    An innocent person gets over 900 hours of community service, but the actual guilty culprit only gets 100? There is no justice in this world.

      You know what actually really pisses me off about it? He was still treated like a guilty party even after that as he was required to perform the psyche evaluation, and he failed because he was "unrepentant." Shit sounds like a conversion camp in the backwoods of America, but we're literally talking the German legal system. Of course it's their legal system from decades ago, so I can't say what it's like now, but this isn't some backwoods retreat for "troubled kids with the gay" it's the actual official government authorized legal system judging him for not being repentant of a crime he was proven not to have committed.

    • @bergmanoswell879
      @bergmanoswell879 ปีที่แล้ว +60

      Odds are the actual culprit at least pretended to be remorseful. Courts frequently punish people who are unrepentant more severely than those who are repentant - and innocent people who are wrongly convicted almost never feel guilt for not doing anything wrong. In fact, only a psychopath would feel guilt for doing the right thing.

      Sounds like this is in Germany, and since he was drunk when they picked him up, it was also probably charged as a DUI. So the charge would already be significantly more severe as is, but I’ve heard European court systems are far more vengeful when it comes to DUIs.

    • @animationlivegerman5989

      It's probably because the parents made them pay for the damages outside court, but had records of this, so for the kid it was probably the deed itself + the damages, since he obviously can't pay damages, it got added to the community service. When the actually guilty one was trialed, the parents probably told and showed the court, that he paid the damages, so his punishment was just the deed.
      Also the whole remorse-thing probably played a role as well, OP was probably just angry or sth during the trial, obviously knowing he was innocent, but since he war trialed guilty, his punishment was for someone who actually did it, lied about it and didn't show any remorse about it whatsoever. Which are not additional crimes technically, but the judges in germany have a little room to decide, so it may be that he had like 250 hours for damages, and then from a range of 100-250 hours, he got the 250, the man got the 100 and had paid the damages already, so that was all he got.
      The numbers are not based on anything it is just to explain a bit how the system works in germany

    8:48 I'd say have them arrested for the fraud, embezzlement, theft, two counts of false imprisonment, lying to law enforcement, lying to a judge, burglary, and whatever else I missed. Unless Germany somehow doesn't have laws for any of that, "no contact" should be the least of their worries.

    • @donschmiddy
      @donschmiddy 2 ปีที่แล้ว +57

      we do, and i am suprised about 500 hours of community service. The amount is one of the highest I have ever heard of.
      Also what kind of a hack of lawer did the op have? Declaring someone legally dead is a lengthy process. It takes months without a certificate of death which in turn you only get by positive identification and fingerprints. The only way this could have happend, is, if the OP did not respond to summons by the court. i am by no means an expert and i have only a minimal understanding concerning civil law let alone criminal (more so economic) but the central idea behind the german laws is caution. I do not believe ANY judge would rule on legally dead without a shitton of evidence.
      As for what to do, let them rot and consequently burn in hell. If even one of the things those parents did is true, they deserve a prision sentence. If all of it is true? throw way the key.

      I doubt cops will do anything about it. From the story it appears that "declaring OP dead" occurred 15-20 years ago. Not sure about statue of limitations on that issue in Germany, but it might have run out. Besides - both "parents" are around 80 years old, so - what's the point ?

    • @ivator

      The thing is that this works well in the US, where everyone sues everyone. But in Europe its not that easy to sue and get a profitable case. Most of the legal fees have to be carried by you, and the judge can't rule for the other side to have to pay the legal fees. This makes it a harder decision to sue, especially with a case like this where it is very hard to prove what happened since there is not a lot of evidence and its his word against his parents.

      If he actually didn't hear them then what is he supposed to do? (Although the lock sounds super extreme).
      Secondly, just because he is a moron doesn't mean he is wrong, he is in fact right, nobody should be leaving 2 children in the kitchen unsupervised, especially if they are cooking.

