്കിക്കൊണ്ട് സർക്കാർ ഉത്തരവും വന്നു. എന്നിട്ടും ഞങ്ങൾക്ക് നീതി ലഭിച്ചില്ല. കണ്ടം പ്റ്റ് ഓഫ് കോർട്ട് കൊടുത്തപ്പോൾ അത് ചാലഞ്ച് ചെയ്യാൻ പറഞ്ഞതു കൊണ്ട് ആ പ്രോസസിലാണ് 2015 മുതൽ 40 ൽ അധികം പ്രാവശ്യം കോടതിക്ക് മുൻപിൽ വന്നിട്ടും ഒരു തീരുമാനവും ഉണ്ടാകുന്നില്ല. എനിക്ക് എഴുപത്തി ഒന്ന് വയസ്സ് കഴിഞ്ഞു മരിക്കുന്നതിന് മുൻപ് ഒരു തീരുമാനം ഉണ്ടാകുമോ?😢😢

True and well said Sir... In India, supremecourt is the custodian of Indian constitution and have authority to review the acts passed by Parliament and repeal it if it goes against basic structure...
But government/parliament can override the judgements, recently also it happened.of course not a basic structure feature. So law making power of supreme court is not absolute.

Static അല്ല എന്നുവച്ചാൽ സർക്കാരുകൾ മാറി വരുന്നതനുസരിച്ച് മാറിക്കൊണ്ടിരിക്കും എന്നാണോ? അതോ അവസരങ്ങൾക്കൊത്ത് വ്യത്യസ്ഥമായി വ്യാഖ്യാനിക്കപ്പെടാം എന്നാണോ? സത്യം എന്നത് ഒന്നു മാത്രമല്ലെ യുള്ളു ?
ഇന്ത്യൻ കോടതികൾ പലപ്പോഴും പ്രതിക്ക് കൂടുതൽ അനുകൂലമാണ്. പ്രതി തെറ്റ് ചെയ്തില്ല എന്നു തെളിയിക്കാനുള്ള ബാധ്യത പ്രതിയുടതാകണം. ഒരു കേസ് ഒരു 10 വർഷത്തിനുള്ളിൽ അന്തിമ വിധി വരണം.

Voice ഇല്ലാത്തവൻ collective voice എങ്ങനെയുണ്ടാക്കും? റോഡിലെ കുണ്ടും കുഴിയും അടച്ചു കിട്ടേണ്ട ത് അവൻ്റെയും കൂടെ ആഗ്രഹമാണല്ലോ. Voice ഇല്ലാത്തവൻ്റെ അത്താണിയാണ് കോടതിയെന്നാണല്ലോ വിവക്ഷ !! പൊതുക്കാര്യത്തിന് കയ്യിൽ നിന്ന് കാശുമുടക്കി voice ഇല്ലാത്ത ഒരു വ്യക്തി കേസ് കൊടുത്താൽ എങ്ങനെയിരിയ്ക്കും? ഇനി ഒരു സ്വകാര്യ വ്യവഹാരം ഒരു വൃക്തി കൊടുത്താൽ അയാൾക്കു പൊതു സമ്മതിയില്ലെങ്കിൽ collective voice എങ്ങനെയുണ്ടാക്കും?

Sir our Indian constitution 14 has been written based on a democratic system only. That is why that constitution 14 was wrongly defined as Equality.That was a grate mistake done by the person Amaker who steered that law.Equality can never be made even by God. Therefore Judiciary & Law enforcement must be handed over to AI (Artificial Intelligence) to provide equal justice to all people without Emotions, Expenses, Errors, Delays, Derailing of Laws, Partiality, Violence, Favouritism etc etc😢
It is already too late.
AI do not need several levels of Courts including Supreme Court, to provide real justice because the Laws are same for every one and AI is capable to perform everything simultaneously, without Errors, tirelessly 24/7 everyday 😊

with love and admiration I differ with Sri Justice Ramachandran one of the finest in the field of Justice. Sir I believe the ultimate power is only with people of this great democratic country. Examples ;Nepal can change Constitution and Sri Lankan people can intrude to Presidents palace nothing is static. People can change anything and everything. If you challenge them to an ultimate low standard then know the way forward. This is my independent Opinion. I agree with most but there are many black spots where I differ with Justice De. Ra.
Recent judgements of some of the courts raised some serious doubts about the impartiality and the independence of the functioning of courts.
I always felt that there should be a cooling off period minimum of 10 years for judjes after retirement or resignation just like in many matured democracies. In U.S.A., there is a life-long bann for judges to take up any job/ assignment during the post retirement life, in order to ensure the independence & impartiality of judges. Likewise, for many high ranking officials in police, army and other departments , there is cooling off period of 10 years in U.S.A. and in other countries. During the post retirement life, judges should not be allowed to function as legal counsel for corporate entities, should not set up legal firms etc.
This type of safeguards is required in India also, which can ward off incidents like that happened recently in Bengal High court where High court judge jumped into the election fray as a party candidate and in another incidence, Supreme Court Judge received a favour of political assignment as upper house member of parliament soon after his retirement. There should be certain ethical and moral code of conduct for judicial officers.

What is so great about an apex court that has not so far declared the law under Art 141, or done complete justice in any case under Art 142, but has piled up a Himalayan mound of arrears denying justice by delaying it? Does not Justice Ramachandran know that it takes a definitive decision to declare the law and that it cannot be done under any appellate jurisdiction?