    • @Skullost
      @Skullost 2 ปีที่แล้ว +6

      We do not know if the husband intentionally ignored the family emergency or not, but he do actually have a point about the wife being neglectful.
      Reason is quite simple... The wife knew that the husband would take a nap at the time, the wife should have known if the kids were cooking food and if she indeed knew that the kids were cooking food (Which it does sound like she did) then she were neglectful by not supervising it or at least have the younger one with her.
      I mean seriously, who the hell leaves a 3 year old kid in the kitchen with another kid that is cooking without an adult surpervising them? I can understand not supervising the 14yo but the 3 year old is the very definition of neglecting your child.
      I do agree that the husband is not guilt-free either, although the situation could have been easily avoided by the wife. :|

    12:55 I used to have a basil plant that I cared for, it was five dollars, and I got over a hundred dollars in basil out of it, but when fall hit, it started to die because of low sunlight, and when my mom threw it away, I internally cried, I had that for most of the summer, i cared for it heavily before vacations, and left it In a bucket, with paper towels going into the base of the planter box, and it survived like that for two weeks. Plants are much easier and cheaper to care fore than pets, just sprinkle some water on them once or twice a day, and you’re good. Story 1 - He should just file a restraining order. They ruined his late childhood because they falsely accused him for a crime that he didn't commit and gave the actual criminal a slap on the wrist while he gets hit the hardest. The legal death thing was essentially a blackmail, or maybe that seems to me that is blackmailing. I live in America, so I don't know how the legal system works in Germany, but what I think he should've done was go back to his hometown, and tell the judge that he is not dead so he could get the money back with a restraining order that comes with it.
    Story 2 - He had a right to freak out. What they did was just flat out theft, and her niece and the sister in law should face charges. He intrusted them with his property, and vandalized and stole parts of his property. Whether he was overreacting or not, he has the right to kick them out. The "My Aunt said it was ok" is not something to brush out on. She committed a crime, and her aunt should've stopped her for it. As a consequence, they should face charges or face some legal penalty.
    Story 3 - It's kind of a grey area. The husband has the right to relax. I think the wife and the husband should talk this out civilly.
    Edit: I changed story 3 cause the first 2 stories got me a little too angry.

      Not really. When I was 14 my parents would go on dates and I would be in charge because I was responsible and old enough. I a lot of people think "oh 14 is so young!!" but they are one year away from being 15 and they can get jobs, drivers permits, etc. It's tough for teens because people are constantly saying "your too old for that!" while at the same time saying "your too young for that!". Also I have spilled oil on myself at 17 (it landed on my pants so I was okay.) Another thing is that the OP can't watch her children every second of the day she has stuff to do, and the child probably wandered into the kitchen to see what she was making and it was terrible timing.
      There is no way the husband is in the right here, he literally goes home, locks the door, sleeps for hours and gets up when the children are probably almost about to go to sleep. they hardly ever get to see their dad. He is acting like a teenager and is super irresponsible. its okay to nap after work but having your earphones in and locking the door is irresponsible, especially because he's a father. what if the child drowned or got crushed by dresser? what if they all died because of something falling on them? he would just be asleep not hearing their screams and basically leaving them for dead. What if there was a fire? they tried to warn him but the door was locked and he could not hear them? they would have to leave knowing the husband doomed himself.

    For story 2, I completely understand. Growing plants, especially rare exotic plants, takes a lot of time and effort. With as many plants as he had, it's on par to having a couple pets. The best comparison I can give, to explain to someone is they are like personal art work, that you keep adding to little by little, just to have someone rip it up. Car guys especially will understand the feeling, because it's like building their dream car, then someone comes with an angle grinder and starts hacking off parts and selling them.
    Something like this has happened to me before. I live in an apartment building with balconies. I asked my neighbours above and to my side to allow me to string my passion flower between all of our balconies, to make a green awning for our building. Everyone loved it. I also have friends that smoke and so would smoke on my balcony. After a few months, my neighbors started telling me that they thought something was wrong. The ends of the vines stopped growing and they said leaves were falling off. I thought I'd done something wrong with the care and started checking the pot, to make sure it wasn't water logged, which can kill the roots. I was horrified to not only find my friends had been ashing in the pot, but there was over a pack worth of butts buried in the pot. I tried to save my passion flower, but lost the plant and didn't have the heart to try again. My neighbours were heart broken. I showed my friends what they had done and they said they didn't know and it was no big deal. So I screamed at them. Autism can really get the better of you sometimes. They offered to replace it, but I said only if they were willing to train it and care for it. They didn't.

    As a plant parent who has 100+ plants i’d be livid! A majority of the plants mentioned go for a LOT of money, many I myself don’t have due to just how expensive they can be. A Monstera albo can be anywhere from $100 for a single node and $1000 for a mother plan of average size. Cutting that plant alone and selling it would be enough to call the cops, from the sounds of it they stole well over $1000 worth of plants. I would sue! The SIL giving the money that she made off selling OPs plants won’t do anything! It won’t bring OPs plants back to they’re original glory and it wouldn’t teach those thieves anything! (she didn’t even offer that money to OP!) But I’m sure being arrested for theft and destruction of property would.
    Never in my life would I plantsit for someone and then go onto butcher their plants just because they said “you could have some cuttings”. Last time I checked you get paid AFTER plantsitting, the fact that OPs niece thought that it was fine to do that after OP said she would get cuttings for watching them then doing it well OP was away is extremely entitled brat behaviour, but seeing how the SIL acts it’s pretty easy to see where the kid gets it from.
    I seriously hope OP calls the cops and has the entitled SIL arrested that would also teach the niece that you’re actions have consequences. They should not get off the hook for this and honestly that would be a hill to die on! The SIL and niece obviously feel absolutely no remorse for what they did and clearly they’re idiots if they thought OP wouldn’t notice or care about what they did.
    The only person I feel bad for in this situation is OP. The fact that Her brother noticed that his wife and daughter were bringing home large amounts of plants and instead of calling or texting OP to confirm she was actually ok with it “auntie said it was fine” was good enough for him. OP even said in the beginning that her family knows about her prize plants means he was not oblivious to the fact that these plants are worth money. (regardless of if they were worth money or not it’s very obvious that OP cares about her plants and that’s all that should matter) He did do the right thing by bringing back the ones that weren’t sold yet and apologizing but that doesn’t fix what they did and he’s still partial to blame for not telling OP as soon as he noticed. Than to say “family means not holding grudges” is bs, I would have told him his daughter and wife are no longer considered family, then thrown the SILs words back at him “what’s done, is done” after all

    • @gracekeesler8082

      I agree that the SIL should get some sort of legal consequences, but definitely not the niece. it sounds like this kid was genuinely interested in plants and respected her aunt as a mentor until her crappy mom used her as a pawn to make money for herself. the mom asked for the price of the plants, not the kid.
      this kid had NO authority to get her mom to stop, she was fourteen, barely even a teenager. when you are that age your parents have a lot of control over you, both with rules and psychologically. what the heck is she (as a fourteen year old) supposed to do in this situation?
      I think this mom is a sick individual not only for stealing, but also for sabotaging a relationship that was clearly important to her daughter.

Ive heard of people who also had horrible parents but most of the time they say they regret not having that last conversation.
    For the second, yeah the op did overreact but who wouldn't when something so precious to yourself is destroyed, the little girl probably was only following what the mother told her to and thats why she cried, the mother being the adult is the one who should take all the blame and not be forgiven, and for the niece maybe just apologize for taking your anger on her too, we have to remember that most kids are not mentally mature to figure out some stuff.
    For the third i understand the husband wanting to have his free time to sleep and his hobby, but if either of those causes trouble to those around you then thats a problem, specially for a grown man with kids and a wife, like come on dude your family comes first and if you really need the sleep, then reduce the gaming time or just have some days where you play and others for your family, but honestly what that family needs is counselling because if the guy was more bothered about his stupid lock then his injured son then he is both a terrible person and a worse father.

    Story 1: Good ol' useless Bureaucracy Story 2 needs to seek legal compensation. That is theft and malicious destruction of personal property and emotional damage to top it all off. Story 3: It seems daddy thinks being the breadwinner is all the family contribution needed so she should oblige him and dump his ass. If he spent any time being an actual father then he would know that sporadic child accidents are common and happen often. What isn't common is a husband and father being completely inaccessible while he's within his own house. In OPs case, I can understand not having a license as that shit takes a large time commitment but not being able to drive should have been accomplished a long time ago. My own mother never got one because of work/time restraints and eventually just laziness after becoming a housewife. But she made sure she could and does drive all the time.

    I have a philodendron climbing around my free standing chimney that I have grown for over 3 years. I would be absolutely mortified if someone cut it back to just the two or three leaves.
    I also remember talking to a lady who said she had some lovely trees that hid the fence all around her property. They were really big trees. Her live in boyfriend decided to cut the tops of them so that they were level with the top of the fence. She was absolutely livid and ended up chucking him out. If you are an avid gardener, they are not just plants. They are something you care about and lavish your attention on. It's like mutilating one of your children. Definitely no contact for them.

    Story One: If OP doesn't want to see them, he should send them a letter telling them so & that what they did was literally unforgivable. They chose to sabotage any chance he had during his developing years of having a normal social life, & used fraud repeatedly in order to try to dictate his life, as such he has no interest in giving them the chance to sabotage his life again or that of his loved ones. As such they will never get to meet his wife & any future grandchildren as OP does not want to subject them to the kind of abuse they put him through.
    Story Two: I can understand that OP is upset, but most of that needs to be focused on the Mom, as she's the one who basically decided to ROB OP. I do understand why he doesn't want contact with them again, as they effectively destroyed YEARS of his work. My ruling is slight AH for blowing up at the kid, but it's understandable & the fact that the family just wants him to rug sweep the theft, and that's what this was a THEFT, shows that he should be leery about trusting them around his things & SIL MOST CERTAINLY shouldn't let back in his house EVER, the kid just sounds like she was dumb & believed her Mom maybe she can EARN back forgiveness but it's going to have to be via best behavior on neutral ground. SIL also owes OP all the money that she got from her sales from HIS property, without that no contact is the best solution.
    Story Three: Final story, I'm going to recommend divorce for OP, as her husband sounds like he has no interest in actually being an involved parent as he's asleep when the kids are awake & home so he can play X-Box. That's not an active participant in raising the children & only seeing them weekends at most while he lives in a separate house from them sounds preferable to him. OP isn't the AH for removing the lock, she is however for keeping the husband.

    Okay. I’mma try to give some reasonable responses to all 3 of these stories.
    Story-01) Okay. I wouldn’t tell his to give chase to sue his parents if he dose not want to. He sounds fine where he is and I wouldn’t recommend continuing a needless drama that has settled.
    Story-02) I’d say they have are in the right to be mad about the destruction of her property and demand anything that wasn’t sold yet. However I do think it was wrong to blow up in the way she had. The husband of the S.I.L had no way of knowing what was happening was not authorized by storyteller.
    But he didn’t deserve to get some of that hate. He tried to de-escalate the situation and calm down the storyteller.
    Story-03) the last one is nothing by irresponsible parenting.
    The father needed to be available for when emergencies happen and when he was needed, he couldn’t be accessed. He was neglectful of his duties as a father. But I also have to wonder why was a 14 year old left unsupervised with cooking oil?
    Why weren’t they supervised?
    I wouldn’t say the mother is to blame for the incident, but to leave a 14 year old to operate kitchen appliances while using a substance that can exceed 300 degrees but only needs to be 300 degrees to cause serious harm is nothing to turn into a joking matter.

    • @Kakachi07
      @Kakachi07 2 ปีที่แล้ว

      @@thatonerandomstick3664 yes... watch their younger sibling while also trying to focus on cooking with oil and not get burned herself, I could see a 3 year old come running out of no where and bump into her sister handling hot oil. The 3 year old should not have been in the kitchen, thus there is some neglect on the mother even if the 14 year old is old enough, The mother should have at least been keeping an eye on the 3 year old. To that much I agree with the father on, but he was still an ass and thus deserves the situation he's in now. I can understand though wanting to have time to do the things you want to do and not having that time because of work and other day time responsibilities thus doing it at night when no one is around to bother you is a way to get that enjoyment, honestly this is as much his fault as it is a society that demands long work hours for a livable wage. Wanting a couple of hours to sleep and sacrificing his sleep to have time to enjoy himself should be allowed. But he totally shouldn't be a dick about a family emergency as a result, the lock on the door should never have been there in the first place.

Just this morning, I accidentally burned myself when my finger brushed against the side of a hot pan.

    Declaring a person dead who isn't in an attempt to make them talk to their family is grounds for 2 things:
    1. A restraining order
    2. A lawsuit for emotional distress, loss of education and earnings.
    A restraining order covers all of the family, the use of private investigators, electronic, written, visits by family members etc. If broken, it's considered contempt of court. Punishments include fines and custody.

Asked a friend if he could help me with something. After I explained how and what he helped me dig a small hole. Took an old picture of them both and placed the invitation in the small pit. Started recording and he lighted it and it was a really nice theraputic fire.
    Rented a truck for advertisement which could display a 'movie' on the sides. Parked it in front of the location where the celebration was at and played that video of the burning picture and invitation.
    Last thing I heard was that they truly expected I would come to their party. Also, they disowned me. Thanked them for informing me and smiled and moved on to the next topic.
